Can Fictional Characters be protected by a Copyright?

Summary: It is not specifically protected under Copyrights but are so by judge made laws. For a character to be protected it must have a distinctive identity from the said production, that is it must have such physical and conceptual qualities and identifiable character traits which can be identified by public even though the said character would appear in another production, that is independent from its parent production e.g Chulbul Pandey in Dabangg or rather Jethalal from Tarak Mehta; where you will be able to identify the character even though it is appearing as the character in another show/movie, etc.

Also the person playing the character has no right over the copyright obviously, only the production company has the right.

My question is whether a person playing such a character be separated from such distinctive identifiable traits/qualities. Even if it can be then what would be the limit where distinctive qualities are stopped by commonality. This can depend on case to case ofcourse.

Background Story: While I was on linkedin I saw a poll asking if Hastags can be trademarked. Yes they can be e.g: '# BornOfGreatness' registered by Suzuki Motorcycle India Pvt. Ltd. under class 35 - Marketing/Advertising.

There maybe many more but I discovered this one through a LinkedIn post by Kalpana Garg where the validity/qualifications required are also stated.

Then although not strictly trademark I wondered a charactered portrayed by a person in a serial be used for an Ad by any other company. Simply as an IP.

Obsession

Jack always has been quite the sporty guy, but a while ago, the care for his body got to a whole other level. He started to train harder, maintained and improved his shape rather obsessively, stocked up his cloth with a tighter that would excentuate that, shaved daily, got a haircut more than twice his usual pratice...

And all of it, because of his neighbour. Why, you ask? Not because of crush. Or maybe it even is something like that yet more of an obsession.

It was almost a year ago that he started to take notice of his neighbour. Or more the visitors he saw. After stumbling into quite the handsome guy, coming from his appartement, he noticed more of that. Fit guys, hunks to say the least, seemingly going in and out of his flat, more buff sometimes, sometimes daddys or even rather young ones, but always quite a nice range of guys coming in and out over the course of month. Probably nobody else noticed due to the big appartement building they lived in. But now he did, he couldn't not see it.

His neighbour though wasn't much like that. Quite average in his looks, bit older, no sports probably. Not to be rude, but it just didn't seem to klick.

More and more Jack noticed other odd Details. Bags for example, a backpack, that his neighbour carried as well as some of those guys, cloth that some wore, a cap for example, or a shirt.

On top of that it seemed like they rarely came twice.

At some point, he started to force conversation, sometimes waited even to get them at the elevator. At forst they were rather open yet shortnoted. But more and more they got quiet, nervous even, and it wasn't for long till Jack noticed a strange feeling talking to them. Something... unnatural in their behavior, something... oddly similar that he couldn't pinpoint.

He also started chatting to his neighbour although he hadn't had much of an interest. But he just wanted to know what it was that happened there! Probably something totally explainable yet like them beeing dates, escorts even. But something in his guts just told him, that there was more to it.

And it wasn't just the sightings with his neighbour that played into that. Some time after he started to notice those guys he also noticed a change at the gym, starting with a guy, looking at him rather openly while excercising, eventually starting to chat in the lockers. Was he hitting on him? Wouldn't be the first time. But it wasn't more than that, probably due to response. Ut was totally ok with Jack to get hit on by guys, rather flattering, but he just wasn't into guys in the slightest.

Several days later though, another guy approached him, making compiments while Jack was checking himself out in the mirror.

That happened with several guys, different types, different situations, under the showers even, sometimes excercising, and he got the feeling that it got more and more intense until it suddenly stopped. He almost missed those guys seemingly hitting on him although the more it happened, the more strange it became.

One day though, there was a guy again. He noticed him watching from afar, much like the guy a while ago, almost pearcing him with looks. But he wouldn't approach him. Not though, until he went to the lockers.

He was alone, undressing and just wrapping a towel around his waiste when the door opened again. It was the guy, that watched him so obviously. And now he came towards himwithout any hesitation.

"Got a great body" he stated, sporting a borad smile, looking at him from head to toe. "Wonder what that feels like"

I didn't really understand what he just said. Another flirty dude, I thought. But the moment I thought of that he charged at me, pushed me back a wall and without beeing able to react that push got even more intense as so did his smile. I felt his hand on my chest and... it seemed to sink in! I looked down, but I couldn't see what I felt, my body beeing stunned, his eyes fixed on mine. And as the feeling got more intense there seemed to be a kond of blurr, in lack of better words, emerging from that guy, rising from his body, pushing at mine while that feeling of his hand got even more intense. My whole body feeling a pressure, a push without beeing moved, a... fullness. As if something was getting into it, some energy, making my whole body pulsing more and more, feeling like it would explode every second.

And much like that blurr I saw emerging from that guy my sight started to blurr itself, my mind even, getting dizzy until I lost conciousness.

I have no idea how long it took, but it couldn't be long as I still was at the lockers. I stood infront of the mirror, looking at myself with satisfaction, a broad smile. But as I tried to move... I couldn't. And as I saw myself lookibg at me, it just didn't feel right at all.

It even got worse as I opened my mouth to say "Good morning!"

That!... I... I didn't do that! I... what was happening.

"Feeling alright?" I said. Or he? The guy in the mirror. I panicked, tryed to shoft, to move, to run even.

"Don't wreck yourself. Everythings fine. I'll just have a little run with that fine body of yours" he said, I said... lifting his hand to feel his chest... my chest.

And as I saw him doing this, feeling this. It felt... oddly comforting. He smiled, feeling up my chest, my abs, circling the edge of the towel.

And he smiled even wider as he seemed ti notice my reaction. I injoyed that! I wanted him to go further, me... that feeling of mbeeing touched, touching myself without doing it myself.

I almost shivered when my hand slid under. Yes, I wanted it, I wanted to feel that! And as I realized me, him, doing that inmidst the lockers I was even more excoted. I would never do that! But yet, at that moment, I wanted nothing more that him continuing.

And he did, explored, going further, moaning sloghtly as he injoyed himself, my body, his in a way, while I was sensing all of it, moaning almost without it really happening until he finished with an undiscribable feeling, my body exploding, beeing touched by myself, by him, me merely watching, experiencing in a way I can hardly describe in full extent.

And inmidst that overflow of sensations, of impressions, of feelings, I got blurry again, looking at my own eyes looking directly at me before I lost consciousness.

This time, I didn't wake up at the lockers. It took a while until I found myself, recognizing my bedroom.

It was late, dark outside. Hours must have passed. Was it real? It couldn't be otherwise. I just knew, that this wasn't a dream. And as I took it all in again, everything suddenly klicked.

Those guys next door, the guys at the gym, my neigbbour! But most of all, my very own experience. And all I could think of really was one thing... I want more!
