समलैंगिकता के खिलाफ अंग्रेजों ने धारा 377 को 1860 में लागू किया था। 158 साल पुराने इस कानून के द्वारा समलैंगिकता को गैरकानूनी बताया गया है।अविभाजित भारत में वर्ष 1925 में खानू बनाम सम्राट का समलैंगिकता से जुड़ा पहला मामला था। उस मामले में यह फैसला दिया गया कि यौन संबंधों का मूल मकसद संतानोत्पत्ति है लेकिन अप्राकृतिक यौन संबंध में यह संभव नहीं है।
