Reprioritization of reservation policy: Wards of Ex Servicemen v. Wards of Serving Army Personnel

Issue before the Court:

Is it justified to place the wards of serving army personnel in Priority category VIII while the wards of ex-servicemen get the benefit of priority VI.

[When wards and wives of ex-servicemen as well as serving personnel who are in receipt of Gallantry Awards, can be placed together in one category, be in Priority V or Priority VII.]

Background:

The son of the petitioner while going through the counselling/cut[1]off charts of various Engineering Colleges of Government of National Capital Territory of Delhi found that the majority of reservation benefits is being taken away only by Priority-VI leaving no seat available for the remaining Priorities, especially Priority-VIII, in getting admission to various professional courses.

Wherefore, the instant petition was filed by petitioner for quashing the Order dt. 21.05.2018 of the Union of India giving the categories of Priority within the reservations provided in the Army quota of 5% for admission to various Colleges; and to give directions to the respondent Nos. 1 and 2 to treat/include Priority No. VIII above the Priority No. VI or in alternative to consider both the Priority Nos. VI and VIII at the same podium for the admissions in the forthcoming Academic Year 2023-24 in medical/professional/non-professional courses.

The revised list of categorizations of priorities vide order dt. 21.05.2018 is as under:

Priority I: Widows/Wards of Defence personnel killed in action.

Priority II: Wards of disabled in action and boarded out from service.

Priority III: Widows/Wards of Defence personnel who died while in service with death attributable to military service.

Priority IV: Wards of disabled in service and boarded out with disability attributable to military service.

Priority V: Wards of Ex-Servicemen and serving personnel who are in receipt of Gallantry Awards: i. Pararn Vir Chakra ii. Ashok Chakra iii. Maha Vir Chakra iv. Kirti Chakra v. Vir Chakra vi. Shaurya Chakra vii. Sena, Nau Sena, Vayu Sena Medal viii. Mention-in-Despatches

Priority VI: Wards of Ex-Servicemen.

Priority VII: Wives of: i) defence personnel disabled in action and boarded out from service. ii) defence personnel disabled in service and boarded out with disability attributable to military service. iii) ex-Servicemen and serving personnel who are in receipt of Gallantry Awards.

Priority VIII: Wards of Serving Personnel.

Priority IX: Wives of Serving Personnel.”

Observation of the Court:

The petitioner has not challenged the reservation of 5% provided to the wards of Armed Forces Personnel but is aggrieved by the wards of ex-servicemen being placed in Priority VI while wards of serving personnel being placed in Priority VIII in the revised list of Priorities.

Horizontal utilization of reservations is the matter of governmental policy & is not in the domain of the Courts to embark upon an inquiry whether a particular public policy is wise and acceptable or whether a better policy can be evolved as was held in the case of Union of India vs. M. Selvakumar (2017) 3 SCC 504.

However, where a policy decision can be faulted on the grounds of mala fide, unreasonableness, arbitrariness or unfairness, the Courts are not prevented to interfere in those circumstances. As has been held by the Apex Cort in the matter of State of Madhya Pradesh vs. Mala Banerjee (2015) 7 SCC 69.

It is a policy decision taken by the Government of India, Ministry of Defence to define the manner in which the reservations by the wards of Army personnel in difference categories shall be availed.

As such, the Government of India vide its order dated 21.05.2018 has provided the Priority list in the order in which the quota of 5% is to be distributed amongst the wards of Armed Forces Personnel, whether retired, disabled or serving in the admissions of the professional courses.

Contention of the Petitioner

Ex Servicemen are getting their pensions as well as due benefits which are commensurate to those which are being enjoyed by the serving personnel.

Whereas, the serving personnel are continuing to face the hardships of service which percolate to their wards as on account of their service contingencies the parents are not able to be equally involved in the education of the wards.

There is no intelligible differentia for placing the wards of serving personnel in a category below the wards of ex-servicemen on the grounds that while ex-servicemen have not only retired from their services and are no longer serving the nation.

The grievance of the petitioner is that while considering the reservation in the prescribed categories, the wards of Ex-Servicemen who fall in Priority VI practically take away the reserved categories despite having scored better ranking, leaving very few vacancy seats for the wards of serving personnel to get the benefit of reservations.

Submission of Respondent- Union of India

The Government of India had taken a decision to give the benefit to the wives and wards of ex-servicemen or Gallantry Award holders, but in the scheme of things, it was found that some vacancies still remained vacant after giving the benefit to the wards of all the categories.

It is only to ensure that the benefit of 5% reservation is fully utilized and exhausted and does not go unutilized that the category of wards of serving personnel has been added as Priority VIII.

Decision

The Instant Writ Petition was dismissed by the Division Bench of the Delhi High Court Comprising as no arbitrariness or mala fide has been brought forth in the Government policy meant for providing reservation to the medical/professional/non-professional courses to interfere with the Government Order dated 21.05.2018 or to reshuffle the Priority categories as provided therein.

Ziling Xin “ Better an oops than a what if”

The first photo is my motivation goal on my room’s windoe blinds. I choose the sentence “ Do one thing at a time, and do well” to meet the theme. From my perspective, the theme means that we should do every task carefully instead of thinking what if. Thus, focus on one thing at one time to make it done and nver think “ what if” like “If I need not to do it”. I stick a 24 hour goal and my priority list on my keyboard becuase it is the most convenient way to see these reminders.

1.3.6 - PLAYING WITH FRIENDS (LEAKED PATCH NOTES)

The first post-game launch update  arrives this week with lots of improvements on the match selection system and server configuration, making life easier for those who want to play with friends and create teams. This is the first of many planned updates  that will enhance the experience of  creating teams and interacting with other players. We keep, as always,  doing game balancing, bug fixing and content additions alongside these main improvements.

Find Your Friends on Home Screen

This new feature allows you to see,  on the game home screen, which of your friends are playing Ballistic Overkill, allowing you to immediately join to the same server that they are  playing. This feature will be the foundation of the clan system, that will be available in the future. In order to make this system the best possible, we rewrote a considerable part of the code that connects players into matches, you can learn more about these changes below.

New Queue System

It is now possible to enter in any server you want, even if that server is full. Doing so will make you a spectator in your friend’s match until a vacant position on your team becomes available. This way, newcomers will enter in a queue, joining the match in an organized way. It will be much easier to organize teams then.

Game lobby screen and private matches no longer exist, players can now  organize their teams from inside a match. We still offer the ability to create password-protected servers for those who want to play with big groups of friends.

Team Selection

Players are asked to choose a team before their first spawn instead of being automatically placed in the team with less members. We still enforce a  minimal difference in team sizes to avoid unbalanced teams. When this happens, you have to wait in the queue until the teams are balanced again. Different from what happened before, however, you will never be blocked from changing teams (with the only excepting of when the match is nearing its end). This change is crucial for the new game modes that are coming.

Spectator Mode Changes

Spectator Mode was remade to let both players and spectators join matches by the same method. Spectator mode is more accessible from the respawn screen, behaving as if it were a soldier class. You can join a match as a spectator at any time, but if you want to join a team to play you’ll be placed in a queue just the same.

Teammate Outlines

We changed characters outlines to allow players to see their teammates through walls, encouraging even better teamplay.

Gold Badges

All classes with level 100 or more will have a golden badge instead of a silver one. Be extra careful when finding one of these in the enemy team!

New Weapon: Sledgehammer

The tank can now unlock a brand new weapon, one that greatly helps him in close quarters combat.The Sledgehammer is a melee weapon with a slow fire-rate, but massive damage. Unaware Shadows may have an unpleasant surprise when getting close to a Tank.

Melee weapons received new animations for sequential attacks.

New Weapon Stats Screen

The weapon Information Screen on the Soldiers Tab was redesigned to make it easier to find your available skins to equip.

New Antialiasing Modes

We’re aiming to give more flexibility on game graphics configuration options. Advanced users who want to can now access them through a text file in the Ballistic Overkill installation folder. On top of an improved version for the standard FXAA, we added the possibility of switching to MSAA, of 2x, 4x or 8x. It's possible to combine both modes, for those who want to take the game graphics to the next level:

Custom Server Commands

We added a few commands to help those who create their own servers manage them with ease. If you are a server host you can type these in the chat anytime during a match.

Lists in numeric order, all players in the match.

./kick [player number from the list]

Kicks the player identified by that number.

./blacklist [player number from the list]

Permanently kick and ban the player identified by that number in this server.

./prioritylist [player number from the list]

Includes the player in the priority list. This will give him priority in any future queue in this server.

To manage banned and priorized players in your servers, you can always manually edit the file BallisticConfiguration.serverdata in the custom server folder.

Vulkan and Metal Support

Linux and MacOS users can celebrate! It is now possible to choose the Ballistic Overkill graphic API through a launch command in Steam properties. Vulkan API is relatively new and may have some bugs. The available APIs are:

Balance Changes

Melee Weapon Changes

One thing that made melee weapons tough to get right was their ability to kill anyone instantly with a backstab. This was done automatically, regardless of the weapon damage or the target’s health. We’re changing this system to allows us to balance the backstab itself via a multiplier so we can have more variance to it. On top of that, we changed the valid angle of attack of melee weapons by reducing it across the board to avoid situations where hits seemed unfair or too easy to aim.

Backstab Multiplier added

Melee weapons won’t kill instantly on backstabs. Backstabs are now considered critical hits (similar to a headshot from a regular weapon). This means that each weapon has it’s own multiplier, allowing for extra variety in that weapon class.

Melee Strike angle reduced slightly on all melee weapons

Tank

We felt that Tank needed an extra option of “fast moving sidearm”. The current only weapon  that fits this description is the Blackhawk. We hope that Tanks who want to be a swifter than normal will find the Sledgehammer as a suitable choice. It allows the Tank to serve Shadow some of that sweet melee action he seems to love.

Vampire and Shadow Walker unlock position switched

Marksman

Marksman received the current version of Awareness as an extra trait while the skill itself was buffed. We hope this helps differentiate the class from others, while also making the skill itself more reliable.

All enemies are revealed on the map for 1 second every 5 seconds. This ability reveals even invisible opponents.

Awareness

Time to activate reduced from 5 to 2 seconds.

Bug Fixes

Fixed a bug that eventually freezes the free camera from the Spectator Mode.

Fixed a series of validation errors on weapons skins.

Reduced the overall memory usage.

Hungarian language added.

Fixed a bug that made the camera shake in a wrong intensity when the player gets hit by certain weapons.

Fixed an audio bug that tied voice commands volume to general sound effects volume

Fixed a problem that makes the Reset Statistics Button reset achievements too.

Fixed a bug that makes the glass breaking noises too loud.

Fixed a bug on Lone Wolf skill (Wraith) that allows allies positions to interfere with the skill’s effect.
