CALL-OUT! Some of you may have seen in my recent stories I am in the midst of writing an article on sham contracting in the ceramics and visual arts industries for the Journal of Australian Ceramics @australianceramics Sham contracting is when workers are hired for ongoing work but are asked by employers to get an ABN and invoice for their labour (to avoid typical employer obligations such as insurance, leave entitlements, minimum wage, payroll tax, superannuation, WorkCover and/or unfair dismissal legislation). Think of it as the Uberisation of the arts. I have found through my own experiences, and that of my community, this practice is increasingly common in local government as well as commercial and not-for-profit ceramics and visual arts studios. This practice is illegal, and sadly, because most visual artists and ceramicists do not have a union, redress can be challenging (also why don't we?!) If you have been taken on as an ongoing ceramics or visual arts tutor, studio technician or artist assistant on an invoice-only basis but have no ability to negotiate your rate, receive less than minimum wage (or less than you think is fair), have no control over your working conditions and/or don’t receive superannuation, please contact me. Also - what pay rate do you receive? I will not be using your or your employer’s names for your privacy but rather am trying to collate information to write an informative article for both artworkers and employers in our industry.
