Yes, there are provisions for challenging unconstitutional rules that govern behavior that you might wish to take but haven't taken because you consider the rules burdensome. Under the Colorado law, if Smith designs any wedding website she is required to serve gay marriages. So the fact that she has never designed a wedding website is what gives her standing - she might like to, but for Colorado's unconstitutional law.

If you think about it, it pretty much has to be this way? Consider a law that requires you to give up custody of your children if you host a drag show. You might believe this law to be unconstitutional, but it's a big ask for you to sacrifice your children for a chance to fight it. That's why you're allowed to argue for an injunction for a law you haven't yet run afoul of.

Today's court ruling weakening discrimination protections for LGBTQ people stands out as extraordinarily strange to me for the simple fact that there was no case. The web designer in question never received a request to create a website for a gay wedding, but instead argued that a hypothetical situation in which she did would violate her rights. I've never really heard of anything like this before— how does she even have standing to sue? Can @radiofreederry or someone with more knowledge of legalese than me elaborate on this?

In this latest case, there is no website and no wedding—just an argument from an anti-LGBTQ group in search of the court’s favor... No person has hired Smith to create a wedding website. As such, there is no client Smith has told she is rejecting due to her stated religious beliefs that marriage is only allowed between one man and one woman. In the absence of all that, ADF has, instead, fashioned Smith as the victim of an injury that has never occurred.   So who has hypothetically victimized Smith? Conservatives better get really comfortable with infantacide real quick. Abortion rights as well as other forms of birth control are under threat and sex education in schools is abysmal by design. People can't afford to feed themselves let alone spend upwards of $50 dollars on baby formula.

CPS already doesn't do their job, the foster system is overloaded and federal goverment spending is expecting to drop to 6% by 2033. The adoption process is predatory, lengthy and tedious and costs $20 grand and babies who are nonwhite are less likely to be adopted as well as babies with visible disabilities.

Conservatives better get comfortable with increased cases of shaken baby syndrome, repeaded child abuse and neglegence, kids that go to school hungry because their parents aren't feeding them, children getting dropped off at a realtive's house or daycare and their parents not coming back for them, babies being born with developmental malformation from failed at home abortion and acute withdrawl from drug or alcohol use.

Republican conservatives better start getting comfortable with more people throwing their newborns into trash cans or leaving them on the side of the road or snuffing them with a pillow because even if you can force people to have babies you can't force people to raise them. You can throw that person in prison, but the US's obsession with crime and punishment does not take preventative action, nor does it reverse time.

You cannot explain these instances of clear sexualization (and of CHILDREN) with “commentary.”

That context/knowledge somehow makes it worse. They have six nipples too as they’re not fully human, and it could be a great opportunity for the “deal with it, it’s not framed weirdly,” and then it’s fucking framed weirdly! Instead of a tool for demonstrating their difference or widening the readers’ horizons, it feels a lot like it plays into the sexualization. Btw nipples on full display, shaded and everything, for a long time now, if you don’t know. *They also sucked on Reg’s arm.

There’s times where it seems like it’s commentary or maybe accident and you want to give the benefit of the doubt, especially when Faputa is so fucking cute all the time but… no, it’s too fucking obvious. There are ways to make these scenes nonsexual, to actually say “yeah, we’re going there, deal with it,” or “wow, nonsexual nudity? It does exist!” MiA is not that.

Some of these scenes make sense with that they’re children and exploring, but then why the fuck go that far/give them that framing!

Side note: I mention opportunities of exploring more animalistic humanity/other facets of humanity (especially in alternate universes) because it’s interesting and an opportunity to NOT sexualize everything—however, preferably not with children. I’m sick of how everything is sexualized. Naked bodies no matter the age have been sexualized. It’s disgusting and exploitative.
