last night i got home kind of tipsy and very much in tears and my mother told me the force you exert to keep someone in your life is proportional to the force with which they will leave your life. if you have to fight tooth and claw to keep them, their leaving will be just as hard, just as harsh, and just as definite.

I've been thinking about the Aaron trial a LOT and kinda fell into a rabbit hole about it and thing is. Aaron is guilty. Like 100% guilty. The prosecution can't prove first degree murder but they don't need to because they can charge him with 2nd degree, aka "murder of passion". It was a charged moment and Aaron responded by killing the dude. Yes he deserved it and yes it's still murder, with considerable jail time.
There are 3 ways for Aaron to get off here (not including Moriyama interference). One, jury nullification. The jury basically decides that yes he did it BUT he shouldn't go to jail for it so we're gonna vote as if we're not convinced he did it. Incredibly rare but legal. Two, Aaron's lawyer successfully argues that Aaron was acting in self defense on Andrew's behalf. They could potentially try to have Drake charged with SA and CSA posthumously, and use the details of that trial as evidence in Aaron's. Three, and this ties into 2, JAG (military legal branch) tells the SC courts they don't want a public trial. From here it becomes internal politics, and might result in a plea deal in exchange for the whole thing getting shoved under the rug.
it seems to me like jury nullification is one of those old laws that don't really hold up in a modern setting, like if you suggested it now, i don't know if they'd actually go forward with it?
the best i've come up with is that he's aquitted for accidental death or self defence and the jury are swayed by andrew, neil and higgins' testimonies, or he's found either guilty or not guilty of involuntary manslaughter. just throwing some random thoughts out into the world. (let's disregard first degree murder.)
voluntary manslaughter in SC can't be given without "heat of passion and sufficient legal provocation" present. "The heat of passion refers to the defendant experiencing some type of uncontrollable emotion, such as rage or terror. The heat of passion does not excuse a homicide, but it does remove malice. Legal provocation refers to circumstances that would cause a reasonable person to lose self-control."
IM NOT A LAWYER but i think it might be hard to prove this - it happened SO quickly that there's not enough evidence beyond reasonable doubt to prove that it was an intentional act of passion with reasonable provocation.
involuntary manslaughter can't be given without "criminal negligence" or essentially a reckless or hazardous disregard for safety etcetc. in SC code of laws it says "criminal negligence is defined as the reckless disregard of the safety of others. A person charged with the crime of involuntary manslaughter may be convicted only upon a showing of criminal negligence as defined in this section."
AGAIN IM NOT A LAWYER but i think there's probably ways to argue that there was no criminal negligence on aarons behalf because it wasn't technically reckless. i think aarons lawyers would argue that it wasn't a homicide at all but was an accident because aarons behaviour wasn't technically reckless (in some ways). regardless even if he was found guilty of involuntary manslaughter there's no minimum sentence for it in SC so it's possible he'd avoid going to jail at all because of his character/how unlikely it is he'll reoffend/his prospects in life/his clean record and all that. he'd have parole terms and probably some community service and a fine or something but i think he'd easily avoid jail time even if he was found guilty.
he could still possibly be aquitted on the question of whether ANY category of murder happened beyond a reasonable doubt. the prosecution would have to prove that aaron intentionally swung the racquet with or without intent to kill. i think there's an argument there for an accidental death - which would definitely make this ask even longer so i won't get into my NOT LAWYER thoughts on how/why.
i'm not saying andrew and neil WOULD commit perjury. but they WERE the only people in the room when it happened, and if they can't say that for certain aaron swung the racquet at drake then there's a doubt there about whether it was homicide or not. nobody is denying the murder occured - but the prosecution HAVE to prove that aaron was WILLFULLY negligent and that led to drake's death. just a thought.

How about Tokoyami and Aizawa relationship together? They don’t seem to interact very much but I feel like they would share the same vibe.
You know it’s funny you say that…I have a bit of a controversial opinion on that haha.
Look I love dadzawa content but fanon goes a little off the rails making him a caring and supportive father…this man is not that. He is cold and critical and purposefully discourages his students to weed them out. His actions show more than his words by doing everything in his power to saving them. He does care about them but he does not show it well. He purposely keeps a distance between himself and his students. While tokoyami and aizawa prioritizes rationality above all else that similarity actually strains their relationship more than anything else.
Because tokoyami is so strict on himself and doesn’t allow himself to feel emotional responses to anything the extra criticism from aizawa is encouraging these bad habits. Tokoyami is already so hard on himself for his failures and Aizawa just creates more pressure with his threats of expulsion or reminding him he will die if this is a real battle. Tokoyami already knows this and the stress is slowly breaking him.
This is why he gets along so well with hawks I think. Hawks is very free spirited and encourages a more emotional and even silly side from fumikage. Even if Tokoyami doesn’t realize the reason he feels better around hawks is because he’s actually being more open and emotional. At first hawks ignored him which is a sort of neutral stance but then after tokoyami decided to catch up to him on his own he became encouraging and inspiring. He took him flying, he said he has potential, he said “those who can fly, should fly” and totally flipped Tokoyami’s world view on his head. No one has ever believed in him before, no one ever encouraged him, it was ground breaking.
As far as UAs teachers go Tokoyami actually likes aizawa the least for this reason. A teacher should be someone who encourages you and also pushes you to be better. Aizawa is a “firm hand” and while that may work for other students tokoyami has had far too many of those hands strike him down to feel believed in or even safe around aizawa. He needs a gentle and kind teacher, someone he can feel safe enough to go to for advice and support. In case it wasn’t obvious toko has had lots of problems with teachers in the past and is slightly afraid of them. He has also had problems with heroes. He tries to be on his best behavior around adults in general.
The thing that obviously scares him most about aizawa is his quirk. He doesn’t like when shadow is erased, it makes him nervous and shadow is always a bit disoriented afterwards. He keeps thinking that if aizawa tried to attack him he wouldn’t be able to escape (even if that situation is very unlikely…unless shadow was in a rampage…). He feels bad for not being able to trust aizawa when the man has clearly shown he will do anything to protect his class. He just doesn’t believe Aizawa would protect him specifically :(
Shadow is also afraid of aizawa for the same reasons. No adults have ever listened to them before and Aizawa doesn’t seem very open minded (dark shadow is actually wrong about this assumption). Dark shadow tries to keep from talking in front of him as much as possible. It is inevitable that they would slip up eventually but aizawa seemed surprisingly cool about them being out when they’re not supposed to?? (Shadow you are wrong about him he is nice and understanding I promise). Maybe Aizawa talks to nezu about Dark Shadow and understands a bit better about what they need and how their training should look. Both birds are very surprised when he starts addressing shadow directly in training. It says something about shadows past treatment that even if aizawa is the teacher they don’t like the most that the man still treats shadow with common decency.
Regardless I think toko stays to the shadows of 1-a so to speak so aizawa doesn’t pay much individual interest in him for quite a while. Once shinso joins class 1-a (however you imagine that happening) he has more free time for one on one training so he offers tokoyami a chance for training at night. Tokoyami immediately refuses. Aizawa makes it obvious that it’s not actually a request but an order and tokoyami relents. After getting erased several times in a row shadow is very sluggish and disoriented, after a few more times toko is having trouble getting them to manifest or wake up at all. He doesn’t want aizawa to think he is making excuses so he keeps trying to train without saying anything. Eventually tokoyami also becomes disoriented and passes out and aizawa is very upset toko didn’t mention anything (not to mention worried because he doesn’t actually know what’s wrong).
Once they are feeling better aizawa immediately berates them on keeping their discomfort a secret. Something snaps in toko and he says “why would I tell you anything when I don’t even trust you.” They have to have a long talk about Tokoyami’s frustrations with Aizawa’s teaching style. Even if Aizawa doesn’t suddenly become a reliable and empathetic teacher he is more careful about beating toko down and no longer a direct hinderance to their progress. Maybe shadow even feels good enough to come out during his class~
(This doesn’t have to be the only scenario where a resolution occurs but what’s important is that toko will not say anything about his issues until he is prompted or his hand is forced)
Eventually tokoyami could be forced to talk about his fear openly with aizawa and could be reassured that aizawa would never hurt him. Once again Aizawa would need to be paying close attention to Tokoyami’s behavior and subdued behavior around him. Then he could truly become a reliable figure in tokos life which would be nice.
As far as aizawa’s opinion on tokoyami goes when nezu told him about toko’s…history he was expecting a problem child but toko didn’t seem to stand out at all and never caused any issues. A good but albeit confusing kid. He quickly learns dark shadow is the actual trouble maker and doles out specific punishment for them if they act out. I’m not sure if aizawa is fully aware of how bad it was when toko lost control at the training camp but he did place his room next to aoyama in the dorms so he probably knew something happened.
I just want a final result of aizawa giving him head pats (without him flinching) and shadow coming over to his desk to play with his stapler and capture scarf while toko is trying to take a test and needs to focus.
PS if anyone has any different hcs for aizawa and toko with good reasoning I’d love to hear it!

One thing that makes me laugh about Hori's world building is the question are heroes allowed to kill, since Hori is a coward who can't decide, it disrupts the world building to an absurd degree. If Izuku had aimed to kill Tomura from the start, then Hori's narrative would have rewarded him. Izuku would still have OFA, possibly Ochako as his girlfriend and applauded as a great hero. The standard hero ending. But Izuku tries to save Tomura and fails miserably and is forgotten by his friends and the public. What is Hori trying to tell us? Kill then ask questions later? Based on the story Izuku should have taken Gran Torino's advice, he would be sad in the short term but he would have been happier and forgotten about the LOV.

MHA'S whole narrative messaging around the subject of "are heroes allowed to kill?" Is presented in an incredibly confusing and unsatisfactory manner.
Horikoshi doesn't directly address the question however, he does indirectly address it by introducing a variety of elements to his story surrounding the question itself.
You have things like:
The development of nomu intelligence. By the nomu's developing basic human intelligence this makes it so that the line between being human and a nomu so incredibly slim that if well developed this plot point could of been tied to heteamorphis discrimation with a side of people taking the route of one has to look human and another side pointing out that humans don't have a specific look in mha. There could also be more development with endings point of the only difference between nomu's and humans is that one is a puppet. This would make civilians question societies expectations for what a human is and would the heroes kill them next because they are comfortable with killing nomu's who are almost like them

Hawks and twice. I have talked about hawks and twice a numerous amount of times but my point still stands hawks could of saved twice instead of killing him. Yes, hawks did try in the beginning of the fight and his mission to semi try and save twice as his intention was to never kill him until dabi intervened and hawks lost it reverting to what the hpsc taught him and taking out the danger infront of him. Now, hawks should of had more introspection on this decision realising that he could of saved twice yet didn't and couldn't because he viewed himself not to be fast or capable enough to stop twice and chose to revert to instincts and the hpsc teachings of killing to dispose of the threat. Hawks could easily link his experiences and give advice to izuku about shigaraki. Hawks also needed more public consequences about killing twice because why the hell is the public more concerned about hawk's villain father then the fact that he killed a man? Was this to show where societies priorities are at? How messed up they are? And if it was why wasn't this brought back up?

Lady nagant. We needed more of lady nagant in general. The way she was used and created to be a killing machine. The way she only killed those who didn't fit the status quo even izuku's own reaction to her killing needs to be studied. The way izuku didn't have much of a reaction to her killing people but he had a huge reaction to finding out that she specifically killed the previous minister of the hpsc makes me think that hero society has a huge belief thay certain lives are much more important than others and that ranking is never fully explained but it seems like the outcasts of society like twice and the people lady nagant killed aren't important and wouldn't evoke a huge reaction to people because they don't care for them and hero society has infulenced that belief.

Izuku and shigaraki . This is the biggest element in the story and the most underdeveloped in my opinion. Why does izuku want to save shigaraki? Why does shigaraki only want destruction? Everyone encouraged izuku to kill shigaraki and believed that his death would be the only way to stop everything and in a way they were right. Shigaraki had to die for this to be over and it just seemed so badly done. Izuku gets labeled as a murder but also praised (barely) for his actions. Its so weird, how am I supposed to expect that society is going to rebuild itself to a better version when it ended in the most repetitive and toxic way by killing and upholding the status quo.

Endeavour and his aggressiveness. Enji has multiple records of flipping attempted murder whether that be him viewing vigilantes and villains as objects to be easily killed like nomu's or the fact that he cannocially has many reports of property damages.
Dabi's fate. My point stands that death would of been mercy for poor dabi. So are there cases when killing should happen or should all villains be forced to live even if it has to be through horrible circumstances like dabi's? At this point it seemed like toga's death was a better ending then dabi's.
In conclusion, mha's status quo was never really broken or rebuilt into a better version and the discussion surrounding the question should heroes kill? Was never properly answered or changed.
The series begins with the answer that Yes! Heroes can kill but they can only kill villains and rejects of society while keeping all of this away from the public eye. However, if it is in the public eye just dehumanise the victim, its not like hero society didn't continually threaten villains with all the graffiti in toga's House or the publics reaction to dabi.
(Ps I do think that izuku was handed the short stick and would of suffered either way. Even with the horrible execution the series make it clear that izuku chose a thorny, hard path but what's worse is that the path doesn't seem to be worth it or hasn't changed anything)
Also izuku's whole arc doesn't depend on him having a love interest and a quirk because he could be a hero without those things it's the execution that sucks

Even with the girl sleeping in Zoro's lap - the thin limbs of childhood dangling limply as her head rests against the swordsman's chest, green hair a curtain over her curled brows softened by sleep. One of Zoro's arms is wrapped snugly around her waist to keep her secure, but other than that he seems barely aware of her as he listens in to the two captain's conversation. Fatherhood an easy burden for him. Although Law supposes he would have had plenty of practice with Strawhat as his captain.
As if he can read Law's thoughts and plans to prove him right Strawhat leans back on his chair. Stretching his upper body towards the gallery.
"Sanji! I'm hungry!"
"You're always hungry!" Zoro says, reaching out with the arm not holding his daughter to tug at the captain's shoulders. The girl's sleep undisturbed by her father's movement. That tired after a day of running around with the Strawhat crew.
