Can Children Testify During South Carolina Divorce Proceedings?
Tumblr media
Divorce proceedings are inherently complex, involving legal, emotional, and often, sensitive family matters. In South Carolina, where families seek resolution amidst the beauty of Mount Pleasant, the question of whether children can testify during divorce proceedings is a poignant one. Futeral & Nelson LLC, esteemed Mount Pleasant Divorce Lawyers, navigates this delicate terrain with expertise and empathy. In this blog, we explore the considerations surrounding children's testimony in South Carolina divorce cases.
Legal Framework: In South Carolina, the legal framework regarding children's testimony during divorce proceedings is nuanced. While there is no specific age at which a child is automatically deemed competent to testify, the court considers factors such as the child's maturity, understanding, and ability to communicate. Futeral & Nelson LLC is well-versed in the legal intricacies, guiding parents through the process while prioritizing the child's well-being.
Best Interests of the Child: Central to South Carolina family law is the principle of acting in the best interests of the child. When contemplating a child's testimony, the court carefully assesses whether it serves the child's best interests. Futeral & Nelson LLC, with its commitment to family advocacy, emphasizes the importance of protecting children from unnecessary stress while ensuring their voices are heard when it genuinely contributes to the case.
Guardians ad Litem: To safeguard the interests of the child, South Carolina courts may appoint a Guardian ad Litem (GAL). A GAL is an impartial representative tasked with assessing the child's situation and making recommendations to the court. Futeral & Nelson LLC collaborates with GALs, ensuring a comprehensive understanding of the child's perspective while maintaining a focus on their emotional well-being.
Child Advocacy and Support Services: Mount Pleasant Divorce Lawyers at Futeral & Nelson LLC recognize the significance of child advocacy and support services. These services may include counseling, therapy, or other forms of emotional support for the child. Integrating these resources into divorce proceedings ensures that the child's emotional needs are addressed, fostering a healthier environment during an emotionally challenging time.
Age and Maturity Factors: While there is no specific age requirement for a child to testify, the court considers the child's age and level of maturity. Younger children may struggle to articulate their thoughts effectively, while older and more mature children may have a better grasp of their feelings. Futeral & Nelson LLC employs a nuanced approach, evaluating each case individually to determine the appropriateness of a child's testimony.
Avoiding Emotional Harm: The emotional well-being of the child is paramount. Futeral & Nelson LLC advocates for children's rights without causing undue emotional harm. Testifying in a courtroom setting can be intimidating, and the firm works diligently to create a supportive environment that minimizes stress and anxiety for the child.
Alternative Testimony Methods: South Carolina courts recognize the potential emotional impact of traditional courtroom testimony on children. Futeral & Nelson LLC explores alternative methods, such as closed-circuit television or recorded testimony, to provide a more comfortable setting for the child. These approaches ensure that the child's perspective is considered without subjecting them to unnecessary stress.
Role of Parental Influence: Courts are cautious of parental influence on a child's testimony. Futeral & Nelson LLC is vigilant in assessing whether a child's testimony reflects their genuine feelings or if it has been influenced by one parent. Ensuring the child's testimony remains impartial and authentic is crucial in upholding the integrity of the legal process.
Educating Parents on the Process: Futeral & Nelson LLC recognizes the importance of educating parents on the legal process and the potential impact on children. By providing clear guidance and setting realistic expectations, the firm empowers parents to navigate divorce proceedings with a focus on their children's emotional well-being.
Mediation and Settlement: Whenever possible, Futeral & Nelson LLC encourages mediation and settlement discussions to resolve divorce matters amicably. This approach minimizes the need for children to testify in court, creating a less adversarial environment and promoting a cooperative co-parenting relationship.
Conclusion
In the sensitive landscape of divorce proceedings in South Carolina, the question of whether children can testify requires careful consideration. Futeral & Nelson LLC, as trusted Mount Pleasant Divorce Lawyers, approaches this matter with a delicate balance of legal expertise and compassion. Recognizing the significance of children's well-being, the firm navigates divorce proceedings with a commitment to protecting the rights of children while ensuring their voices are heard in a manner that prioritizes their emotional health. Contact Futeral & Nelson LLC for comprehensive guidance through divorce proceedings that places your family's well-being at the forefront.

The Dylann Roof case- In Depth
I DO NOT SUPPORT. THIS IS INFORMATIONAL!
Pls reblog incase I get trmed!
Tumblr media
Dylann was born April 3rd 1994 to mother Amelia and father Franklin with 2 sisters Amber and Morgan. During early childhood his parents would divorce and his father would later remarry. His stepmother accused his father of abüse. He would beg his step mother to let him live with her but she wasn’t able to. Dylann would be described to have obsessive compulsive tendencies with germs. In middle school he would stop caring about school and started smoking weed and drinking vodka. In nine years he would have attended seven schools. In 2010 he would drop out of Highschool and continue playing video games and smoking weed and drinking.
In 2015 he was caught with an invalid prescription for suboxone at a mall to which he was banned from for a year. Later that year he was caught loitering in the mall to which they searched his car finding a forearm grip for a AR-15 semiautomatic rifle and six unloaded magazines capable of holding 40 rounds each but was let off it was legal in the state. Roofs Suboxone charge was mishandled and a system error took it as a misdemeanour instead of a felony. Which would have possibly prohibited him from purchasing the firearm.
Later Dylann would look into the Trayvon Martin case and from an unknown article concluded Zimmerman was in the right. He then fell down a rabbit hole of black on white crime and misinformation. He then found 4chan and would find even more misinformation and hard right ideologies Dylann states he hasn’t been the same since that day. Which leads to his manifesto titled ‘The last Rhodesian’ Rhodesia being the African state founded in 1965 ran by primary Europeans and a white supr3macy ideology before being abolished in 1979. The term now sticks with white supremac!sts like Dylann had became, as he also used the flag on his jacket. In preparation before the attack he looked up black churches and found the Emanuel Methodist Episcopal Church and would scout the area and ask around about mass times.
June 15th 2015 somewhere around 8:00pm Dylann entered the church, once he did he was greeted by Rev.Pinckney and given a bible to study with. Roof was sat next to Pinckney as the study continued. As the study closed and the ending pray started Roof stood up and pulled out his Gl0ck 41 .45 calibre handgûn and began sh00ting. Killing Pinckney first. Then 26 year old Tywanza Sanders stood up to plead with Dylann before he said ‘I have to do it. You r4p3 our women and you’re taking over our country and you have to go’ he then wh0re and k!lled Sharonda Singleton, Dr. Daniel L. Simmons, Ethel Lee Lance, Cynthia Hurd, Myra Tompson and Tywanza Sanders. Dylann would reload 5 times that day. Polly Shepherd was spared when he asked her if he shot her yet to which she replied no he then told her ‘good cause we need someone to survive because I’m gonna sh00t myself and you’ll be the only survivor. He then turned the gûn on himself realizing he was out of ammo. He then left the church to the surprise there wasn’t anyone outside. The next day the police confirmed the gûnman was 21 year old Dylann Roof with witnesses reporting they saw him drive towards Shelby, a town close to Charleston. At 10:44am Roof was arrested at a traffic stop in Shelby where it was then confirmed he worked alone.
Five days after the sh00ting the grand jury announced that Roof was being indicted for 33 federal charges.
12 counts hate crime against black people
12 counts obstructing the exercise of religion
9 counts mûrd3r using a firearm.
On June 6th Roof reportedly did not want to be trialed by jury and instead let the judge decide if he was guilty and if the d3ath penalty was reasonable. August 23rd Roofs lawyers called the motion of d3ath penalty unconstitutional and asked to reject the motion. On September 1st an on camera hearing was held in case of outbursts. December 7th 2016 the trial started. During a survivor statement Roofs mom collapsed as she had a heart attack. After 3 days of the trial FBI played a video on which he admitted to laughing and drinking while describing to friends how he’d sh00t the church. To which his friend didn’t report to police and said he was drunk and took his keys and gl0ck that was on him. After 2 hours the jury found him guilty on all 33 charges. Roof wanting to plead guilty but told not to by lawyers.
January 10th 2027 Roof was sentenced to d3ath penalty, and d3ath by lethal injection.

Falling for him Y/N's backstory
Y/N Palmer, Kook princess. Daughter of Charles and Madelyn Palmer, although they divorced a few years back. Her dad was money obsessed, born kook. But her mum on the other hand was carefree, and lively. She couldn’t care about money, she grew up Pogue and found money in becoming a criminal lawyer. She is the best in South Carolina, let alone in Kildare, making over 7 figures every year. She gets paid to fly all around America. Charles was greedy, jealous even of the amount Madelyn is making. Her mum was sick of Charles weird money obsession, and his general attitude towards her and other people. He was rude, and bratty which lead to arguments between the 2 of them. then lead to divorce when Y/N was 10 years old. Her and Charles are still close, when he used to live on the island, she would spend every weekend with him but since he moved to Charleston it’s made it difficult to do that, Y/N just doesn’t have the time for it. The last time she saw her father was at midsummers, he gets invited every year since he still considered “the face of the island” whatever that is.
She lives with her mother on figure 8, In a huge house that they built when Charles left.

Book Recs: Feline Reads
Mimi Lee Gets a Clue by Jennifer J. Chow
Mimi Lee hoped to give Los Angeles animal lovers something to talk about with her pet grooming shop, Hollywoof. She never imagined that the first cat she said hello to would talk back or be quite so, well, catty - especially about those disastrous dates Mimi's mother keeps setting up. When Marshmallow exposes local breeder Russ Nolan for mistreating Chihuahuas, Mimi steals some of her cat's attitude to tell Russ off. The next day the police show up at Hollywoof. Russ has been found dead, and Mimi's shouting match with him has secured her top billing as the main suspect. Hoping to clear her name and save the pups Russ left behind, Mimi enlists help from her dreamy lawyer neighbor Josh. But even with Josh on board, it'll take Mimi and Marshmallow a lot of sleuthing and more than a little sass to get back to the pet-grooming life - and off the murder scene.
This is the first volume in the “A Sassy Cat Mystery” series.
Lawyer for the Cat by Lee Robinson
Sally Baynard is one of the best lawyers around. In the years since her divorce from Family Court Judge Joe Baynard, she dedicated herself to representing the worst and craziest Charleston, S.C. had to offer. But none of the murderers, burglars, or angry divorcing clients compared to Sherman, the dog her ex-husband appointed her to represent. Although the miniature Schnauzer found his way into her heart (and brought his handsome vet Tony along too), his case was a thorny one. With that business out of the way, Sally is happy to move back to non-canine clients... until a probate judge asks her about a cat. Agreeing to represent Beatrice, a black cat who's the beneficiary of a multi-million dollar trust and a plantation, Sally must put her wit, charm, and brains to the test, choosing among three colorful potential caregivers while dodging the former owner's angry son. Meanwhile, Sally must juggle the demands of the court with those of her aging mother and make a decision about Tony, who wants to get more serious. Lawyer for the Cat is Southern women's fiction at its most delightful, featuring strong, smart characters, a charming setting, and plenty of adorable critters.
This is the second volume in the “Sally Baynard” series.
Probable Claws by Rita Mae Brown
With the New Year just around the corner, winter has transformed the cozy Blue Ridge Mountain community of Crozet, Virginia, into a living snow globe. It’s the perfect setting for Mary Minor “Harry” Haristeen to build a new work shed designed by her dear friend, local architect Gary Gardner. But the natural serenity is shattered when out of the blue, right in front of Harry and Deputy Cynthia Cooper, and in broad daylight, Gary is shot to death by a masked motorcyclist. Outraged by the brazen murder, Harry begins to burrow into her friend’s past - and unearths a pattern of destructive greed reaching far back into Virginia’s post-Revolutionary history. When Harry finds incriminating evidence, the killer strikes again. Heedless of her own safety, Harry follows a trail of clues to a construction site in Richmond, where the discovery of mysterious remains has recently halted work. Aided as always by her loyal, if opinionated, companions, crime-solving cats Mrs. Murphy and Pewter, and Tee Tucker the Corgi, Harry hunts for a link between the decades-old dead, the recently violently deceased - and ancient secrets that underlie everything. And while other deaths are narrowly averted in a flurry of fur, the killer remains at large - ever more desperate and dangerous. The deep-rooted legacy of corruption that’s been exposed can never be buried again. But if Harry keeps pursuing the terrible truth, she may be digging her own grave.
This is the 27th volume in the “Mrs. Murphy” series.
The Cat Who Saved Books by Sōsuke Natsukawa
Bookish high school student Rintaro Natsuki is about to close the secondhand bookstore he inherited from his beloved bookworm grandfather. Then, a talking cat named Tiger appears with an unusual request. The feline asks for - or rather, demands - the teenager’s help in saving books with him. The world is full of lonely books left unread and unloved, and Tiger and Rintaro must liberate them from their neglectful owners.
Their mission sends this odd couple on an amazing journey, where they enter different mazes to set books free. Through their travels, Tiger and Rintaro meet a man who leaves his books to perish on a bookshelf, an unwitting book torturer who cuts the pages of books into snippets to help people speed read, and a publishing drone who only wants to create bestsellers. Their adventures culminate in one final, unforgettable challenge - the last maze that awaits leads Rintaro down a realm only the bravest dare enter...

"not seen together in ages"- except this weekend at James Rhodes wedding...
So what? Is that why Cunter's got Proudman who's a well-known divorce lawyer on retainer? How long ago was that parched broad papped at JFK? Creeping around Charleston? Last week? Like she'd pass up another opportunity for free publicity via a minor celebrity? Why the sudden aggressive PR push? I was even IMd by multiple Spanish plants and the sneaky pics? Same. Not exactly organic. Cunter's simply milking that tit-for-tat PR dealio in her fauxmance contract seeing as how she has nothing else to do RN. Throwing herself into her "work"? LMFAO 🤣!

After high school, she went to study medicine in Chicago with her cousin Esme, but her father saw that as giving her too much freedom, so then moved to Wakefield to get married at 23 to a man of her father’s choosing who treated her terribly. She completed her studies in Charleston and began to work there. When she was 26, her father died from heart failure which led to her being truly free for the first time in her life and she filed for a divorce immediately and quit her job. Her ex-husband as well as father’s brother tried to take control of her life and her father’s wealth but she didn’t let it happen, instead getting a lawyer to kick them out of her life and choosing to live life to the fullest now that she had the freedom to be.

HAMILTON'S BIRTHDAY HISTORY POST
Today on January 11th Hamilton was born in Charleston, Nevis.
Overview:
Born into poverty, Hamilton faced many struggles in his life. A hurricane destroyed his home at the age of 17, at the age of 11 he began working at a counting house as a clerk. When he was roughly 19 Hamilton journeyed to America (New York) under the financial aid of Henry Livingston. He met his friends such as Hercules Mulligan and John Laurens in New York and in his early years at war. He also met Marquis de Lafayette in war. Laurens, Laffayete and Hamilton had been referred to as the Gay Trio by Washington’s Nephew. He later became a prominent political figure and fighter in the revolution. He is known for his lasting effects on our government and Financial system.
Revolutionary War and Washington:
In the american revolutionary war Hamilton served as Washington’s Aide-de-camp for the longest time. His Military Stances; Major General and Lieutenant Colonel in the continental army with allegiance to New York and The US. he served in the battle of Yorktown, commanding a battalion that stormed redoubt 9. The battles he served in notably are: Battle of Harlem Heights, Battle of White Plain, Battle of Trenton, Battle of Princeton, Battle of Brandywine, Battle of Germantown, Battle of Monmouth, and The Siege of Yorktown. Hamilton was a son-like figure to Washington although it took a long time to finally allow Hamilton to fight in a battle and command a battalion.
Political Career:
Hamilton began his political career shortly after the war ended. He wrote the federalist papers with James Madison and John Jay, served as a lawyer often defending wrongly treated british people. He attended and participated in the constitutional convention, signed the constitution, and served in Washington’s Cabinet as Secretary of Treasury. He also drafted and ended up creating the financial and banking system used today. He was known for his feuds with Thomas Jefferson and his tendency to endorse a government that many feared would end up like Britain. Hamilton could be referred to as the Nancy Pelosi of his time. He held great power and influence, however he was more disliked than liked at the time. He made important decisions and knew the leaders of the country well, but would never be able to hold the presidency due to the fact that he was unelectable. He had most of the Democratic-Republicans against him and even members of his own party disliked him. (Recognize the name John Adams?) He was widely popular in both good and bad ways and did heavily influence the young nation, but there were things Hamilton simply could do.
Children and Family History:
Born to James Hamilton and Rachel Faucett Lavine. His parents divorced in roughly 1758. Shortly after James left to live on his own leaving Rachel to set up a small shop to provide for her sons. He had a brother named James too. Rachel died in 1768, leaving him a technical orphan with no contact to his father.
In roughly December 14, 1780 - July 12, 1804 he married Elizabeth Schyler
His children include; Philip, Alexander, Angelica, James Alexander, John Church, William, Eliza, Philip (Yes there were two)
His relatives included Philip Schyler, Angelica Schyler Church, and Margarita “Peggy” Schyler.
The Fatal Duel:
On July 11th, Burr and Hamilton met on the Weehawken river on the New Jersey side. Burr’s second was William P. Van Ness, while Hamilton's was Nathaniel Pendleton. There was a doctor present as it was custom for duels. The intent was to keep the duel a secret so they left separate docks. From early letters describing the duel it was clear Hamilton intended to throw away his shot and end the duel with both men still living. However, when it came to the duel Hamilton did not traditionally (and debatably correctly) Delope. Normally the parson would aim and shoot the ground, Hamilton aimed skyward and ended up shooting a tree behind Burr. Burr acted in panic and turned to shoot Hamilton, delivering the fatal blow. Hamilton died the next day.
Life and Legacy:
Hamilton had both ideas and initiative. He was willing to go through on his ideas, all of which were directed at a goal. He was ambitious, headstrong, and a hard worker. He demonstrated gratitude, moral principle and was good natured while also being impulsive, arrogant and jealous which created the interesting life he had. Known for Establishing the Financial System of America and the Reynolds Pamphlet and Affair, Hamilton is truly one of the most interesting founding fathers. And today 264-266 years ago, He was born.

INTRODUCING; SOFIA PADILLA
Age: 26
Gender: Cis Female
Pronouns: She/Her
Occupation: Unemployed
Trigger Warnings: Deportation, Undocumented Immigrants, Coercion, Divorce
Biography:
Sofia was the youngest of the six Padilla children and the only one that held US Citizenship, born less than a year after her family immigrated to the US, her father having found a company to sponsor him and the family’s immigration. Her parents had wanted a better life than their own in Mexico and they did find it. For a short while, at least. Due to a change in the company, her father was let go before they’d managed to get citizenship, but they didn’t return to Mexico when their green cards expired. Instead, her parents got jobs that would overlook their immigration status for cheaper labor. The family didn’t have a lot, but they made ends meet, especially as the older children were able to take on jobs as well.
Sofia didn’t know about this until she was in her teens and when she found out, she was at a complete loss for what to do. Sure, she was a citizen, but her parents were not and hadn’t known what steps to take in order to become citizens without the backing of the company. It wasn’t long after she turned 18 that something happened, her parents and the three siblings that had yet to marry were discovered to be in the country illegally. Despite being a US citizen, she couldn’t sponsor her family to stay until she was 21 and her other two siblings, one still only 20, and the other living in Canada with their spouse, could do nothing either. That was, until Sofia met the lawyer that was assigned by his firm to work on their case pro bono.
Chad seemed fairly uninterested in their case until he laid eyes on the youngest Padilla child. She was clearly distressed at the idea of losing her family to deportation, and he took advantage of that. Sofia wasn’t stupid, however, knowing from the start what he was doing. He told her that the only way for them to stay would be for someone, preferably related by blood or marriage, over 21, in decent financial standing, would have to sponsor them until they could obtain citizenship. Otherwise, they case really could go either way. He played the part of a caring and compassionate man, recently divorced by a cheating wife, and Sofia played the part of the desperate daughter, looking only to help her family. It was decided before the court date that they would be married and he would sponsor her family.
He was true to his word and did just that, however, he also never let her forget it. He was never abusive, but he was a dick and a jealous one at that. The sponsorship and actual applications for their citizenship took a long time and Chad only helped to drag them out. It was during that time that the new housewife joined a gym to pass the time and distance herself from the man she’d married. Anything to get away from his presence for a while, truly. Or out of the house when he wasn’t home. But there’d been one day they’d argued and he later found her as she was going into the gym. He’d asked her if she was really going to wear such an outfit. It wasn’t anything spectacular, but it didn’t make her look bad. So, in the typical Sofia way, she peeled her shirt off, leaving her in a pair of athletics shorts and a pushup sports bra and told him she’d be wearing that. That was the day she first encountered Cain. The two became fast friends, both knowing toxicity in a relationship. Sofia helped him, supporting him when he went to rehab by running the gym that she’d grown to love and teach classes at. He helped her move out once her family had gotten their citizenship and during the ugly divorce. The only reason she’d gotten a settlement was because she’d threatened to reveal that he’d coerced her into getting married in order to keep him from throwing her parent’s case. While she didn’t have evidence, the allegations would be enough to get him in trouble with his firm and she knew it. Sofia also helped Cain with Morgan and encouraged him to fix things with his family.
After Cain left, things were okay. Sure, she missed her best friend, but she had her parents around and a few of her siblings. But, when Chad came around, wanting her back, she decided it was time to leave before he tried to overturn their divorce or the like. She packed up her things without too much hesitation, informing her family of the situation and leaving. They’d all felt so guilty for her having to have done such a thing for them that they didn’t try to convince her not to go. Just to make sure that she kept in touch and promised to visit or be visited once she settled down. Without telling him she was coming, Sofia hopped on a plain and flew into Charleston, taking a pretty expensive Uber ride to Wakefield and starting her new life.
