Un progetto che anticipa quelle che sembrano essere il modo di fare vacanza dei prossimi anni, ma che nasce da molto lontano: dall’esigenza di riscoprire delle tradizioni sane e a misura d’uomo.

CHIESE DEDICATE ALLA MADONNA DEL CARMINE

Storicamente la Chiesa di Santa Maria della Civitella o Madonna del Carmine è la più importante di Chieti, (CH), dopo la cattedrale. Si trova nel punto più alto della città, chiamata anticamente Theate, sopra un tempio pagano dedicato ad Achille, in Via Gennaro Ravizza, 105. Fu edificata nel 1295 dal Beato Roberto da Salle, quale chiesa del monastero benedettino dei Celestini, seguaci di Pietro da Morrone, dedicata all’Assunzione di Maria. Dell’antica Chiesa resta il portale gotico trecentesco di Nicola Mancino da Ortona, com’è documentato da un’iscrizione sull’architrave, con la scultura del re Carlo II d’Angiò, il volto del quale è ritratto in una scultura che campeggia sul portale. La Chiesa, a navata unica con alto tiburio e con volta a botte lunettata, fu completata entro il 1304 e nel 1321. Venne ristrutturata nella seconda metà del XVII sec. e trasformata con una struttura più moderna che fu curata dall’abate Girolamo Lasena a partire dal 1677 ed i lavori si protrassero per circa un decennio. Oggi rimangono al posto originario solamente l’affresco in cornice mistilinea che raffigura la Cacciata degli Angeli ribelli, dipinto dal pittore Donato Teodoro nel 1739, ed una delicata Madonna fittile policroma del ‘500 modellata secondo i canoni scultorei propri dell’arte Abruzzese del tempo. Sulla parete absidale una grande scenografia in stucco raffigurante l’assunzione di Maria. Sulla volta della navata, la grande pittura ad affresco della Caduta di Lucifero, opera settecentesca del Teodoro. Su un altare laterale, la statua in terracotta della Madonna della Neve. Nella Chiesa era custodito il corpo di S. Eleuterio, vescovo di Chieti, oggi custodito in Cattedrale. Dopo la soppressione dell’ordine celestino, Chiesa e monastero passarono ai frati Carmelitani, che diedero alla chiesa l’attuale nome di Madonna del Carmine. Occupato dai francesi nel 1799 e 1807, poi confiscato dal neonato Stato italiano, il complesso fu caserma, scuola e colonia sportiva, per diventate nel 1900 istituto delle Suore Orsoline. Công ty Sở hữu Trí tuệ WINCO yêu cầu bồi thường 35 tỉ đồng do hành vi xâm phạm quyền sở hữu trí tuệ

Liên quan đến vụ việc Công ty TNHH Sở hữu Trí tuệ WINCO đã gửi đơn tới TAND TP. Hồ Chí Minh yêu cầu Công ty TNHH Tư vấn quốc tế INCOLAW (Công ty tư vấn INCOLAW) và Công ty Luật TNHH INCOLAW (Công ty Luật INCOLAW) phải bồi thường 35 tỉ đồng do có những dấu hiệu xâm phạm quyền sở hữu trí tuệ, PV đã có cuộc trao đổi với ông Nguyễn Văn Lợi, nguyên Thẩm phán TAND Tối cao.

Trong quá trình hội nhập kinh tế quốc tế hiện nay, Việt Nam đã tham gia rất nhiều các Hiệp định hợp tác song phương, đa phương và gần đây vừa mới kí kết gia nhập Hiệp định Đối tác Kinh tế toàn diện khu vực (RCEP) vào ngày 15 tháng 11 năm 2020.

Thực thi hiệp định RCEP mở ra rất nhiều cơ hội trong quá trình lưu thông hàng hóa, dịch vụ giữa các nền kinh tế. Tuy nhiên, bên cạnh những mặt thuận lợi, những xâm phạm, tranh chấp về quyền sở hữu trí tuệ cũng sẽ gia tăng mà các doanh nghiệp Việt Nam cần lưu ý để bảo vệ quyền sở hữu trí tuệ, đảm bảo cho hoạt động kinh doanh được thông suốt. Mặt khác, cũng đòi hỏi các cơ quan thực thi pháp luật phải nâng cao năng lực trong công tác thực thi để bảo vệ quyền sở hữu trí tuệ theo quy định của pháp luật hiện hành.

Đơn cử như vụ việc tranh chấp quyền sở hữu trí tuệ giữa Công ty TNHH Sở hữu Trí tuệ WINCO (Công ty WINCO, địa chỉ 54, Trần Quốc Vượng, Cầu Giấy, Hà Nội) với Công ty TNHH Tư vấn quốc tế INCOLAW (Công ty tư vấn INCOLAW) và Công ty Luật TNHH INCOLAW (Công ty Luật INCOLAW), cùng địa chỉ Tầng 1, Tòa nhà Alpha Tower, số 151, Nguyễn Đình Chiểu, phường 6, quận 3, thành phố Hồ Chí Minh, đang được TAND TP. Hồ Chí Minh thụ lý gần đây.

Căn cứ khởi kiện là Giấy chứng nhận đăng ký nhãn hiệu số 60668, được Cục Sở hữu Trí tuệ Việt Nam cấp từ năm 2005, cho nhãn hiệu “WINCOLAW và hình” cho Công ty WINCO. Trong khi đó, năm 2017, Công ty tư vấn INCOLAW mới nộp đơn đăng ký nhãn hiệu “INCOLAW” tại Cục Sở hữu Trí tuệ Việt Nam.

Liên quan đến vụ việc này, chúng tôi đã có cuộc trao đổi với ông Nguyễn Văn Lợi, nguyên Thẩm phán TAND Tối cao.

PV: Xin ông đánh giá khi so sánh giữa nhãn hiệu “WINCOLAW và hình” với dấu hiệu “INCOLAW” cho cùng các dịch vụ “tư vấn pháp lý, dịch vụ sở hữu trí tuệ” có sự tương tự gây nhầm lẫn hay không?

Ông Nguyễn Văn Lợi: Để đánh giá một dấu hiệu có sự tương tự đến mức gây nhẫm lẫn với nhãn hiệu được bảo hộ hay không cần căn cứ các quy định nêu tại Điều 74.1, Điều 74.2 (e) Luật Sở hữu Trí Tuệ và Điểm 39.8 Thông tư 01/2007/TT-BKHCN hiện hành.

Trong trường hợp cụ thể này, nhãn hiệu “WINCOLAW và hình” là sự kết hợp của hai thành phần chính: thành phần “hình”  và chữ “WINCOLAW”.

Cả hai thành phần này đều có khả năng phân biệt, trong đó phần chữ “WINCOLAW” được viết in hoa đậm, tạo ấn tượng mạnh về thị giác khi quan sát nhãn hiệu. Mặt khác, do là yếu tố chữ nên thành phần “WINCOLAW” này dễ được ghi nhớ thông qua hình thức phát âm, truyền khẩu hoặc qua các phương tiện thông tin bằng âm thanh nên chiếm ưu thế hơn khi so sánh với dấu hiệu khác để đánh giá tính phân biệt.

Do vậy, trong trường hợp cá nhân, tổ chức khác sử dụng bất kỳ dấu hiệu nào trùng hoặc tương tự với một trong các thành phần nêu trên của nhãn hiệu “WINCOLAW và hình” sẽ dẫn đến sự nhầm lẫn về chủ thể quyền, đặc biệt là khi sử dụng dấu hiệu trùng hoặc tương tự với thành phần chữ “WINCOLAW”.

Có thể nhận thấy, dấu hiệu “INCOLAW” chỉ thiếu ký tự “W” đứng đầu so với nhãn hiệu “WINCOLAW và hình”, còn lại đều trùng với nhãn hiệu này cả về ký tự và vị trí sắp xếp các ký tự. Điều này dẫn đến cách phát âm cũng tương tự nhau. Ngoài ra, dịch vụ gắn dấu hiệu “INCOLAW” là dịch vụ pháp lý, tư vấn sở hữu trí tuệ cũng trùng với dịch vụ được bảo hộ của nhãn hiệu “WINCOLAW và hình” đã được đăng ký bảo hộ. Như vậy, căn cứ theo các quy định pháp luật đã nêu, có cơ sở để kết luận rằng dấu hiệu “INCOLAW” là tương tự đến mức gây nhầm lẫn với nhãn hiệu “WINCOLAW và hình”.

Theo tôi được biết, Cục Sở hữu Trí tuệ Việt Nam cũng đã thẩm định, xem xét và từ chối nhiều trường hợp tương tự như trường hợp nêu trên như: “SEXTRA và SEXFTR”; “LASENA và SENNA””…

PV: Được biết, Công ty Tư vấn INCOLAW cho rằng: “Nhãn hiệu “WINCOLAW và hình” được bảo hộ tổng thể, tức là được bảo hộ kết hợp cả hai phần: Phần chữ “WINCO”, “WINCOLAW” và hình, chứ không bảo hộ riêng chữ “WINCOLAW”. Phần chính của nhãn hiệu là phần hình, phần chữ “WINCOLAW” không phải là phần chính của nhãn hiệu. Trong khi đó, dấu hiệu “INCOLAW” chỉ gồm phần chữ “INCOLAW”, trong đó nổi bật là chữ “O” được thể hiện cách điệu với hình dạng mặt đồng hồ, và chữ “A” cũng được thể hiện cách điệu với hình dạng như mũi tên đi lên. Do đó, hai nhãn hiệu này hoàn toàn khác nhau”. Ông có đánh giá gì về ý kiến này của Công ty Tư vấn INCOLAW?

Ông Nguyễn Văn Lợi: Cá nhân tôi cho rằng, ý kiến này của bên bị đơn là chưa phù hợp với các quy định pháp luật tôi đã nêu ở trên. Như đã phân tích, trong nhãn hiệu có sự kết hợp cả chữ và hình thì phần chữ luôn luôn đóng vai trò quan trọng hơn, ưu thế hơn phần hình về khả năng phân biệt bởi chúng không chỉ được đọc, được ghi nhớ bằng thị giác mà còn được ghi nhớ thông qua sự truyền khẩu hoặc qua các phương tiên thông tin bằng âm thanh…

Dấu hiệu INCOLAW tuy có phần chữ O và A thể hiện cách điệu nhưng các chữ cái này vẫn được nhận biết là chữ O và A, vẫn được ghi nhớ là INCOLAW mà không phải là một dấu hiệu khác.

PV: Viện Khoa học Sở hữu Trí tuệ, Bộ Khoa học và Công nghệ đã có kết luận giám định dấu hiệu “INCOLAW và hình” là yếu tố xâm phạm quyền đối với nhãn hiệu được bảo hộ của Công ty TNHH Sở hữu trí tuệ WINCO. Vậy, xin ông cho biết, kết luận giám định trên có phải là chứng cứ để tòa án xem xét yêu cầu khởi kiện của nguyên đơn hay không?

Ông Nguyễn Văn Lợi: Theo quy định nêu tại Điều 94, Bộ luật Tố tụng dân sự 2015, kết luận giám định được xác định là một trong các nguồn chứng cứ để tòa án sử dụng làm căn cứ xác định tình tiết khách quan của vụ án cũng như xác định yêu cầu hay sự phản đối của các đương sự là có căn cứ và hợp pháp.

PV: Xin ông cho biết thêm, Công ty WINCO đã khởi kiện hai công ty nêu trên tại TAND TP. Hồ Chí Minh để yêu cầu chấm dứt hành vi sử dụng bất hợp pháp dấu hiệu “INCOLAW” trong tên thương mại, trên biển hiệu, website, trên các phương tiện quảng cáo, phương tiện kinh doanh, phương tiện dịch vụ cho các dịch vụ tư vấn pháp luật, dịch vụ sở hữu trí tuệ, dịch vụ tư vấn pháp lý khác. Đồng thời, yêu cầu tòa án buộc các bị đơn phải bồi thường thiệt hại với số tiền tạm tính lên tới 35 tỉ đồng do sử dụng nhãn hiệu bất hợp pháp là có hợp lý hay không?

Ông Nguyễn Văn Lợi: Căn cứ phát sinh trách nhiệm bồi thường thiệt hại được xác định theo quy định nêu tại Điều 584, Bộ luật Dân sự năm 2015. Trong trường hợp này, nếu Công ty WINCO chứng minh được hành vi xâm phạm quyền của Công ty Tư vấn INCOLAW và Công ty Luật INCOLAW đã gây thiệt hại về vật chất cho mình thì có quyền yêu cầu Tòa án quyết định mức bồi thường theo một trong các căn cứ quy định tại Điều 205, Luật Sở hữu trí tuệ. Mức yêu cầu bồi thường căn cứ vào tính chất và mức độ xâm phạm, tức là căn cứ vào động cơ xâm phạm, cách thức thực hiện hành vi xâm phạm, thời gian thực hiện hành vi xâm phạm, quy mô thực hiện hành vi xâm phạm… Do đó, việc nguyên đơn yêu cầu bồi thường với mức 35 tỉ đồng là có thể xảy ra.

Ngoài bồi thường thiệt hại, bị đơn còn phải chấm dứt việc sử dụng dấu hiệu “INCOLAW”, thực hiện việc thay đổi tên thương mại, chấm dứt việc sử dụng tên miền, xin lỗi cải chính công khai trên các phương tiện truyền thông…
