An Epic antitrust loss for Google

A jury just found Google guilty on all counts of antitrust violations stemming from its dispute with Epic, maker of Fortnite, which brought a variety of claims related to how Google runs its app marketplace. This is huge:

The mobile app store world is a duopoly run by Google and Apple. Both use a variety of tactics to prevent their customers from installing third party app stores, which funnels all app makers into their own app stores. Those app stores cream an eye-popping 30% off every purchase made in an app.
This is a shocking amount to charge for payment processing. The payments sector is incredibly monopolized and notorious for its price-gouging – and its standard (wildly inflated) rate is 2-5%:

Now, in theory, Epic doesn't have to sell in Google Play, the official Android app store. Unlike Apple's iOS, Android permit both sideloading (installing an app directly without using an app store) and configuring your device to use a different app store. In practice, Google uses a variety of anticompetitive tricks to prevent these app stores from springing up and to dissuade Android users from sideloading. Proving that Google's actions – like paying Activision $360m as part of "Project Hug" (no, really!) – were intended to prevent new app storesfrom springing up was a big lift for Epic. But they managed it, in large part thanks to Google's own internal communications, wherein executives admitted that this was exactly why Project Hug existed. This is part of a pattern with Big Tech antitrust: many of the charges are theoretically very hard to make stick, but because the companies put their evil plans in writing (think of the fraudulent crypto exchange FTX, whose top execs all conferred in a groupchat called "Wirefraud"), Big Tech keeps losing in court:

Now, I do like to dunk on Big Tech for this kind of thing, because it's objectively funny and because the companies make so many unforced errors. But in an important sense, this kind of written record is impossible to avoid. Any large institution can only make and enact policy through administrative systems, and those systems leave behind a paper-trail: memos, meeting minutes, etc. Yes, we all know that quote from The Wire: "Is you taking notes on a fucking criminal conspiracy?" But inevitably, any ambitious conspiracy can only exist if someone is taking notes.
What's more, any large conspiracy involving lots of parties will inevitably produce leaks. Think of this as the corollary to the idea that the moon landing can't be a hoax, because there's no way 400,000 co-conspirators could keep the secret. Big Tech's conspiracies required hundreds or even thousands of collaborators to keep their mouths shut, and eventually someone blabs:

This is part of a wave of antitrust cases being brought against the tech giants. As Matt Stoller writes, the guilty-on-all-counts jury verdict will leak into current and future actions. Remember, Google spent much of this year in court fighting the DoJ, who argued that the company bribed Apple not to make a competing search engine, paying tens of billions every year to keep a competitor from emerging. Now that a jury has convinced Google of doing that to prevent alternative app stores from emerging, claims that it used these pay-for-delay tactics in other sectros get a lot more credible:

On that note: what about Apple? Epic brought a very similar case against Apple and lost. Both Apple and Epic are appealing that case to the Supreme Court, and now that Google has been convicted in a similar case, it might prompt the Supremes to weigh in and resolve the seeming inconsistencies in the interpretation of federal law.
This is a key moment in the long project to wrest antitrust away from the pro-monopoly side, who spent decades "training" judges to produce verdicts that run counter to the plain language of America's antitrust law:

There's 40 years' worth of bad precedent to overturn. The good news is that we've got the law on our side. Literally, the wording of the laws and the records of the Congressional debate leading to their passage, all militate towards the (incredibly obvious) conclusion that the purpose of anti-monopoly law is to fight monopoly, not defend it:

It's amazing to realize that we got into this monopoly quagmire because judges just literally refused to enforce the law. That's what makes one part of the jury verdict against Google so exciting: the jury found that Google's insistence that Play Store sellers use its payment processor was an act of illegal tying. Today, "tying" is an obscure legal theory, but few doctrines would be more useful in disenshittifying the internet. A company is guilty of illegal tying when it forces you to use unrelated products or services as a condition of using the product you actually want. The abandonment of tying led to a host of horribles, from printer companies forcing you to buy ink at $10,000/gallon to Livenation forcing venues to sell tickets through its Ticketmaster subsidiary.
The next phase of this comes when the judge decides on the penalty. Epic doesn't want cash damages – it wants the judge to order Google to fulfill its promise of "an open, competitive Android ecosystem for all users and industry participants." They've asked the judge to order Google to facilitate third-party app stores, and to separate app stores from payment processors. As Stoller puts it, they want to "crush Google’s control over Android":

Google has sworn to appeal, surprising no one. The Times's expert says that they will have a tough time winning, given how clear the verdict was. Whatever this means for Google and Android, it means a lot for a future free from monopolies.

There are some parts I will elaborate on in other posts, these will be marked and will probably have some links attached later.
Here is the first/original post where I came up with her (and her husband's) design and name.

Edaphe wanted to follow in her mother's footsteps (she was an engineer for agricultural machinery) and studied mechanical engineering. She graduated with incredible marks and quickly got a job at Olympus INC.

She enjoyed her work for quite a while, but quickly turned into the poster child for the engineering department, which meant she had less time to work on projects. Instead she spent more time talking to shareholders and partner companies. Her dissatisfaction as well as her abnormal talent was noticed by the higher ups (as well as a certain organisation...). She received a job offer from a "sister company" to work on a confidential project.

She gladly accepted, hoping to go into practise once again. She was absolutely baffled when she was taken by Charons and ended up on the Island of Woe mere hours later. She was aware of STYXs existence but could have never imagined someday working for them, let alone see the HQ with her own eyes. She had the option to refuse the offer at any time and return to her old life with no memories of the Institute. While she was overwhelmed, she was determined and excited to work on machines of unparalleled technological advancement.

Through hard work and burning passion, she was able to rise her rank, now looking over and managing the engineering department. It was at this point, that Phoros, the directors son and her came more into contact. Him and Edaphe were vaguely aware of eachothers existence, but never really interacted with eachother. Now Phoros, the acting chief of the company had to speak to her from time to time, passing on confidential information and projects, etc. All was well until the assignments she received got more minuscule and ridiculous with time. Her initial thought was that the Acting Chief was ridiculing her. Scared of being forced in the same position she had at Olympus INC., she decided to give him a piece of her mind, only to find out that he was, by his words "reviewing her performance for a potential promotion". They came to the agreement that he could watch and join her work, so he could come to a conclusion regarding her rank. Edaphe, less dense than the Acting Chief quickly realised that this whole thing wasn't about reviewing performance at all. She thought it was a little silly, but cute. Both of them began a romantic relationship after a few months (much to the Acting Chiefs surprise).

2 years later, Edaphe wanted to elope with Phoros and start a family, but he seemed hesitant and distant. Afraid that he no longer loved him, she had a talk with him. Turns out that order to elope with him, she had to take on his curse, something he desperately wanted to avoid. This also meant that it was no longer possible to send her home, he did not want to take that choice away from her, but she gladly accepted, finding her life at STYX satisfying. Much to her husband's discomfort, they went through with the elopement, which was carried out as a private ritual.
At 36, she finally became the chief engineer, has been for the last 16 years.

It feels like no one should have to say this, and yet we are in a situation where it needs to be said, very loudly and clearly, before it’s too late to do anything about it: The United States is not a startup. If you run it like one, it will break.
The onslaught of news about Elon Musk’s takeover of the federal government’s core institutions is altogether too much—in volume, in magnitude, in the sheer chaotic absurdity of a 19-year-old who goes by “Big Balls” helping the world’s richest man consolidate power. There’s an easy way to process it, though.
Donald Trump may be the president of the United States, but Musk has made himself its CEO.
This is bad on its face. Musk was not elected to any office, has billions of dollars of government contracts, and has radicalized others and himself by elevating conspiratorial X accounts with handles like @redpillsigma420. His allies control the US government’s human resources and information technology departments, and he has deployed a strike force of eager former interns to poke and prod at the data and code bases that are effectively the gears of democracy. None of this should be happening.
It is, though. And while this takeover is unprecedented for the government, it’s standard operating procedure for Musk. It maps almost too neatly to his acquisition of Twitter in 2022: Get rid of most of the workforce. Install loyalists. Rip up safeguards. Remake in your own image.
This is the way of the startup. You’re scrappy, you’re unconventional, you’re iterating. This is the world that Musk’s lieutenants come from, and the one they are imposing on the Office of Personnel Management and the General Services Administration.
What do they want? A lot.
There’s AI, of course. They all want AI. They want it especially at the GSA, where a Tesla engineer runs a key government IT department and thinks AI coding agents are just what bureaucracy needs. Never mind that large language models can be effective but are inherently, definitionally unreliable, or that AI agents—essentially chatbots that can perform certain tasks for you—are especially unproven. Never mind that AI works not just by outputting information but by ingesting it, turning whatever enters its maw into training data for the next frontier model. Never mind that, wouldn’t you know it, Elon Musk happens to own an AI company himself. Go figure.
Speaking of data: They want that, too. DOGE agents are installed at or have visited the Treasury Department, the National Oceanic and Atmospheric Administration, the Small Business Administration, the Centers for Disease Control and Prevention, the Centers for Medicare and Medicaid Services, the Department of Education, the Department of Health and Human Services, the Department of Labor. Probably more. They’ve demanded data, sensitive data, payments data, and in many cases they’ve gotten it—the pursuit of data as an end unto itself but also data that could easily be used as a competitive edge, as a weapon, if you care to wield it.
And savings. They want savings. Specifically they want to subject the federal government to zero-based budgeting, a popular financial planning method in Silicon Valley in which every expenditure needs to be justified from scratch. One way to do that is to offer legally dubious buyouts to almost all federal employees, who collectively make up a low-single-digit percentage of the budget. Another, apparently, is to dismantle USAID just because you can. (If you’re wondering how that’s legal, many, many experts will tell you that it’s not.) The fact that the spending to support these people and programs has been both justified and mandated by Congress is treated as inconvenience, or maybe not even that.
Those are just the goals we know about. They have, by now, so many tentacles in so many agencies that anything is possible. The only certainty is that it’s happening in secret.
Musk’s fans, and many of Trump’s, have cheered all of this. Surely billionaires must know what they’re doing; they’re billionaires, after all. Fresh-faced engineer whiz kids are just what this country needs, not the stodgy, analog thinking of the past. It’s time to nextify the Constitution. Sure, why not, give Big Balls a memecoin while you’re at it.
The thing about most software startups, though, is that they fail. They take big risks and they don’t pay off and they leave the carcass of that failure behind and start cranking out a new pitch deck. This is the process that DOGE is imposing on the United States.
No one would argue that federal bureaucracy is perfect, or especially efficient. Of course it can be improved. Of course it should be. But there is a reason that change comes slowly, methodically, through processes that involve elected officials and civil servants and care and consideration. The stakes are too high, and the cost of failure is total and irrevocable.
Musk will reinvent the US government in the way that the hyperloop reinvented trains, that the Boring company reinvented subways, that Juicero reinvented squeezing. Which is to say he will reinvent nothing at all, fix no problems, offer no solutions beyond those that further consolidate his own power and wealth. He will strip democracy down to the studs and rebuild it in the fractious image of his own companies. He will move fast. He will break things.

What is Dataflow? Part 2: Diagrams
This is the second part of a couple of posts about Dataflow, particularly why it's important for the world going forward and relating to the Crowd Strike IT disaster.
Read the first part here.
Before I get into this one today, I wanted to address a couple of things.
Firstly, Dataflow is something that nearly every single person can understand. You do NOT:
Need to have a degree in Computing Science
Need to work in IT
Need to be a data analyst / Spreadsheet master
If any of you see the word 'Data' and feel your eyes glazing over, try and snap out of it because, if you're anything like me, Dataflow is much more approachable as a concept.
Secondly, what do I mean by IT?
Traditionally in most of our media the all-encompassing 'IT department' handles everything to do with technology. But every business works differently and there are many job titles with lots of crossover.
For example, you can be an infrastructure engineer where your focus is on building and maintaining the IT infrastructure that connects your organisation internally and externally. This is a completely different role from an Application Portfolio Manager who is tasked with looking after the Applications used in business processes.
Both are technical people and come under the banner of 'IT' - but their roles are focused in different areas. So just bear that in mind!
Now that's out of the way, let's begin! This one will be a little bit deeper, and questions welcome!
An Intro to Diagrams
You probably do not need a history of why pictures are important to the human race but to cover our bases, ever since we put traced our hands on a cave wall we have been using pictures to communicate.

Jump forward in time and you have engineers like Leonardo Da Vinci drafting engineering schematics.

You get the idea, humans have been creating diagrams (Pictures) for thousands of years. Centuries of refinement and we have much more modern variations.
And there's one main reason why diagrams are important: They are a Common Language.
In this context, a Common Language helps bridge a language gap between disciplines as well as a linguistic gap. A Spanish electrician and a German electrician should be able to refer to the same diagram and understand each other, even if they don't know each other's language.
The reason they can do this is because they're are international standards which govern how electrical diagrams are created.
A Common Language for Digital?
Here's an image I've shown to clients from governments and institutions to global organisations.

Everything around us, from the products we use to the bridges we drive over and the buildings we live, work, enjoy and shop in had diagrams backing them.
You would not build a skyscraper without a structural engineering diagram, you would not build an extension on your house if an architect couldn't produce a blueprint.
Why is there not an equivalent for the Digital World and for Dataflow?
Where is the Digital Common Language?
This is the bit where the lightbulb goes on in a lot of people's heads. Because, as I mentioned in Part 1, the flow of data is the flow of information and knowledge. And the common mistake is that people think of dataflow, and only ever think about the technology.
Dataflow is the flow of information between People, Business Processes *and* Technology Assets.
It is not reserved to Technology specialists. When you look at the flow of data, you need to understand the People (Stakeholders) at the top, the processes that they perform (and the processes which use the data) and the technology assets that support that data.
The reason why this is important is because it puts the entire organisation in context.
It is something that modern businesses fail to do. They might have flow charts and network diagrams, and these are 'alright' in specific contexts, but they fall to pieces when they lack the context of the full organisation.
For example, here is a Network Diagram. It is probably of *some* value to technical personnel who work in infrastructure. Worth bearing in mind, some organisations don't even have something like this.

To be absolutely clear, this diagram will hold some value for some people within the organisation. I'm not saying it's completely useless. But for almost everyone else, it is entirely out of context, especially for any non-technical people.
So it doesn't help non-technical people understand why all of these assets are important, and it doesn't help infrastructure teams articulate the importance of any of these assets.
What happens if one of those switches or routers fails? What's the impact on the organisation? Who is affected? The diagram above does not answer those questions.
On the other side of the business we have process diagrams (aka workflow diagrams) which look like this.

Again we run into the same problem - This is maybe useful for some people working up at the process layer, but even then it doesn't provide context for the stakeholders involved (Are there multiple people/departments involved throughout) and it doesn't provide any context for technical personnel who are responsible for maintaining the technology that supports this process.
In short, nobody has the big picture because there is not a common language between Business & IT.
Conclusion
So what do we do? Well we need to have a Common Language between Business & IT. While we need people with cross-functional knowledge, we also need a common language (or common framework) for both sides of the organisation to actually understand each other.
Otherwise you get massively siloed departments completely winging their disaster recovery strategies when things like Crowd Strike goes down.
Senior Management will be asked questions about what needs to be prioritised and they won't have answers because they aren't thinking in terms of Dataflow.
It's not just 'We need to turn on everything again' - It's a question of priorities.
Thing is, there's a relatively simple way to do it, in a way that looking at any engineering diagram feels simple but actually has had decades/centuries of thought behind it. It almost feels like complete common sense.
I'll save it for Part 3 if you're interested in me continuing and I'll make a diagram of my blog.
The important thing is mapping out all the connections and dependencies, and there's not some magic button you press that does it all.
But rigorous engineering work is exactly that, you can't fudge it with a half-arsed attempt. You need to be proactive, instead of reacting whenever disaster strikes.

Out of the contraption, in leggings and an oversized sweatshirt that has to be Ianto’s, she looks human. She and Ianto are sitting on one side of the conference room, the rest of them on the other, and Jack is probably focusing too much on how their clasped hands are resting on Ianto’s knee. He’s probably focusing too much on the ring on Lisa’s finger, one Ianto had slid on the moment she’d been on her own two feet.
“She’s been down there this whole time?” Owen demands, pacing angrily behind him. He’s fighting against his urge as a doctor to check her over and his desire to shoot first and it’s putting him in a mood. Jack doesn’t think it’s worth the effort to try and keep him still.
“Not the whole time,” Ianto says blandly, “just since two weeks after I was hired.”
“Your file lists you as a researcher,” Tosh says.
Lisa smiles. Ianto raises an eyebrow. “It does.”
She nudges him in the side and he sighs. She rolls her eyes. “He was a retrieval specialist at One.”
“A retrieval specialist?” Gwen asks.
“A spy,” Jacks says, voice hard. The Ianto he knows would have flinched, but this one just stares at him blandly. “Sent in to different agencies, different institutions, to steal whatever alien artifact they’d gotten their hands on that Torchwood wanted. Researcher gets out into a lot of places.”
“It does. It got me in here, in fact,” he says, like it was his title that got Jack to hire him.
Does Lisa know they slept together? Jack wants to blurt it out, to throw it down in the space between them like a gauntlet, but he stops himself. Barely.
“You’re being awfully forthcoming,” Gwen says.
Ianto presses his lips together. “It’s only fair. I owe you – well, not you, Gwen, sorry. But I couldn’t have saved Lisa without the others.”
Tosh gasps, hand coming up to her mouth. “Wait, all those theoretical – and you said you were tinkering, and your nephew in robotics-”
“David really is on the robotics team,” Lisa says, as if that’s the most pressing issue.
Owen has gone very still. “You said – those old reports from before us that you said had information missing, that you made me go through them all and write up what I thought happened, or how to fix it.”
“Manufactured,” Ianto says. “Although invaluable. I’m an intelligent man, but at the end of the day I’m no match for Cyberman technology. What I needed was an engineer and coder who could do what no one else could, and I also needed a very, very good doctor.”
“Thank you both,” Lisa says earnestly, like this is something they chose rather than something they were manipulated into. “You saved me. We’re very grateful.”
More manipulation.
It’s even working, because Tosh and Owen are hesitating, some of that anger and betrayal draining away in the face of Lisa’s smile.  
“And me?” Jack asks.
Ianto meets his gaze. “I am of course most grateful to you, Jack. If you ran Three properly, I never would have managed to help her.”
He flinches.

feel like posting about my Freaks but instead I'll post about the setting inhabited by my Freaks.
At The Arcane University takes place in 2053, in part of what used to be Wisconsin- the United States no longer exists as an entity, having been broken up after a second Cold War sort of situation around 2004 (the current big dog in town is China).
the titular Arcane University is part of an international organization called the Falke Institute, and the Madison campus is one of many around the world established to study magic- Campus 16 is by far the largest in terms of surface area and population, effectively being a self-sustaining city of about 90 thousand people.
magic has only really been properly understood as a science since about 1960, although its study has made it clear that magic has always been a subtle background element in human history. since the 60s, Aetheric Studies has led to massive advancements in essentially every other scientific discipline, from clean energy to agriculture to magnetic tape storage media.
Campus 16 (est. 2023) is partly an experiment by the F.I. to test a whole bunch of Aetheric technology mostly focused on sustainable food and energy production. everyone attending and working at the Arcane University is ultimately part of this experiment- students and staff are provided basically-free housing and amenities, with the understanding that everyone is expected to contribute to the common good and general campus upkeep.
given its size and enormous population for a university, Campus 16 is split into six Districts in an attempt to make management and coordination easier: the four main University Sub-Campuses (Allard, Hayes, Tai, and Belmonte, sometimes called Houses) which each contain student & staff housing, academic buildings, and various student services and recreational areas; the Daris District, a relatively small administrative area; and the Common District which encompasses the bulk of Campus 16's support infrastructure for food, power, transportation, etc.

Elara Carson was born in Minneapolis, Minnesota, on April 08, 2001. She has an older brother. She is fluent in English and Malay, and has conversational proficiency in Korean, Mandarin, Arabic and Portuguese. At the age of 18, she moved to China to attend Harbin Institute of Technology (HIT) through a transfer program affiliated with the Massachusetts Institute of Technology (MIT), where she was previously enrolled as a Computer Science and Engineering major. In early 2020, following the outbreak of the COVID-19 pandemic, she temporarily relocated to South Korea due to her acquaintance with members of the South Korean boy group Seventeen.
She later resumed her education, graduating with a CSE degree from MIT and enrolling in Seoul National University for graduate studies in computer engineering.

Elara became acquainted with Seventeen in mid to late 2019 while still a non-celebrity. Her musical talents and creative vision were accidentally recognized by the group and their team, leading to off camera performances. After a period of informal involvement and initially appearing in behind the scenes of web content like Going Seventeen, performances and special digital collaborations, in 2020, Elara officially debuted as a member of the South Korean boy group Seventeen with the extended play Semicolon on October 19, under the stage name Lee Eunseo, a Korean name given to her by the group, after excessive support/demand from fans for her to join the group. 
As Seventeen’s 14th member, she contributed to songwriting, vocal arrangements, and storytelling aspects of the group's releases.
