Good capture of Halloween! This was filmed on the aisle so you can see some people getting up and walking around at times. Today, a jointly selected impartial arbitrator issued a ruling agreeing with the NWSL Players Association’s position that 22 Players with 6 or more NWSL Service Years and contracts that expire on December 31, 2022 were eligible for free agency when the free agency window opened on August 26, 2022. Under Section 13.5 of the Collective Bargaining Agreement, Players with six (6) or more NWSL Service Years whose contracts are expiring on December 31, 2022 are eligible for free agency. The NWSL Players Association filed a grievance to enforce the free agency provisions of the contract on August 16, 2022. Hearings were held on October 4 and 6, 2022.

Each of these 22 contested free agents entered into contracts with their clubs that expire on December 31, 2022, and which contained a club option for 2023. The impartial arbitrator ruled that these options must have been exercised before the free agency window opened on August 26, 2022 in order to extend the term of the contract. No player received written notice from the NWSL of an intent to exercise the option before the first-ever free agency window opened.

The grievance and arbitration procedure that is contained in the Collective Bargaining Agreement is, itself, a win for collective bargaining. Through this process, the NWSL and the NWSL Players Association agree to submit issues where we cannot reach agreement to a jointly selected, impartial arbitrator. The grievance and arbitration procedure is a fair, collectively bargained mechanism that provides finality and instills confidence in the outcome.

The NWSL Players Association appreciates the parties’ commitment to a fair process, the diligence of the impartial arbitrator, and, as always, the engagement and solidarity of Players that makes our union strong.
