So, since the custody was out of its jurisdiction, the Miami court approved an abatement, which is basically a suspension of the divorce case, until they reached a permanent custody agreement.

So, I think they already reached a permanent custody agreement in the UK court, which was approved on January 11, 2024, and that's why Sophie dropped the international lawsuit at the New York court, and requested to the Miami court to "reactivate" the divorce case on January 14, 2024, but this was only recently made public.

We don't know the details of the permanent custody agreement. But I hope she has primary custody, and the rat has visitation rights.

Arlen paid a surprise visit to Hoyt's home in a quandary the night after their rescue tells her that his ex-wife Carla had taken their daughter back to Texas leaving him unsure about staying in Montana. After a few beers, things started getting close to crossing the professional/private line between them. He left saying neither was clear-headed enough to make any rational decisions that would change them from colleagues and occasional confidants.

A week later, Arlen was served court papers stating that he’d allowed their daughter to remain in a place of known danger and Carla was granted primary custody with all communication between them monitored by a court-appointed third party.

Arlen had what Cassie calls his tantrum then sought legal counsel from a lawyer he knew back in Houston. The lawyer advised with his checkered history in law enforcement and at home, to follow the stipulations to the letter if he hoped for a chance in hell of regaining his parental rights before Emily turned eighteen.

Sergeant Madge Crowder greeted the returning duo with, “Got a visitor, sheriff.”

Entering his office, Arlen spies the Stetson from that morning sitting upside down on his desk.

“Hello, I’m Sheriff Arlen. What can I,” and something that rarely happens happens when its owner turns, and Arlen loses his voice. “You must be the infamous Reina Stanley.”

“Call me Beau. “I see Denise Brisbane is still the town gossip.” Arlen chuckled, “She does have her ear to the ground. Denise didn’t go into details but mentioned your family has substantial influence in this state.”

“Hold on, Gerald was your grandfather? The same Gerald I’d go trout fishing with?”

“Walter Tubb’s said you were quick on the uptake. Lala Gerald chose to use his given name outside of business.” The sheriff tipped his head. “Right, you're a transplant. The Stanley descendent who settled here left a will stipulating that all direct descendants maintain the family surname to keep their inheritance, including any man marrying in.” Reina paused scrutinizing him giving Arlen a fluttering he hadn't felt in years.

“Tubb also said you have a set of huevos for taking the job even after getting an earful about the undersheriff.” Arlen chuckled, “Yeah, Tubb had a few things to say about Hoyt. But she knows to stay between the lines, I’ll have her back.”

Taking out his cellphone, he decided to type what he wanted to say and let the translator help him.

Before he could ask why, a loud music and confetti exploded around them.

There were feathers and people dancing holding signs with Bem-vindo [welcome] written in bright colors, Y/N was pulled by a sea of people who wrapped her in hugs and love, he knew she had eight sisters and one brother and everyone were expecting to see her after along time overseas.

Cillian was moved by the love they were showing her and he saw other people joining the traditional samba dance, completely strangers passing by united by the moves that every single person there knew by heart. Y/N had tried to show him some, but he was a lousy dancer and he didn’t want to embarrass himself.

“Me deixa apresentar meu namorado, Cillian.” Y/N leaned her head on his shoulder and wrapped her hands around his waist. [Let me introduce you to my boyfriend]

Feeling his palm sweat, he smiled at her family. “Plasher e-e conusherlo” He stuttered, shaking his head. “Prazer em conhecê-lo.” He repeated. [It’s nice to meet you.]

“Bem vindo a familiaf.” [Welcome to the family]. A woman that looked just like Y/N walked towards him to greet him in a warm hug. “Você está pronto para o carnaval?” [Are you ready for the carnival?]

Cillian looked at Y/N mortified, he didn’t understand a single thing but the last word.

“She welcomed you into the family and asked if you’re ready for the carnival.”

“Muito obrigado.” He looked at Y/N’s mum, feeling proud of the very few words he knew. “As long as you don’t make me dance.” He chuckled then.

“After a few caipirinhas we all become trilingual.” A man approached them.

“Cill this is my brother Marcus.” He saw Y/N hugging him.

“Why didn’t you let me drink a caipirinha in the flight?” He laughed nervously, but grateful to know that her brother spoke English as well.

After kissing and hugging at least a dozen of people, they drove away from the airport and it was a funny dynamic since it was him or her family waiting for the translation.

The family had decorated the house with colorful flags and balloons, there was a huge table set with all kinds of foods, Y/N named them all for him; feijoada, moqueca de Camarão, empadão, he was particularly fascinated by the brigadeiro.

After several caipirinhas, he started to speak more fluently, asking whoever was in front of him of how to say something, his cheeks were turning a bit red from the alcohol and he was really enjoying himself that he didn’t even noticed Y/N was gone until Marcus made him a sign and Cillian turned his head to find her with the rest of her sisters in typical carnival customs, a loud cheering in the background as they started to dance samba to the music.

Cillian’s eyes popping almost from his head, his mouth hanging open as the sequins and feathers hugged her body beautifully. Her hips shaking to the rhythm and her face glowing from the happiness.

Everyone from the kids to the adults joined them, and he even ended up dancing with Y/N’s mother.

Once the sun went down and the spirits calmed, Cillian winked at Y/N across the room, joining her soon.

“I’m hoping for a samba private dance later.”

“Maybe if you’re lucky.” Y/N winked as his hands squeezed her hips.

“Te amo muitíssimo.” Cillian declared clearly.

Y/N secured her arms around his neck, it was the first time that he said I love you so much in her mother language.

Whoa holy shit what happened to your cousins??? Are they okay??

This was two years ago! Just to start off but ummm let me try to summarize this (very long story) but in 2022 my uncle died and 2/3 of his kids were under 18 and my mom got immediate temporary custody and they lived with us, my mom got them on our insurance, appointments for vaccines with our doctor (their dad was anti-vaxx), my mom got them enrolled in a local school, etc, all this to say she was a good guardian and cared for them (better than their dad but not the point rn)

after some shit happened that i don't want to post abt publicly, my mom took them to a memorial service for their dad in the woods (what he would've wanted) and camped over 4th of July weekend and adults that went told my mom they were taking my cousins and would press charges against her of she fought back (let it be said she was also. Mourning her fucking brother ????) And just. Took them. My mom got a lawyer and tried to win back custody but the kidnappers were rich and my mom isnt lol and did a he said she said bs saying the kids wanted to live there bc a friend of their dads said so (thalia i hope u fucking drop dead btw. Stop "fostering" kids illegally on ur property without running water. Also ur annoying) also they said my mom was a Satanist practicing black magic (none of which is true) and it was "inappropriate" of her to let my cousin (a boy) wear a dress and go to local pride events . Which 😐😐😐😐😐 anyways the kidnappers won the court case. So. Yeah

There were murmers of agreement from both sides, though everyone fell quiet when Judge Kirby's face turns serious. "And that brings us to our next order of business; the gathering of evidence for both sides. Since this custody battle came one abruptly, I understand that neither side has had time to compile evidence?"

The lawyers for both sides nod.

"I believed so." the judge sighs. "So, since we already have all of these affairs in order, I'll allow a three day period for both sides to compile their arguments. During this time.. I will be assigning Ms. Lilly a temporary guardian until the time comes."

"What?!" the Estrellas shout.

"Why?!" the SMGs cry.

"Because there could be conflicts of interest, or either side could.." Judge Kirby coughs. "Pardon, either side could.." the judge coughs a few more times before forcing out the words. "Either side could try and influence her."

There were many things Meownager was prepared for. But being called into the Mushroom Kingdom Supreme Court was not one of them. They definitely didn't expect to be standing before a judge, either.

"So, you are.." Judge Kirby's eyes narrow at the paper in front of him. "The Meownager?"

"Meownager is just fine," the cat speaks. "But yes, I am, your honor."

Judge Kirby nods. "Good! So, Meownager, what is your relationship to Mario Mario?"

"He's a customer of mine that comes in once and a while. We chat, but never anything too deep." Meownager speaks, voice calmed and collected.

"Has he told you that he knows SMG4 and SMG3, who are currently engaged in a custody battle?" the judge asks.

"No." the cat shakes their head. "Like I said, he only comes in once and a while. He's never talked about his personal life."

Their eyes drift up to the witness stand, and they see Lily there. Her head is down and her face downcast. Their heart aches. Anytime they saw her, she looked so lively. Now.. she looked nothing like that.

Judge Kirby continues, "are you capable of taking care of a child?"

"Yes, your honor."

"Are you currently wanted for any crimes?"

"No, your honor."

The questioning continued until Judge Kirby nodded, satisfied. "Well then! Meownager, I'm placing Ms. Lily in your custody and granting you temporary guardianship of her. You'll be taking care of her until the custody battle is over, and then the winners of this trial will be her guardians. Do you agree to take Ms. Lily into your care until then?"

Meownager nods without a second thought. "Yes. I agree."

"Good. Bailiff?" Judge Kirby looks down at a Shy Guy wearing a cop hat. The Shy Guy nods and walks over to the witness stand.

"When did you get a bailiff?" Mario asks.

"After last time, we realized we needed one." the judge states.

Meownager hops off of the box that they were standing on so that they could they could be heard easier. The Shy Guy walks Lily over to Meownager before then walking back.

"Meownager, Ms. Lily, you two are free to leave." Judge Kirby speaks. "I have a few more things to hash out with each side here. You'll get a letter when it's time to bring Ms. Lily back to the court, Meownager."

"I understand." Meownager nods. They reach up a paw for Lily to take, which she quickly does, and the two walk away.

As they walk out the large wooden doors, Lily glances over her shoulder to look at her dads.

They both look at her as well. They seem sad, but determined. They smile at her reassuringly.

It makes Lily smile, even as the giant wooden doors slam shut soon after.

The human and the cat walk through the halls, quiet. Lily hesitates before speaking. "You.. do know you technically lied under, oath, right? You downplayed your friendship with Uncle Mario.."

"I owed him a favor anyway." Meownager smiles. "That, and I'm in full support of your dads, Lily. If it takes a little perjury to reassure them you'll be with someone safe, I'm willing to risk it."

If a really good lawyer (😉) were to defend Trish Walker for the crimes she committed in JJS3, what would his defense strategy be?

Frankly, I feel like it would go something like this: Matt argues temporary insanity. That Trish became disassociated from reality as a result of the experiment Dr. Malus subjected her to, and then she snapped and brutally murdered her mother's killer. He also has Jessica discredited as a witness by bringing up her sketchy track record and the broken chain of custody with the evidence (and also has Trish testify to how Jessica destroyed evidence in the investigation that would have put Sallinger away), and maybe makes the argument that Trish doesn't deserve to go to prison by virtue of the fact that there's another vigilante in New York who does the same thing Trish does (and the only difference between Trish and Frank Castle is that Frank is a man, he's killed way more people, and he was initially motivated by revenge while Trish was initially motivated by more wholesome reasons).

And I think at the end of it, Trish would be sentenced to time served plus probation (with court-mandated therapy).

Or do you think Matt would take a different defense strategy?

So this is a really late reply, and the major caveat is that I’m not nearly as familiar with the facts of Jessica Jones as I am with Daredevil. So everyone please feel free to correct me if I seem to miss anything!

An insanity defense might work. In NY, you can use an insanity defense (technically “mental disease or defect”) if your “disease or defect” meant that, when you committed the crime(s), you lacked the capacity to know or appreciate either: 1) the nature and consequences of your conduct; or 2) that such conduct was wrong.

In Trish’s case, it would be tricky because experts can’t give a final conclusion on the matter—like, an expert can’t say, “Trish was definitely incapable of forming the requisite intent for a guilty verdict, based on their mental health.” What an expert can say is, “When ✨a person ✨experiences [x, y, z] events or their brain is affected in [x, y, z] ways, which can lead to [x, y, z] thoughts/behaviors/etc.” The obvious difficulty here is that Dr. Malus’ experiments on Trish aren’t exactly well-studied. So you’d have to get an expert to examine Trish, get reports (if they exist?) of the experiment (maybe try to find Dr. Malus and interview him?) and essentially reverse-engineer what Trish experienced, and then try to say how that would have affected ✨ a person’s ✨ ability to understand their own actions—then in closing argument, Matt would argue that it would affect Trish the same way.

Would the jury buy it? I don’t know. Would Matt buy it? I don’t know. I personally am not sure I buy it: Trish has always been more motivated to Take Action and Stop Bad Guys (not unlike Matt), and she’s always been frustrated that she doesn’t have the abilities of someone like Jessica to do that. In fact, I think her lack of abilities has been the only thing stopping her from taking illegal action. Again, I think she and Matt have a lot in common (@some-fiction I'm thinking of your fics! ❤)—the difference being that Matt draws stronger, clearer lines as to what kind of illegal action he finds appropriate.

So yeah, if Trish had come by her powers in a way that didn’t affect how she thought at all, I could still see her making the same choices.

If the jury reaches the same conclusion, then a mental disease or defect defense won’t work—unless there’s something else causing her to be Like That. But I can’t think of anything in the show suggesting that Trish is Like That for any reason other than…just her personality.

Anyway.

Unfortunately, I’m not sure what part of Jessica’s history will be admissible to discredit her as a witness. Matt could try to prove that she’s lied before, but how exactly would he prove that? Especially because you can't bring in extrinsic evidence to prove a witness was lying about something unless the lie is material to the case. So sure, Jessica's pretended to be other people to con her way into places, but you wouldn't be able to call the people she lied to as witnesses to testify.

And she hasn’t committed perjury that I’m aware of, which is the best way to discredit a witness. Nor has she been actually convicted of a crime, right?

In short, the rules of evidence governing discrediting a witness for truthfulness are 608 and 609, and I just don’t think either of them apply. Nor could I see Matt being comfortable making that argument anyway, except perhaps by pointing to Jessica’s willingness to destroy evidence. If she gets convicted of that, even better.

Chain of custody is a great route to go, I just…don’t remember what evidence Jessica destroyed and how determinative it would be. Did she destroy / tamper with all the evidence of Trish’s activities? Not that I recall. So that route would help, but it wouldn’t guarantee an acquittal.

As for comparing Trish to Frank…nope, that won’t work at all. Firstly, it's not like Frank got off; he actually was convicted…he just escaped.

Secondly, whether one criminal is worse than another doesn’t matter at all except for sentencing—it doesn’t affect whether someone is guilty of a crime in the first place. Someone is guilty if they break the law, regardless of whether someone else broke it more, had worse reasons for doing so, etc.

So basically: Trish is guilty of killing X number of people for wholesome reasons + Frank is guilty of killing Y number of people due to revenge (which is debatable but let’s go with this for now) = Trish gets, at least, the minimum sentence for killing X number of people, and perhaps the reason she doesn’t get above the minimum sentence is because of her wholesome motivations, while Frank gets possibly more than the minimum sentence for killing Y number of people because he did it for less wholesome reasons.

Conclusion: both of them get convicted, even if her sentence is lesser. So this argument doesn’t help unless Matt is resigned to Trish getting convicted.

Personally, I don’t think there is a great strategy, other than mental disease or defect and the catch-all reasonable doubt defense (made simply by pointing to anything he thinks the prosecution can’t 100% prove). But the simple truth is, Trish committed multiple crimes. Aside from the mental disease or defect defense, the only strategy is to poke holes in the prosecution’s available evidence. I don’t know if Matt can do that enough to get Trish off.

Ultimately, I think the point at which advocacy will really help Trish is at the sentencing stage…plus dealing with her unconstitutional treatment post-arrest.

But that’s a whole other issue. 😉

In 2021, over a decade after being in a conservatorship, singer Britney Spears posted a furious rant about her mother Lynne on social media. The singer was born to Lynne, a school teacher and Jamie, an alcoholic building contractor in a small town in Louisiana.

In Britney's recent post, she claims her mother 'thrived on drama' and that she would argue with a 'drunk' Jamie 'every night of my life.'

Jamie's brother, Willie, told an outlet that Jamie would often get drunk and argue with Lynne, and that once he even tried to 'drive off with Britney' during an argument.

Britney says her father Jamie was abusive to both her and brother Bryan.

"My brother was a football player. And my dad was really, really hard on him when he was younger, really abusive," she alleges.

Britney adds that her father 'controlled everything I did' but that she 'had to go along because I knew they could hurt me.'

In 1979, Lynne reportedly filed for divorce and tried to obtain a restraining order against Jamie after an infidelity, but the divorce filing was withdrawn shortly after.

An OnlyFans model, accused of stabbing her boyfriend to death in Miami in April 3, was arrested on Wednesday and charged with murder, her lawyer confirmed to Yahoo News.

Courtney Clenney, 26, was taken into custody in Laupahoehoe, Hawaii — more than four months after her boyfriend, Christian “Toby” Obumseli, was killed.

“We are completely shocked at Courtney’s arrest based upon the clear evidence of self defense in this matter,” Clenney’s lawyer, Frank Prieto, told Yahoo News via email. “Further, we are disappointed that the state attorney sought an arrest warrant in this matter. … We have always offered to self-surrender if charges were filed in an effort to begin the legal process of clearing her of the charges.”

Clenney, a white social media influencer and OnlyFans model who also goes by the name Courtney Tailor on social media, is being charged with second-degree murder with a deadly weapon, according to the Hawaii Police Department.

The Miami Herald reported Clenney had been in Hawaii seeking treatment for PTSD and rehabilitation for substance abuse. But her lawyer maintains that Clenney was the victim in the entire ordeal, not Obumseli, a Black cryptocurrency investor, and promised to do whatever it takes to clear her name.

“Obumseli attacked her and choked her that evening; Courtney had no choice but to meet force with force,” Prieto said. “Courtney was clearly defending herself. We will vigorously defend Courtney and clear her of this unfounded and baseless charge.”

The attorney for the Obumseli family, Larry Handfield, did not immediately respond to Yahoo News’ request for comment, but in a previous statement, he said the Obumseli family just wants justice.

“The family just wants accountability,” Handfield told Yahoo News in April. “That’s all the family wants.”

The arrest warrant for Clenney, which is currently sealed, was issued by Miami-Dade County, Fla., and will likely be made public ahead of a press conference Thursday afternoon held by the Miami-Dade State Attorney’s Office, according to a press release issued Wednesday evening.

For many critics, Clenney’s arrest is just the latest domino of evidence in a delayed justice system for Black Americans. For others, her arrest exemplifies the legal system working as it should.

“I believe that if she was Black, she would have been arrested and [police would have] let the process play itself out,” Handfield said earlier this year. “But since she was treated with privilege, she has not been arrested.”

The fatal stabbing of Obumseli, according to police, was the result of a domestic dispute. Clenney had called authorities after the ordeal and told police that she had feared for her life and acted in self defense. She was eventually hospitalized for psychiatric evaluation under Florida’s Baker Act, which provides emergency mental health services and temporary detention for people at risk of suicide or mental health crisis. But she was soon released and spotted out at a hotel bar five days after the stabbing.

Clenney and Obumseli, who had recently moved together from Austin, Texas, to Miami, were known to police prior to the fatal stabbing because officers had been called to their apartment at least four times in recent months in response to disturbances, but no arrests were made.

Obumseli’s family has maintained that they never believed he was ever a threat.

“We have no cause to believe that this was a case of self defense,” Obumseli’s cousin Karen Egbuna said at a press conference five days after the killing.

As of Wednesday, Clenney was being held at East Hawai’i Detention Center and is expected to appear in district court on Thursday. Local police said she will “eventually will be extradited to Florida.”

Clowning Around's Jester

Hello folks, we'll be talking more about the Clowning Around AU specifically Jester. There also some plot exposition as well!

Tricky's power can be wielded by MK in various different ways but not at 100%...yet. At the moment, our Monkie Kid must fuse his zombie clown guest into their combined form for Tricky's power to be fully unleashed: Jester.

This undead clown's visage is similar to that of a Chinese Opera performer specifically the Jester role with a Tricky mixed style. Just like the assassin, Jester refers to himself as well...Jester.

"You don't kill Jester! Jester kills you!"

"Oh teh noes! So close to catching Jester!"

"Cheater! Jester burns away cheaters!"

Yep, even this fusion has some of Tricky's insane tendencies but is surprisingly more focused and empathetic. Elements that no doubt originate fron MK's honorable kind hearted nature. Despite being this demon clown's host, this young man is still worthy to wield the Monkey King's Staff: Ruyi Jingu Bang.

Sun Wukong's magic further evolving the powers of Jester and gives MK even more access to the Improbability Drive's unique functions. An Emergency Stop Sign now a powerful cudgel capable of creating hellfire shields with Tricky's unique signature. Can't forget that the clown can now manifest with a temporary body of his own!

For any Madness Combat fans, if you are wondering if MK also gained one of Tricky's most infamous powers...he sure did. I'll be drawing it just like I've drawn Jester. But for now, onto the plot!

Thanks to being Tricky's host, MK is unfortunately wanted by the Heavens/Celestial Realm. Word got out about a 'mysterious clown' causing problems in the mortal realm specifically Megapolis. The same place that the Prison Pill holding Tricky had disappeared. Jade Emperor theorized that someone down there has become the demon clown's host.

An incident that has a few immortal soldiers to even generals hiding amongst Megapolis' population in search of Tricky's host. One of them being Erlang Shen, the immortal responsible for capturing Sun Wukong which led said monkey to being tossed into the Eight Trigram Furnace. Yeah, MK now has a few immortals added to his enemy list.

Sun Wukong is informed about this hunt via scroll but he tossed it away. This monkey doesn't read his own lawyer's emails so he'll toss away any orders from the Heavens. An action that will come back to bite him on the ass considering the Macaque episode. Plus when you take into consideration on how protective Tricky is involving MK... It ain't gonna be pretty.

Once he finds out, the Monkey King won't have much time to put MK into his protective custody unlike in Wrathful Idol.

Anyway, there is one person in MK's friend group that knows about Tricky and Jester. This individual being Mei who helps our Monkie Kid find cover whenever he has to 'Go Clown'. Got the whole Danny Phantom skit going on here but with zombie assassins. Also MK does say a transforming catchphrase like 'Going Jester' or 'It's Time To Clown Around' mainly cause Tricky thinks it's cool despite it being cheesy. Something he could do to make his clown friend happy.

Now, Jester and MK will be rotating certain battles when it comes to the canon episodes. I'll partially be using canon but most of it is going to follow my personal plot.
