Help save Bilal's family!

i want to talk about my friend Bilal @bilal-salah0. for over a year now, Bilal has been living in germany, trying to adjust to his new living situation in a foreign country, learning a new language and working full time. 

when the war started, he was far away from home and his family and has been living in daily fear for their lives ever since. 

being forced to work long hours and promoting his family’s fundraiser at the same time, he has taken on more responsibility than anyone ever should. still, he managed to raise money for their evacuation fund and helped take care of his family’s daily needs with the money he was making while working. 

in a cruel twist of fate, all of this got taken away in an instant. he lost his job and his apartment and even his residence permit. which means he is at danger of deportation from germany that could happen as soon as next week!

i have been in daily contact with Bilal for a while now and connected him with some of my friends in germany. together, we are trying our utmost to make sure he can stay in the country. anyone who knows german bureaucracy knows what kind of hell it is. but we won't give up.

without his job, he was forced to dip into the money of his family’s evacuation fund to cover their daily expenses like food and shelter. this meant he had to raise his goal from €70,000 to €100,000. this was not an easy decision for him to make, he even asked for my advice on whether or not to do it, because he did not want anyone to think he was scamming people. 

even in such a desperate situation, Bilal does not want to be seen as someone who would ever take advantage of people's generosity

his family is comprised of 18 members, 10 of them are adults and 8 are children under 16 years old, some of them newborns who were born amidst the chaos of war and displacement.

News Group Newspapers (NGN) is seeking the release of emails, as well as text messages and WhatsApp messages, sent and received by the Duke, and material held on two encrypted hard drives.

EU’s proposed Chat Control law has become a bone of contention between members of the bloc. First proposed by the European Commissioner for Home Affairs Ylva Johansson in May 2022 as part of bloc’s push to combat child sexual abuse online, the framework of the bill has now come under fire, earning itself a derisive term “Chat Control”. 

France, Germany and Poland have particularly refused to accept a clause that allows for mass scanning of private messages by breaking end-to-end encryption. Some tech companies, along with trade associations, and privacy experts have all vehemently opposed the regulation. 

On the other hand, Interior Ministers of Spain and Ireland have supported the proposal. Separately, a network of organisations and individuals, advocating for children’s rights in Europe, have lashed out at EU leaders for failing to tackle child sexual abuse online. 

What are the concerns of those against the proposal?

Scanning end-to-end encrypted messages has remained a controversial issue. That’s because there is no way to do this without opening risky backdoors that can be accessed by third parties who can exploit the vulnerability, in turn ending the promise of end-to-end encryption.

Tech firms that treaded the encryption bypassing path have have often been made to retreat. In 2021, Apple announced NeuralHash, a feature that could automatically scan iCloud photo libraries of individual devices for child sexual abuse material, or CSAM. Employees and activist groups expressed concerns over the loss of privacy. A year later, Apple said it had abandoned the initiative. 

Another looming issue the iPhone maker recognised in the process was how authoritarian governments could potentially misuse the feature by using it as a tool to target individuals who oppose the regime.

Erik Neuenschwander, Director of user privacy and child safety at Apple, admitted this in a note saying, “It would […] inject the potential for a slippery slope of unintended consequences. Scanning for one type of content, for instance, opens the door for bulk surveillance and could create a desire to search other encrypted messaging systems across content types.” 

When brining in a similar clause through the UK’s Online Safety Bill, lawmakers attempted to make way for client-side scanning of private and encrypted messages. The proposal was postponed after receiving pushback from encrypted messaging app owners like WhatsApp and Signal. The duo threatened to leave the UK if such a law was passed. In its final stages, in September, 2023, the House of Lords considered the potential security threat that the clause would bring saying it would not implement scanning until it was “technically feasible.” 

What is the status of EU’s Chat Control law?

On June 30, a new draft of the proposal is set to be be reviewed. Legislators have now left the idea of scanning text messages and audio, and are instead targetting shared photos, videos and URLs with an adjustment to appease the naysayers. 

Another tweak in the making could be people’s consent in sharing material being scanned before being encrypted. But this compromise has been largely called out as a farcical one. A report by Euractiv which has been confirmed by internal documents show that if a user refuses the scanning, they will simply be blocked from sending or receiving images, videos and links hardly leaving them with a choice.

Despite these measures, EU’s enforcement of such regulations have seen exemptions to the rule. In November 2023, the European Commission reportedly published a proposal to amend the regulation on a temporary derogation of the E-Privacy Directive against CSAM. Under the regulation, specific online communications service providers were allowed to sift through or scan messages to detect, report and remove online child sexual abuse material or CSAM and content that solicits children. The regulation is set to expire in early August . The initial plan on the table was to simply extend this regulation for another three years. But, according to media reports, plans for further extensions were stalled in February this year.

Meredith Whittaker, President of Signal app called the measures to assuage concerns as “cosmetic”, and has signed a joint statement along with a group of over 60 other organisations like Mozilla, Proton, Surfshark and Tuta, voicing out her concerns. Whittaker has echoed her earlier warning saying Signal will leave the UK rather than undermine end-to-end encryption. 

A blog, co-authored by Riana Pfefferkorn, a research scholar at the Stanford Internet Observatory and Callum Voge, director of government affairs and advocacy at the Internet Society, notes, ”If government surveillance is a concern in an established democratic entity like the EU, what hope is there for beleaguered democracies like Turkey, India and Brazil, much less autocracies?”

For farmers in Senegal who struggle to read or write, sending voice notes has unlocked a new world of collaboration across the industry.

In 2012, the al-Qaeda–linked jihadist group Ansar Eddine swept through Timbuktu, taking control of the Malian city. As part of the group’s imposition of sharia law over the residents, it created an Islamic police force, led by Al Hassan Ag Abdoul Aziz. Ansar Eddine controlled the city until 2013, when a military campaign led by France drove the group out.

During his tenure with the police force, Al Hassan helped carry out a campaign of “forced marriages” and floggings of those accused of violating the strict religious rules imposed by Ansar Eddine. He faced 13 counts of crimes against humanity before the International Criminal Court at the Hague. Earlier today, the ICC convicted Al Hassan of war crimes and crimes against humanity, including torture and cruel treatment, for which he could face life in prison.

As part of the case, prosecutors employed a unique strategy of presenting evidence—a bespoke immersive replica of the city that includes visual evidence of where the alleged crimes took place. Created by SITU Research, a visual investigations firm, the platform used to prosecute Al Hassan represents a watershed moment in how evidence of war crimes is presented and the kinds of evidence the ICC might consider in future rulings.

Established in 2002, the ICC is relatively young. Alexa Koenig, a law professor at UC Berkeley, who helped set up the Technology Advisory Board at the ICC, says that the impetus for incorporating new technologies into evidence came as a response to an evaluation from the court that cases relied too heavily on witness testimony.

“Judges were saying that the prosecution had a problem,” says Koenig. “That essentially they were over-relying on the stories of survivors without bringing in the corroborating information needed to meet the evidentiary standards to allow these cases to go forward.”

As more and more evidence of war crimes became digital—through social media content or videos and photos uploaded online—Koenig says, the court has allowed this material to be submitted as evidence, but other tools, like the platform created by SITU Research, are still a nascent way to present evidence. And because cases can take much longer to move through the ICC than another kind of court, Koenig says, the ICC has only begun to reckon with these kinds of questions.

“As people are preserving evidence on places like Facebook or WhatsApp or YouTube, we're going, How do we preserve this in a way that preserves its values for our purposes?” Koenig says. “But also how do we make the content more impactful?”

SITU Research created a similar platform for the ICC prosecution of Ahmad Al Faqi Al Mahdi, also a part of Ansar Eddine, who was accused of destroying sites of cultural heritage in Timbuktu. But al Mahdi pleaded guilty, so the court never had the opportunity to evaluate the platform as a piece of evidence. Al Mahdi was sentenced to nine years in prison in 2016.

“It's kind of challenging to get new tech integrated and admitted as evidence,” says Brad Samuels, founding partner at SITU Research. “And often the technology that's in the world isn't necessarily finding its way into the courtroom quickly.”

The platform allows users to virtually walk through the city of Timbuktu, as well as see it from above. Nested within the virtual re-creation of the city are pieces of video, photo, and audio evidence, showing where and when an event allegedly occurred. For instance, users can explore down a street and encounter an item labeled to a corresponding piece of evidence, click on it, and see a video of a particular moment that shows who was allegedly present and what occurred.

SITU’s platform combines drone footage, satellite imagery, laser scans, and other forms of visual evidence that, Samuels says, allows the judges to see the evidence over time and space in a way that would not otherwise be possible. This is particularly important in cases of crimes against humanity, which require the crimes to be systematic and widespread as opposed to a single, isolated incident. And he says there’s more value to the platform than just helping the judges organize visual evidence that supports witness testimony.

“In the case of Timbuktu, the security situation in Mali has sort of gotten worse and worse. And the judges definitely were not able to go there in person,” Samuels says. For instance, the platform includes the interior of a former bank that functioned as the headquarters of Islamic Police, and another site where someone was flogged.

“It can also become a tool for interviewing witnesses about what they experienced,” Koenig says of SITU’s platform. “If you think about some of the language barriers and cultural barriers, not having a touchpoint like that, have them walk you through what happened to them can be almost guesswork at times of trying to piece together their story, particularly when there's a lot of trauma involved and memories are fragmented or recollections are fragmented.”

Sarah Zarmsky, assistant lecturer at Essex Law School, says, however, that often the defense teams for the accused lack the same resources offered to the prosecution.

“This platform was designed for the prosecution,” she says. “So, while SITU Research does great work, the defense also isn't coming in with that same expertise. And so there are a lot of fair-trial implications there.”

In an article published in 2023, ICC chief prosecutor Karim Khan noted that “the defense sought full access to the virtual platform, and required (and were provided) training and guidance on its use, so that they could also deploy it as needed.”

In the case of the ICC, where the court allows almost all evidence to be submitted and then decides afterward how much weight to assign each piece of evidence, that can mean an overburdened defense team may not have the time to sift through each piece of evidence. For something novel like the platform created by SITU, Zarmsky says, it’s unclear how much weight the court might put on it when it comes down to making a ruling.

But Khan asserted that the “Trial Chamber’s acceptance of the platform shows that the law and procedure of the ICC is ready to accommodate forward-thinking approaches to the presentation of evidence.”

▪️HAMAS ARRESTS.. a wave of arrests by Hamas against Fatah operatives throughout the Strip in recent days, with an emphasis on the northern part of the Strip, just a few days after the signing of the "Beijing Declaration" regarding Palestinian internal reconciliation between Fatah and Hamas.

♦️(Enemy report) The town of Ita al Sha'ab has been under artillery attack and by bombing - more than 75% of the houses are destroyed.

♦️IAF fighter jets, combat helicopters, and drones, struck some 45 targets across Gaza over the past day.  The targets included terrorists, tunnel shafts, buildings used by terror groups,  and rocket launchers previously used to attack the southern city of Be’er Sheva.
