[S]urveillance in the service of racial capitalism has historically aided three interconnected goals: (1) the control of movement of certain - predominantly racialized - bodies through means of identification; (2) the control of labor to increase productivity and output; and (3) the generation of knowledge about the colony and its native inhabitants in order to “maintain” the colonies [...].

Identification documents and practices can, like so many other surveillance technologies, be traced back to the Middle Passage [...]. [T]he movement of captives was controlled through [...] slave passes, slave patrols [...]. Similar strategies of using wanted posters and passes were put in place to control the movement of indentured white laborers from England and Ireland. [...]

Fingerprinting, for example, was developed in India because colonial officials could not tell people apart [...].

In Algeria, the French dominated the colonized population by issuing internal passports, creating internal limits on movement for certain groups, and establishing camps for landless peasants [...]. On the plantation itself, two forms of surveillance emerged - both with the underlying aim of increasing productivity and output. One was in the form of daily notetaking by plantation and slave owners. [...] Second, [...] a combination of surveillance, accounting, and violence was used to make slave labor in the cotton fields more “efficient.” [...] [S]imilar logics of quotas and surveillance still reverberate in today's labor management systems. In sum, when thinking about so-called surveillance capitalism today, it is essential to recognize that the logics that underpin these technologies are not new, but were developed and tested in the management of racialized minorities during the colonial era with a similar end goal, namely to control, order, and undermine the poor, colonized, enslaved, and indentured; to create a vulnerable and super-exploitable workforce; and to increase efficiency in production and foster accumulation. Consequently, while the (digital) technologies used for surveillance might have changed, the logics underpinning them have not.

So at the dinner table today, my dad said the government was making it mandatory to register live-in relationships now, and that not registering your relationship could result in a 6-month jail penalty or something. And at first I was like huh - they're trying to police us again, huh - but then stopped to think, and decided to research instead.

Now, this here is a Times of India article from a few hours ago.✨

In short, the Uttarakhand CM tabled the Uniform Civil Code (UCC) bill in the Uttarakhand assembly this morning. And one part from the 192-page bill is devoted to looking at live-in relationships as a legal entity. The bill was approved on Sunday, and tabled today.

And this made me SO HAPPY, because FINALLY. We're finally making some progress as a society. The Indian law has taken the first step in recognising two people living together without getting married, yet reaping the legal benefits - an unmarried partner will be a legal entity, legally counting as a loved one (provided they are over 21). Moreover, a couple that's living together but not married can legally have kids, and not face any discrimination in the eyes of the law. And not only that, but in case of a break-up (which also needs to be procedurally filed with the authorities), the woman is entitled to maintenance. I quote from the article:

CM Dhami said, “It is a historic moment for each one of us. Let us all have a lengthy and healthy discussion to bring uniformity in the society.”

This is wonderful! It's such a progressive measure.

But what caught my eye was the final paragraph from the article.

Leader of opposition Yashpal Arya said, "We fail to understand the logic behind the urgency being shown by the BJP government. They expect us to read such a lengthy document speedily and start the discussion. It looks like the government is trying to hide something."

At first that seemed like a classic political counterattack, but it got me thinking. Why indeed the urgency?

And then I realised - what if - what if - it is now legalised for queer couples in Uttarakhand to register live-on relationships and basically reap all the benefits of a legally recognised marriage? They haven't explicitly mentioned the queer community anywhere, but it's possible, right? We know the Supreme Court refused to give marriage rights to non-heterosexual couples last year (see here); but if this is presented as an option to queer couples instead, they can secure all the rights of a traditional marriage with a different kind of registration? It is, after all, not illegal to get into long-term homosexual relationships. I know it isn't perfect, but if they allow homosexual live-in relationships, then it's at least a step in the right direction?

I'm not very well-versed with this, so I'm turning to the only relatively safe space I can think of - desis on tumblr. Is it possible that this could happen, that queer relationship recognition could be an ulterior agenda? Is it really as progressive as I think it is? I'm curious, and so hopeful! With millions of people voting in India’s General Election, Prime Minister Narendra Modi and the Bharatiya Janata Party (BJP) are seeking a third term in office, and are widely tipped to get it. The Hindu nationalist movement in India predates Modi and the BJP but their decade in power has catapulted Hindu nationalism into the mainstream. 

Modi’s rise to power has reshaped India including the landscape for foreign funded organisations and media. Many human rights groups, journalists and activists critical of the government have come under intense scrutiny. A direct outcome has been the suspension or cancellation of their licences under the Foreign Contribution Regulation Act (FCRA) which permits non-governmental organisations (NGOs) to receive funds from abroad. 

In the past nine years more than 16,000 NGOs have had their FCRA registration cancelled due to “violations” according to, national daily The Hindu, including those working on rights of India’s most vulnerable minority groups. 

Aakar Patel the former head of Amnesty International India – which was forced to halt operations in 2020 due to allegations of FCRA violations- told Bellingcat, “I think India should do away with a law that is used maliciously in a targeted fashion. There is no reason for one part of the private sector to be governed by a special law that the rest of the private sector is not subject to. And it is the government that decides, arbitrarily, what activity and which entity should submit itself to FCRA.” 

However, some media outlets that have thrived in the Modi-era, with content promoting Hindu nationalism and vilifying minority groups, are in fact receiving foreign donations or operating in ways that may be inconsistent with Indian laws. Bellingcat identified two such far-right outlets–OpIndia and Hindu Existence. We also found two other outlets receiving donations in ways that lack transparency–and both of these sites have links to a RSS-affiliated organisation in the US. The RSS (Rashtriya Swayamsevak Sangh) was founded in 1925 and is often described as a volunteer, “paramilitary” organisation accused of stoking riots against minority groups and carrying out assassinations plots.

I wanted to question that narrative, so I turned my attention around: what else was coming out of the printing presses? Literacy grew rapidly, and these presses were opening up, making it cheaper to publish things, in particular the aforementioned pulp fiction, crime or romance stories. In them you find a trenchant critique of elite society -- biting laughter against high literature. [...]

I was interested in a history from below, of ordinary people, the subaltern. How did these people record the changes they were experiencing in the city? How did they make sense of these huge transformations happening almost overnight – bridges, electricity, drainage and steam boats? These songs were printed in very cheap presses, and the print runs were significantly greater than for so-called high literatures. They were topical, and mentioned electric lights, tramways, or cyclones. [...]

In 1867, there was a Book Registration Act that was passed in India. For any book that was published, two copies of it had to be submitted to the colonial government. One was being kept at the Imperial Library in Calcutta, and the other one was shipped across to London, to be housed in what was then known as the India Office Library.

There are meticulous records and catalogues of all these publications: a quirky outcome of colonial surveillance has made my research possible. Elites, cultured families in India would have thrown these out, and not kept them. It is telling that such vernacular documents are not being conserved in their original place, but rather in the metropolitan and imperial core.

Often, vernacular archives are not consulted. People do not know the language, scholars do not reside there. The more important books that are published are in English. [...]
