🇿🇦🇮🇱 🚨 GENOCIDE TRIAL BEGINS AGAINST THE ISRAELI ENTITY AT INTERNATIONAL COURT OF JUSTICE
The first hearings against Israel on charges of genocide are currently being held at the International Court of Justice in The Hague, Netherlands on Thursday, as Israeli occupation bombing and shelling continued to massacre entire families in the Gaza Strip.
The charges, brought against the Israeli entity by South Africa, were filed with the ICJ on Dec. 29th, 2023, accusing the Jewish apartheid-State of the crime of genocide, implemented as a matter of policy against the Palestinian population of the enclave.
South Africa filed the charges with the ICJ in a meticulously crafted case that included an 84-page report compiling evidence of genocide against the Palestinian population of the Gaza Strip by the Israeli occupation.
In the 84-page document, South Africa accuses the Israeli entity of creating conditions "conducive to [the Palestinian population's] physical destruction," which South Africa and several other Arab and African nations believe constitutes the crime of "genocide" being inflicted against the native population of the enclave, by the mostly European Jewish colonists.
The hearings, which are being held in The Hague, Netherlands, will be exclusively addressing the request by South Africa that the International community take urgent measures to direct the Israeli occupation to cease and disist its military operations in the Gaza Strip while the Court hears evidence in the case, a process that can span several years.
Hearings began with a statement by South Africa's Deputy Attorney General and Minister of Justice, Ronald Lamola, followed by a presentation from the South African representative.
Early on in the hearings, Adila Hassim, an advocate of South Africa's High Court, began setting the stage for the current conflict by describing for the Court the events of 1948 and the Nakba, arguing that the Palestinian people faced a "catastrophe" that year, with the Israeli entity depriving the Arab population of their non-negotiable Rights, such as the right of return and self-determination.
The advocate called for the immediate end to discriminatory policies targeting Palestinians, and pointed out that Israel's aggression against the Arab population has escalated.
Hassim also pointed to Israel's system of apartheid imposed on the Palestinian people, along with the blockade and siege of the Gaza Strip, and described for the Court the ways in which Israel incites violence against Palestinians, in direct contravention of the Genocide Convention.
“We, along with representatives of the state of Palestine and human rights, file this lawsuit on behalf of the citizens of Gaza who cannot live in safety,” Hassim told the Court.
Later on in the hearings, South Africa's Minister of Justice, Ronald Lamola, added that “no armed attack on any territory, however grave its danger (…) can justify violations of the Convention," and accused the Israeli occupation of failing to uphold its obligations under International Law and the Genocide Conventions.
Over the course of two days, the Court will hear South Africa's justifications for filing the case with the ICJ, and will hear Israel's response on Friday.
Several Arab and African nations have also voiced support for South Africa's case of genocide against the Israeli occupation, including Jordan, Turkey, Libya, Pakistan, Bangladesh, the Maldives, Venezuela, Namibia, Nicaragua, Malaysia, Indonesia, Bolivia, Colombia, Brazil, as well as the Organization of Islamic Cooperation (OIC), comprising 57 Muslim-majority countries, and the members of the Arab League as well.
More than 200 Professors, academics and experts in International Law, the majority of which being from prestigious universities in the United States, have also endorsed South Africa's case against Israel.
More than 23'000 Palestinian civilians have been killed in Israel's genocidal war on Gaza, with nearly 60'000 wounded, 70% of whom are women and children, and with another 7'000 or more buried under the rubble.

Why ICC’s impartiality threatened by US influence
For many years, the International Criminal Court (ICC) has been adjudicating conflicts around the world, but recently there have been increasing concerns over the Court’s impartiality, especially against the backdrop of judgements on Israel that were allegedly influenced by top US officials.
The credibility of the ICC has been shaken after South Africa’s landmark lawsuit against Israel, accused of genocide of Palestinians in the Gaza Strip. South Africa’s Minister of International Relations and Co-operation of South Africa, Ronald Lamola, the chief accuser, said the UN International Court of Justice’s judgement in the lawsuit against Israel proved the rule of international law.
All countries must be treated equally and Israel is no exception. It cannot in any exceptional way disregard the UN Genocide Convention, other UN conventions as well as international law.
Genocide of Palestinians
Israel’s retaliatory offensive against Hamas since the 7 October 2023 attack has resulted in catastrophic damage to the people of Gaza, as the Israeli government has been unable to provide essential food, water, medicine, fuel, and other humanitarian aid to the civilian population, South Africa’s representatives to the Court said.
However, Israeli military action continues despite the Court’s ruling, with Prime Minister Benjamin Netanyahu and Defence Minister Yoav Gallant and his predecessor Benny Gantz still unpunished.
In response to Netanyahu’s request, US President Joe Biden’s administration ordered a cut in funding to the UN agency for Palestinian refugees and Works Agency (UNRWA), which only exacerbates hunger and the collapse of social services.
UNRWA provides food and basic needs to some 5.7 million registered Palestinian refugees in East Jerusalem, the West Bank, Gaza, Jordan, Lebanon, and Syria.
It is clear from what is happening in Gaza that the ICJ’s 26 January ruling has only further emboldened the Netanyahu government accused by South Africa of genocide against the people of Palestine. Israel promised to “take all measures within its authority to prevent and punish those responsible for committing acts of genocide.” At the same time, the Netanyahu administration, “appointed” to fulfil the mandate to “prevent and punish,” cannot be accused of committing “acts of genocide.”
Roots of the issue
In other words, the judges upheld almost all of the urgent measures that South Africa requested, but did not stop the Israeli military operation in the Gaza Strip. The lack of an explicit demand for a ceasefire is presumably due to who was heading the ICC.
Until February 2024, the president of the UN International Court of Justice was Joan Donoghue, who previously served as legal advisor to US Secretary of State Hillary Clinton under the administration of then-President Barack Obama.
The court ruled that the Israeli government must guarantee that its armed forces will not commit genocide against the people of Gaza, take steps to prevent and punish calls for such action, and ensure that all evidence of the alleged genocide is preserved. However, there were apparently some difficulties with the ceasefire demand.
In such a situation, the US, Israel’s staunch ally, remained victorious. After the Court’s ruling, Israel was entitled to “take measures in accordance with international law to ensure that the attack of 7 October is not repeated.” In other words, Israel, accused of genocide of the Palestinians of Gaza, became, in the judgement of the International Court of Justice, the victim of genocide by the Palestinians themselves.

South Africa to receive new flights to over 60 international destinations
Pixabay South African Airways (SAA) has reactivated its codeshare agreement with Brazilian airline Gol Linhas Aéreas Inteligentes. This partnership, paused during the Covid-19 pandemic, offers benefits like more fare options, single ticket purchases, and streamlined check-in and baggage processes for connecting flights. This announcement follows the launch of SAA’s direct flights to São Paulo, Brazil, nine months ago, and direct flights to Perth, Australia, five months ago. The agreement includes flights between Cape Town International, OR Tambo International, and Galeão-Antonio Carlos Jobim International Airport in Rio de Janeiro, Brazil. It also extends to domestic routes connecting Cape Town, Durban, Gqeberha, and Johannesburg. SAA will also add its code to over 20 Gol-operated flights within Brazil, including cities such as Belo Horizonte, Brasília, Curitiba, and Porto Alegre. In the future, the airlines plan to add 60 more destinations across Latin America and Africa, making multi-city itineraries easier to plan. “The reinstatement of the codeshare agreement affirms Brazil’s status as a strategically important destination for South Africa,” said SAA Chief Commercial Officer Tebogo Tsimane, as per TopAuto. “It connects two major economies in the southern hemisphere to enable leisure tourism, and to facilitate business, networking, and trade.” Currently, SAA runs two flights per week between Guarulhos and Cape Town, and two between São Paulo and Johannesburg, using Airbus A330-300 aircraft. In addition to this renewed agreement, SAA plans to expand its operations significantly. By the end of April, SAA aims to increase its destinations from 14 to 23 and expand its fleet by 50% to 21 aircraft by March. Interim Chief Executive Officer John Lamola mentioned that SAA has the funds to support this growth and plans to open routes to Frankfurt, Munich, London, and US East Coast cities by March 2028. Völkermord - Südafrikas Klage gegen Israel vor dem IGH

Südafrika hat vor dem Internationalen Gerichtsshof in den Den Haag Israel angeklagt, an den Palästinensern Völkermord zu begehen. Völkermord Israels bisher nicht juristisch verfolgt Israel hat auf die Angriffe der Hamas am 07. 10. 2023 mit seiner gesamten militärischen Stärke reagiert. Angesichts der Opfer, liegt schön lange der Vorwurf eines Völkermords in der Luft. Craig Murray hatte bereits am 07. Dezember 2023 beklagt, dass bisher kein Staat Israel des Völkermord angeklagt habe. "Jeder einzelne Staat der Welt hat die Pflicht, jetzt einzugreifen, um den Völkermord in Gaza zu verhindern, und nicht erst, wenn ein Gericht den Völkermord festgestellt hat. Dies wird in Randnummer 431 des Urteils des Internationalen Gerichtshofs in der Rechtssache Bosnien gegen Serbien kristallklar dargelegt". Am 29. Dezember 2023 reichte Südafrika, ein Vertragsstaat der Völkermordkonvention, beim Internationalen Gerichtshof (IGH oder Weltgerichtshof) einen 84-seitigen Antrag ein. Darin wird behauptet und dokumentiert, dass Israel in Gaza Völkermord begehe. Israel und die Vereinigten Staaten, sind sich des Ausmaßes des Antrags Südafrikas auf den Internationalen Gerichtshof bewusst und wehren sich vehement gegen den Antrag. Dies erläutert Marjori Cohn in einem Artikel vom 09. 01. 2024 ausführlich: "Urteile über die Begründetheit, die der IGH in Streitigkeiten zwischen Parteien fällt, sind für die beteiligten Parteien bindend. Artikel 94 der Charta der Vereinten Nationen besagt: 'Jedes Mitglied der Vereinten Nationen verpflichtet sich, die Entscheidung in jedem Fall zu befolgen, in dem es Vertragspartei ist.' Die Urteile des Gerichts sind endgültig; es gibt keine Berufung." Darüber hinaus könnten mit der Entscheidung des IGH die Weichen für die Verfolgung weiterer ähnlicher Verbrechen gestellt werden. Südafrikas Klage gegen Israel Südafrikas Justizminister Lamola verweis zu Begin des Prozesses auf "75 Jahre Apartheid, 56 Jahre Besatzung, 13 Jahre Blockade" Südafrika klagt Israel des Völkermords gemäß "Übereinkommen über die Verhütung und Bestrafung des Völkermordes" vom 09. Dezember 1948 an: "Artikel II In dieser Konvention bedeutet Völkermord eine der folgenden Handlungen, die in der Absicht begangen wird, eine nationale, ethnische, rassische oder religiöse Gruppe als solche ganz oder teilweise zu zerstören: - Tötung von Mitgliedern der Gruppe; - Verursachung von schwerem körperlichem oder seelischem Schaden an Mitgliedern der Gruppe; - vorsätzliche Auferlegung von Lebensbedingungen für die Gruppe, die geeignet sind, ihre körperliche Zerstörung ganz oder teilweise herbeizuführen; - Verhängung von Maßnahmen, die auf die Geburtenverhinderung innerhalb der Gruppe gerichtet sind; - gewaltsame Überführung von Kindern der Gruppe in eine andere Gruppe." Bundesregierung mit "Urheberrechtsklage" Die Bundesregierung stellt sich in dem Völkermord-Verfahren zum Gaza-Krieg klar hinter Israel. Regierungssprecher Steffen Hebestreit in Berlin: "Wir wissen, dass verschiedene Länder die Operation Israels im Gazastreifen unterschiedlich bewerten. Den nun vor dem Internationalen Gerichtshof gegen Israel erhobenen Vorwurf des Völkermords weist die Bundesregierung aber entschieden und ausdrücklich zurück". Die Bundesregierung beabsichtige auch vor Gericht entsprechend Stellung zu beziehen, wenn es zu einer Hauptverhandlung kommt. "Die Bundesregierung intendiert, in der Hauptverhandlung als Drittpartei zu intervenieren". (Nachtrag vom 21. 01. 2024: Bundesregierung will Lieferung von 10.000 Schuss Munition an Israel genehmigen. Deutsche Unterstützung für Israel im Genozidverfahren vor dem Internationalen Gerichtshof wird im Globalen Süden scharf kritisiert.) Der ehemalige britische Botschafter Craig Murray äußerte sich dazu sehr sarkastisch: "Während das Gericht tagte, kündigte Deutschland an, dass es in dem wichtigen Fall intervenieren wird, um Israel zu unterstützen. Sie argumentieren ausdrücklich, dass sie als größter Völkermörder der Welt in einer einzigartigen Position sind, um zu urteilen. Es handelt sich im Grunde um eine Urheberrechtsklage. Sie schützen Deutschlands geistiges Eigentum an der Kunst des Völkermordes. Vielleicht werden sie in Zukunft Lizenzen für Völkermord vergeben oder Israel erlauben, den Völkermord auf Franchise-Basis fortzusetzen." Craig Murray berichtete über Tag 1 und Tag 2. Der Vorwurf Südafrikas an die israelische Regierung, einen Völkermord zu begehen, spiegelt Lemkins Engagement für die Anprangerung des Verbrechens ungeachtet der ethnischen Zugehörigkeit wider." “Un campione in famiglia”: domani a Bari la tappa del tour con Adriano Panatta, Ciccio Graziani e Andrea Lucchetta. Si terrà domattina, sabato 2 dicembre, tra le 9.30 e le 12.30, al parco 2 Giugno, la tappa barese di “Un Campione in Famiglia”, tour itinerante all’insegna dello sport promosso da Cattolica, Business Unit di Generali Italia, in partnership con la società RG, con il coinvolgimento della rete agenti Cattolica. Ad aspettare giovani e famiglie baresi in viale Luigi Einaudi ci saranno tre atleti che hanno fatto la storia dello sport azzurro: Adriano Panatta, Ciccio Graziani e Andrea Lucchetta. A inaugurare la mattinata, alle 9.30, insieme ai tre campioni, l’assessore allo Sport Pietro Petruzzelli. All’evento, che gode del patrocinio del Comune di Bari, saranno presenti anche Samuele Marconcini, chief Cattolica Business Unit Officer di Generali Italia, Arianna Nardi, responsabile marketing di Generali Italia e Cattolica e Marco Lamola, responsabile distribution di Cattolica con alcuni agenti della rete. Per l’occasione all’interno del parco verrà allestito un vero e proprio villaggio dotato di un mini campo da calcio e un campo da pallavolo dove Cicco Graziani e Andrea Lucchetta coinvolgeranno i presenti in gare e partite, una zona riservata a spettacoli di magia e truccabimbi e un’area con animazione dedicata a giochi di coordinazione motoria e psicomotricità.
