The irreconcilable contradiction between the US’s conflicting roles as Israel’s most powerful military ally and the principal mediator between Israel and Palestine is obvious to the whole world.

Biden or Netanyahu could end the slaughter very quickly if they wanted to - Netanyahu by agreeing to a permanent ceasefire, or Biden by ending or suspending US weapons deliveries to Israel.

Israel could not carry out this war without US military and diplomatic support.

But Biden refuses to use his leverage, even though he has admitted in an interview that it was “reasonable” to conclude that Netanyahu was prolonging the war for his own political benefit.

The US seems determined to share Israel’s self-inflicted isolation from voices calling for peace from all over the world, including large majorities of countries in the UN General Assembly and Security Council.

But perhaps this is appropriate, as the United States bears a great deal of responsibility for that isolation.

By its decades of unconditional support for Israel, and by using its UN Security Council veto dozens of times to shield Israel from international accountability, the US has enabled successive Israeli governments to pursue flagrantly criminal policies and to thumb their noses at the growing outrage of people and countries across the world.

Israel’s de facto expansion has been facilitated by the US’s monopoly over mediation between Israel and Palestine, which it has aggressively staked out and defended against the UN and other countries.

But as we see even in the midst of the genocide in Gaza, the rest of the world and the UN have failed to break this US monopoly and establish legitimate, impartial mediation by the UN or neutral countries that respect the lives of Palestinians and their human and civil rights.

Dear High Commissioner,

This will be my last official communication to you as Director of the New York Office of the High Commissioner for Human Rights.

I write at a moment of great anguish for the world, including for many of our colleagues. Once again, we are seeing a genocide unfolding before our eyes, and the Organization that we serve appears powerless to stop it. As someone who has investigated human rights in Palestine since the 1980s, lived in Gaza as a UN human rights advisor in the 1990s, and carried out several human rights missions to the country before and since, this is deeply personal to me.

I also worked in these halls through the genocides against the Tutsis, Bosnian Muslims, the Yazidi, and the Rohingya. In each case, when the dust settled on the horrors that had been perpetrated against defenseless civilian populations, it became painfully clear that we had failed in our duty to meet the imperatives of prevention of mass atrocites, of protection of the vulnerable, and of accountability for perpetrators. And so it has been with successive waves of murder and persecution against the Palestinians throughout the entire life of the UN.

High Commissioner, we are failing again.

As a human rights lawyer with more than three decades of experience in the field, I know well that the concept of genocide has often been subject to political abuse. But the current wholesale slaughter of the Palestinian people, rooted in an ethno-nationalist settler colonial ideology, in continuation of decades of their systematic persecution and purging, based entirely upon their status as Arabs, and coupled with explicit statements of intent by leaders in the Israeli government and military, leaves no room for doubt or debate. In Gaza, civilian homes, schools, churches, mosques, and medical institutions are wantonly attacked as thousands of civilians are massacred. In the West Bank, including occupied Jerusalem, homes are seized and reassigned based entirely on race, and violent settler pogroms are accompanied by Israeli military units. Across the land, Apartheid rules.

This is a text-book case of genocide. The European, ethno-nationalist, settler colonial project in Palestine has entered its final phase, toward the expedited destruction of the last remnants of indigenous Palestinian life in Palestine. What's more, the governments of the United States, the United Kingdom, and much of Europe, are wholly complicit in the horrific assault. Not only are these governments refusing to meet their treaty obligations "to ensure respect" for the Geneva Conventions, but they are in fact actively arming the assault, providing economic and intelligence support, and giving political and diplomatic cover for Israel's atrocities.

In concert with this, western corporate media, increasingly captured and state-adjacent, are in open breach of Article 20 of the ICCPR, continuously dehumanizing Palestinians to facilitate the genocide, and broadcasting propaganda for war and advocacy of national, racial, or religious hatred that constitutes incitement to discrimination, hostility, and violence. US-based social media companies are suppressing the voices of human rights defenders while amplifying pro-Israel propaganda. Israel lobby online-trolls and GONGOS are harassing and smearing human rights defenders, and western universities and employers are collaborating with them to punish those who dare to speak out against the atrocities. In the wake of this genocide, there must be an accounting for these actors as well, just as there was for radio Mules Collins in Rwanda.

In such circumstances, the demands on our organization for principled and effective action are greater than ever. But we phave not met the challenge. The protective enforcement power Security Council has again been blocked by US intransigence, the SG [UN Secretary General] is under assault for the mildest of protestations, and our human rights mechanisms are under sustained slanderous attack by an organized, online impunity network.

Decades of distraction by the illusory and largely disingenuous promises of Oslo have diverted the Organization from its core duty to defend international law, international human rights, and the Charter itself. The mantra of the "two-state solution" has become an open joke in the corridors of the UN, both for its utter impossibility in fact, and for its total failure to account for the inalienable human rights of the Palestinian people. The so-called "Quartet" has become nothing more than a fig leaf for inaction and for subservience to a brutal status quo. The (US-scripted) deference to "agreements between the parties themselves" (in place of international law) was always a transparent slight-of-hand, designed to reinforce the power of Israel over the rights of the occupied and dispossessed Palestinians.

High Commissioner, I came to this Organization first in the 1980s, because I found in it a principled, norm-based institution that was squarely on the side of human rights, including in cases where the powerful US, UK, and Europe were not on our side. While my own government, its subsidiarity institutions, and much of the US media were still supporting or justifying South African apartheid, Israeli oppression, and Central American death squads, the UN was standing up for the oppressed peoples of those lands. We had international law on our side. We had human rights on our side. We had principle on our side. Our authority was rooted in our integrity. But no more.

In recent decades, key parts of the UN have surrendered to the power of the US, and to fear of the Israel Lobby, to abandon these principles, and to retreat from international law itself. We have lost a lot in this abandonment, not least our own global credibility. But the Palestinian people have sustained the biggest losses as a result of our failures. It is a stunning historic irony that the Universal Declaration of Human Rights was adopted in the same year that the Nakba was perpetrated against the Palestinian people. As we commemorate the 75th Anniversary of the UDHR, we would do well to abandon the old cliché that the UDHR was born out of the atrocities that proceeded it, and to admit that it was born alongside one of the most atrocious genocides of the 20th Century, that of the destruction of Palestine. In some sense, the framers were promising human rights to everyone, except the Palestinian people. And let us remember as well, that the UN itself carries the original sin of helping to facilitate the dispossession of the Palestinian people by ratifying the European settler colonial project that seized Palestinian land and turned it over to the colonists. We have much for which to atone.

But the path to atonement is clear. We have much to learn from the principled stance taken in cities around the world in recent days, as masses of people stand up against the genocide, even at risk of beatings and arrest. Palestinians and their allies, human rights defenders of every stripe, Christian and Muslim organizations, and progressive Jewish voices saying "not in our name", are all leading the way. All we have to do is to follow them.

Yesterday, just a few blocks from here, New York's Grand Central Station was completely taken over by thousands of Jewish human rights defenders standing in solidarity with the Palestinian people and demanding an end to Israeli tyranny (many risking arrest, in the process). In doing so, they stripped away in an instant the Israeli hasbara propaganda point (and old antisemitic trope) that Israel somehow represents the Jewish people. It does not. And, as such, Israel is solely responsible for its crimes. On this point, it bears repeating, in spite of Israel lobby smears to the contrary, that criticism of Israel's human rights violations is not antisemitic, any more than criticism of Saudi violations is Islamophobic, criticism of Myanmar violations is anti-Buddhist, or criticism of Indian violations is anti-Hindu. When they seek to silence us with smears, we must raise our voice, not lower it. I trust you will agree, High Commissioner, that this is what speaking truth to power is all about.

But I also find hope in those parts of the UN that have refused to compromise the Organization's human rights principles in spite of enormous pressures to do so. Our independent special rapporteurs, commissions of enquiry, and treaty body experts, alongside most of our staff, have continued to stand up for the human rights of the Palestinian people, even as other parts of the UN (even at the highest levels) have shamefully bowed their heads to power. As the custodians of the human rights norms and standards, OHCHR. has a particular duty to defend those standards. Our job, I believe, is to make our voice heard, from the Secretary-General to the newest UN recruit, and horizontally across the wider UN system, incisting that the human rights of the Palestinian people are not up for debate, negotiation, or compromise anywhere under the blue flag.

What, then, would a UN-norm-based position look like? For what would we work if we were true to our rhetorical admonitions about human rights and equality for all, accountability for perpetrators, redress for victims, protection of the vulnerable, and empowerment for rights-holders, all under the rule of law? The answer, I believe, is simple—if we have the clarity to see beyond the propagandistic smokescreens that distort the vision of justice to which we are sworn, the courage to abandon fear and deference to powerful states, and the will to truly take up the banner of human rights and peace. To be sure, this is a long-term project and a steep climb. But we must begin now or surrender to unspeakable horror. I see ten essential points:

Legitimate action: First, we in the UN must abandon the failed (and largely disingenuous) Oslo paradigm, its illusory two-state solution, its impotent and complicit Quartet, and its subjugation of international law to the dictates of presumed political expediency. Our positions must be unapologetically based on international human rights and international law.

Clarity of Vision: We must stop the pretense that this is simply a conflict over land or religion between two warring parties and admit the reality of the situation in which a disproportionately powerful state is colonizing, persecuting, and dispossessing an indigenous population on the basis of their ethnicity.

One State based on human rights: We must support the establishment of a single, democratic, secular state in all of historic Palestine, with equal rights for Christians, Muslims, and Jews, and, therefore, the dicmantling of the deeply racist, settler-colonial project and an end to apartheid across the land.

Fighting Apartheid: We must redirect all UN efforts and resources to the struggle against apartheid, just as we did for South Africa in the 1970s, 80s, and early 90s.

Return and Compensation: We must reaffirm and insist on the right to return and full compensation for all Palestinians and their families currently living in the occupied territories, in Lebanon, Jordan, Syria, and in the diaspora across the globe.

Truth and Justice: We must call for a transitional justice process, making full use of decades of accumulated UN investigations, enquiries, and reports, to document the truth, and to ensure accountability for all perpetrators, redress for all victims, and remedies for documented injustices.

Protection: We must press for the deployment of a well-resourced and strongly mandated UN protection force with a sustained mandate to protect civilians from the river to the sea.

Disarmament: We must advocate for the removal and destruction of Israel's massive stockpiles of nuclear, chemical, and biological weapons, lest the conflict lead to the total destruction of the region and, possibly, beyond.

Mediation: We must recognize that the US and other western powers are in fact not credible mediators, but rather actual parties to the conflict who are complicit with Israel in the violation of Palestinian rights, and we must engage them as such.

Solidarity: We must open our doors (and the doors of the SG) wide to the legions of Palestinian, Israeli, Jewish, Muslim, and Christian human rights defenders who are standing in solidarity with the people of Palestine and their human rights and stop the unconstrained flow of Israel lobbyists to the offices of UN leaders, where they advocate for continued war, persecution, apartheid, and impunity, and smear our human rights defenders for their principled defense of Palestinian rights.

This will take years to achieve, and western powers will fight us every step of the way, so we must be steadfast. In the immediate term, we must work for an immediate ceasefire and an end to the longstanding siege on Gaza, stand up against the ethnic cleansing of Gaza, Jerusalem, and the West Bank (and elsewhere), document the genocidal assault in Gaza, help to bring massive humanitarian aid and reconstruction to the Palestinians, take care of our traumatized colleagues and their families, and fight like hell for a principled approach in the UN's political offices.

The UN's failure in Palestine thus far is not a reason for us to withdraw. Rather it should give us the courage to abandon the failed paradigm of the past, and fully embrace a more principled course. Let us, as OHCHR, boldly and proudly join the anti-apartheid movement that is growing all around the world, adding our logo to the banner of equality and human rights for the Palestinian people. The world is watching. We will all be accountable for where we stood at this crucial moment in history. Let us stand on the side of justice.

When Russia invaded Ukraine, the insurance giant AXA (France) took targeted measures against it. Yet as Israel, a 75-year-old regime of colonialism and apartheid, wages a genocidal war on Gaza, AXA continues to invest in Israeli banks that finance war crimes and the theft of Palestinian land and natural resources.

Hewlett Packard Inc (HP Inc)

HP Inc (USA) provides services to the offices of the genocide leaders, Israeli Prime Minister Netanyahu and Finance Minister Smotrich.

SodaStream

SodaStream is actively complicit in Israel's policy of displacing Israel's indigenous Bedouin-Palestinian citizens in the Naqab (Negev) and has a long history of racial discrimination against Palestinian workers.

Ahava cosmetics

Ahava have their production site, visitor center and main store in an illegal Israeli settlement in the occupied Palestinian territories.

D/MAX

RE/MAX (USA) markets and sells property in illegal Israeli settlements built on stolen Palestinian land, thus enabling Israeli colonization of the occupied West Bank.

Elbit Systems is the largest apartheid Israeli arms company. It “field tests” its weapons against the Palestinians, including in Israel's ongoing genocidal war against the Palestinians in Gaza. In addition to building killer drones, Elbit produces surveillance technology for the apartheid wall, checkpoints and fence in Gaza, enabling apartheid. The US and EU use Elbit technology to militarize their borders, violating the rights of refugees and indigenous peoples.

HD Hyundai/Volvo/CAT/JCB machinery

by HD Hyundai (South Korea), Volvo (Sweden/China), CAT (United States) and JCB (United Kingdom) have been used by Israel in the ethnic cleansing and forced displacement of Palestinians through the destruction of their homes, farms and commercial activities, as well as the construction of illegal settlements on stolen land, a war crime under international law.

Barclays

Barclays Bank (UK) holds more than £1 billion in shares and provides more than £3 billion in loans and subscriptions to nine companies whose weapons, components and military technology have been used in Israel's armed violence against Palestinians.

CAF

The Basque transport company CAF builds and provides maintenance services to the Jerusalem Light Rail (JLR), a tram line serving illegal Israeli settlements in Jerusalem. The CAF benefits from Israel's war crimes on stolen Palestinian lands.

Chevron

The US fossil fuel multinational Chevron is the main international company extracting gas claimed by Israeli apartheid in the eastern Mediterranean. Chevron generates billions in revenue, bolstering Israel's war chest and apartheid system and exacerbating the climate crisis.

HikVision

Amnesty International has documented high-resolution CCTV cameras made by Chinese company Hikvision installed in residential areas and mounted on Israeli military infrastructure for surveillance of Palestinians. Some of these models, according to Hikvision marketing, can connect to external facial recognition software.

TKH Security

Amnesty International has identified cameras from the Dutch company TKH Security used by Israel for surveillance of Palestinians. TKH supplies the Israeli police with surveillance technology used to enforce apartheid.

Zara

Zara's latest marketing campaign uses corpses in plastic wrapping, and warzone aesthetics, mocking the genocide by israel in Gaza. In a previous incident Joey Schwebel, a Canadian-Israeli dual national and chairman of israel's Zara franchisee Trimera, hosted the convicted terrorist Itamar Ben-Gvir at his home in the lead-up to the Israeli elections. Zara did not made a statement distancing themselves from this association and allowed this ad campaign to run.

Adidas

Adidas uses isr@eli manufacturer, Delta Galil, to manufacture its underwear range.

Prada:

Prada Beauty is a partnership with L'Oreal, which is a 'warm friend of Isr@el'.

Louis Vuitton:

The owner of Louis Vuitton's parent company, LVMH, Bernard Arnault invests hundreds of millions in Isr@eli companies

Hi. I don't usually speak up about these issues mainly because I don't exactly have a following, and I'm pretty sure only mutuals will be able to see this post.

But—

Let's open our eyes to what's going on for a second. Let's take a break from consuming things that distract us from reality. From what's been happening across the sea. From the tides that are ebbing and flowing with the blood of the innocent. From the cries of children, mothers, fathers, brothers, and sisters stripped of their home and of their lives.

From the people who are desperately reaching out to us for help.

I have been privileged enough not to wake to the sounds of bombs mere miles from where I'm sleeping. I have been privileged enough to wake up and not smell sulfur and ash in the air. I have been privileged enough not to live in cramped spaces that breed disease, lacking food or clean water.

The people of Palestine need you to amplify their voices. They need you to scream for them now more than ever.

Rafah is currently being bombed and invaded. The border between the Rafah to Egypt crossing is currently being lined with tanks.

I know that it all feels hopeless, but please do not give up. There will be another opportunity. There will be another opening. While the invasion of Rafah is currently taking place, a ceasefire resolution is still being negotiated as we speak. Do NOT give up hope.

I didn't want to make this post without supplementing it with something that is actionable, but as someone with little means to help monetarily, I understand if you cannot directly donate to the links provided below. However, please do not underestimate your voice. Being able to spread this to someone who is able to contribute funding is equally as important.

So what can you do?

The simplest thing you can do is share these resources. Share them to as many people as you can. Amplifying the voices of the disparaged means that more people who are able to give aid can be reached. Research any local movements, any protests happening in your city or town, and attend them if you can.

And when your voice is hoarse from speaking, from screaming. When your legs hurt from the march. When you aren't able to reach as far as you can, as you want to, as you need to, the next thing you can do is listen. Keep updated on what is happening. Keep your eyes open. The more people mobilize and direct their efforts to help, the more people come up with new ways to give aid. There is always a next step.

Avoid supporting companies who are supporting or are compliant to Israel's genocide. There is a useful app called Boycat that you can scan the barcodes of products with so it can tell you, using its ever-expanding database, if its brand is compliant to ethical standards. One of the current campaigns it's supporting is that of Palestine.

eSims For Gaza makes sure that people in Gaza are able to maintain communication with their families overseas, and allows journalists to secure more visibility on what is happening on the field.

The Gaza Sunbirds are a para-cycling team focusing their efforts and resources to helping their community by routing supplies to families in the Gaza strip.

Gxza Health provides telemedicine to the people in Gaza in need of medicine and healthcare. They are partnered with UNRWA to get medication delivered to patients.

Palestine Red Crescent Society is a part of the Red Cross and the Red Crescent and helps facilitate aid to the people in the Gaza strip.

Sulala Animal Rescue is an organization focused on rescuing, treating, and feeding strays in Gaza City, with hopes of possibly opening a permanent shelter with international support.

Medical Aid for Palestinians supports Palestinians by providing medical aid to those who need it.

Anera provides warm meals and facilitates medical aid for refugees in Palestine.

Baitumaal provides emergency aid and poverty relief to communities that are under-privileged, including a service to sponsor children who have been orphaned.

If you want to directly sponsor a Palestinian family, a grassroots movement called Operation Olive Branch is currently working hard to amplify the voices of Palestinians who are in need of funding to escape their current predicament. You can find over 800+ families in the spreadsheet that they maintain, with gofundme campaigns operated by the families themselves. OOB also heads the Perinatal Project, a project that specifically caters to people in need of urgent prenatal, postpartum, and infant care needs.

A Vancouver-area Jewish organization is raising safety concerns amid reports Hamas has called for a day of action on Friday amid the escalating conflict in Israel and Palestine.

In a community security update posted to its website, the Jewish Federation of Greater Vancouver said it was taking the reports “very seriously.”

“Our understanding is that Hamas is calling for violence in Israel, the West Bank, and around the world under the guise of showing solidarity with Palestinians,” the organization wrote.

The Philly Palestine Coalition on Monday began a petition that demanded the cancellation of the film festival, which is co-sponsored by Israel Bonds, the Consulate General of Israel, and the Jewish Federation of Greater Pennsylvania. The pro-Palestinian group falsely claimed that Israel Bonds “finances the Israeli government’s budget” and “directly contributes to the displacement of Palestinians, the expansion of unlawful settlements, and unchecked settler violence.” The petition also falsely accused the state of Israel of genocide, apartheid, and occupation in its treatment of Palestinians living in the Gaza Strip.

According to the Israel Bonds website, proceeds from the sale of bonds have contributed to Israel’s growth in high-tech, cleantech, and biotech. Capital from Israel bonds have also “helped strengthen every aspect of Israel’s economy, enabling national infrastructure development … [and] expanded transportation networks enabled by investments in Israel bonds help facilitate shipment of ‘Made in Israel’ technology around the world, enhancing national export growth.”

Soon after facing pressure from the Philly Palestine Coalition, the BMFI announced on Monday it pulled the screening of The Child Within Me — a day before the scheduled event.

“Bryn Mawr Film Institute is not a political organization. We don’t endorse or oppose any causes,” the BMFI said in a released statement. “In past years, we have not regarded hosting a screening from the Israeli Film Festival as a political partnership or taking a stance on any issues. This was our feeling when we arranged the 2024 screening many months ago. However, as the situation in Israel and Gaza has developed, it has become clear that our showing this movie is being widely taken among individuals and institutions in our community as an endorsement of Israel’s recent and ongoing actions. This is not a statement we intended or wish to make.”

“BMFI is a safe place for civil and nuanced conversations about diverse stories,” the film institute added. “For the well-being and safety of all patrons, BMFI will not be a location for anger and violence. For those who wish to partake in an IFF screening, there are upcoming screenings at other venues.”

The Jewish Federation of Greater Philadelphia and the Anti-Defamation League’s chapter in Philadelphia were outraged by the move. They urged the BMFI to immediately reverse its decision to cancel the screening.

The Nova Music Festival Exhibition, described on its website as an “in-depth remembrance of the brutal October 7th attack,” is currently installed at 35 Wall Street in NYC. More than 9 million Jews lived in Europe before World War II,residing in countries later controlled by the Nazis (Germany,Poland,Yugoslavia,Czechoslovakia & others). After the Holocaust,the Zionist movement claims that one in three Jews was killed. So,how and why did this happen?

Let's go back a bit in history. After losing World War I,Germany faced poverty, despair & other heavy consequences. A party known as the Nazis emerged,gaining popularity by promoting two fundamental ideas

The first idea was the superiority of the Aryan race,the elite of nations..

The second was the establishment of a national state for the Germans, a sharp nationalist discourse evolving with the birth of the modern state, strengthened by the colonial European mindset that viewed African and Asian colonies as inferior.

In light of this, the Nazis targeted those they deemed subhuman, either due to their racial status or political non-acceptance. This means that the Jews were not the only victims of the conflict.

The Nazis also targeted Romani people, Slavic peoples, some Arabs, along with other groups like Communists, Socialists, trade unionists, homosexuals, and the disabled. By the way, among the victims were also Christian religious believers.

The Jews, along with others, faced systematic persecution policies leading to the "Final Solution" (extermination). Their books were burned, they were dismissed from jobs, their properties were confiscated, and they were uprooted from their homes to live in isolated ghettos.

They were forced to wear a distinctive symbol on their clothes (the yellow Star of David) and were sent to concentration camps, subjected to forced labor until death.

The victims of the Nazis exceeded 20 million people, so why focus only on the Jews?

Jewish groups possessed financial resources, media institutions, research centers, and academic voices that shed more light on the victims of the Holocaust among the Jews. However, the number of Holocaust victims remains one of the most prominent historical debates to this day.

People are divided into groups: some deny the genocide, some believe the results are exaggerated, and some accuse the Zionist movement of exaggerating it for the benefit of the establishment of Israel. Here, let's pause. How did Israel benefit from the Holocaust?

During the initial months of Nazi rule, an agreement was signed between the Zionist Agency and Nazi Germany, aiming to facilitate Jewish migration to Palestine, provided they give up their assets to Germany. This is the only known official contract between the two parties.

While it was later criticized by all sides, this agreement allowed more than 60,000 Jews to immigrate to Palestine early on and opened the door for similar migrations that greatly increased with the rise of Nazism, leading to the Nakba (Palestinian exodus).

This agreement, along with other documents, led some to the idea that Hitler supported Zionism, prompting former Mayor of London, Ken Livingstone, to declare this belief openly, which eventually resulted in his suspension from the Labour Party in 2016.

The Holocaust's narrative of persecution and suffering dominated the world, paving the way for Jewish migration to Palestine. But, did the story end like that?

UN Human Rights New York Office Director Craig Mokhiber has resigned in protest against the UN's incompetence and failure to intervene and acknowledge Israel's crimes against humanity in Palestine.

Dear High Commissioner,

This will be my last official communication to you as Director of the New York Office of the High Commissioner for Human Rights.

I write at a moment of great anguish for the world, including for many of our colleagues. Once again, we are seeing a genocide unfolding before our eyes, and the Organization that we serve appears powerless to stop it. As someone who has investigated human rights in Palestine since the 1980s, lived in Gaza as a UN human rights advisor in the 1990s, and carried out several human rights missions to the country before and since, this is deeply personal to me.

I also worked in these halls through the genocides against the Tutsis, Bosnian Muslims, the Yazidi, and the Rohingya. In each case, when the dust settled on the horrors that had been perpetrated against defenseless civilian populations, it became painfully clear that we had failed in our duty to meet the imperatives of prevention of mass atrocites, of protection of the vulnerable, and of accountability for perpetrators. And so it has been with successive waves of murder and persecution against the Palestinians throughout the entire life of the UN.

High Commissioner, we are failing again.

As a human rights lawyer with more than three decades of experience in the field, I know well that the concept of genocide has often been subject to political abuse. But the current wholesale slaughter of the Palestinian people, rooted in an ethno-nationalist settler colonial ideology, in continuation of decades of their systematic persecution and purging, based entirely upon their status as Arabs, and coupled with explicit statements of intent by leaders in the Israeli government and military, leaves no room for doubt or debate. In Gaza, civilian homes, schools, churches, mosques, and medical institutions are wantonly attacked as thousands of civilians are massacred. In the West Bank, including occupied Jerusalem, homes are seized and reassigned based entirely on race, and violent settler pogroms are accompanied by Israeli military units.

Across the land, Apartheid rules.

This is a text-book case of genocide. The European, ethno-nationalist, settler colonial project in Palestine has entered its final phase, toward the expedited destruction of the last remnants of indigenous Palestinian life in Palestine. What's more, the governments of the United States, the United Kingdom, and much of Europe, are wholly complicit in the horrific assault. Not only are these governments refusing to meet their treaty obligations "to ensure respect" for the Geneva Conventions, but they are in fact actively arming the assault, providing economic and intelligence support, and giving political and diplomatic cover for Israel's atrocities.

In concert with this, western corporate media, increasingly captured and state-adjacent, are in open breach of Article 20 of the ICCPR, continuously dehumanizing Palestinians to facilitate the genocide, and broadcasting propaganda for war and advocacy of national, racial, or religious hatred that constitutes incitement to discrimination, hostility, and violence. US-based social media companies are suppressing the voices of human rights defenders while amplifying pro-Israel propaganda. Israel lobby online-trolls and GONGOS are harassing and smearing human rights defenders, and western universities and employers are collaborating with them to punish those who dare to speak out against the atrocities. In the wake of this genocide, there must be an accounting for these actors as well, just as there was for radio Milles Collines in Rwanda.

In such circumstances, the demands on our organization for principled and effective action are greater than ever. But we have not met the challenge. The protective enforcement power Security Council has again been blocked by US intransigence, the SG is under assault for the mildest of protestations, and our human rights mechanisms are under sustained slanderous attack by an organized, online impunity network.

Decades of distraction by the illusory and largely disingenuous promises of Oslo have diverted the Organization from its core duty to defend international law, international human rights, and the Charter itself. The mantra of the "two-state solution" has become an open joke in the corridors of the UN, both for its utter impossibility in fact, and for its total failure to account for the inalienable human rights of the Palestinian people. The so-called "Quartet" has become nothing more than a fig leaf for inaction and for subservience to a brutal status quo. The (US-scripted) deference to "agreements between the parties themselves" (in place of international law) was always a transparent slight-of-hand, designed to reinforce the power of Israel over the rights of the occupied and dispossessed Palestinians.

High Commissioner, I came to this Organization first in the 1980s, because I found in it a principled, norm-based institution that was squarely on the side of human rights, including in cases where the powerful US, UK, and Europe were not on our side. While my own government, its subsidiarity institutions, and much of the US media were still supporting or justifying South African apartheid, Israeli oppression, and Central American death squads, the UN was standing up for the oppressed peoples of those lands. We had international law on our side. We had human rights on our side. We had principle on our side. Our authority was rooted in our integrity. But no more.

In recent decades, key parts of the UN have surrendered to the power of the US, and to fear of the Israel Lobby, to abandon these principles, and to retreat from international law itself. We have lost a lot in this abandonment, not least our own global credibility. But the Palestinian people have sustained the biggest losses as a result of our failures. It is a stunning historic irony that the Universal Declaration of Human Rights was adopted in the same year that the Nakba was perpetrated against the Palestinian people. As we commemorate the 75* Anniversary of the UDHR, we would do well to abandon the old cliché that the UDHR was born out of the atrocities that proceeded it, and to admit that it was born alongside one of the most atrocious genocides of the 20* Century, that of the destruction of Palestine. In some sense, the framers were promising human rights to everyone, except the Palestinian people. And let us remember as well, that the UN itself carries the original sin of helping to facilitate the dispossession of the Palestinian people by ratifying the European settler colonial project that seized Palestinian land and turned it over to the colonists.

We have much for which to atone.

But the path to atonement is clear. We have much to learn from the principled stance taken in cities around the world in recent days, as masses of people stand up against the genocide, even at risk of beatings and arrest. Palestinians and their allies, human rights defenders of every stripe, Christian and Muslim organizations, and progressive Jewish voices saying "not in our name" to do is to follow them.

Yesterday, just a few blocks from here, New York's Grand Central Station was completely taken over by thousands of Jewish human rights defenders standing in solidarity with the Palestinian people and demanding an end to Israeli tyranny (many risking arrest, in the process). In doing so, they stripped away in an instant the Israeli hasbara propaganda point (and old antisemitic trope) that Israel somehow represents the Jewish people. It does not. And, as such, Israel is solely responsible for its crimes. On this point, it bears repeating, in spite of Israel lobby smears to the contrary, that criticism of Israel's human rights violations is not antisemitic, any more than criticism of Saudi violations is Islamophobic, criticism of Myanmar violations is anti-Buddhist, or criticism of Indian violations is anti-Hindu. When they seek to silence us with smears, we must raise our voice, not lower it. I trust you will agree, High Commissioner, that this is what speaking truth to power is all about.

But I also find hope in those parts of the UN that have refused to compromise the Organization's human rights principles in spite of enormous pressures to do so. Our independent special rapporteurs, commissions of enquiry, and treaty body experts, alongside most of our staff, have continued to stand up for the human rights of the Palestinian people, even as other parts of the UN (even at the highest levels) have shamefully bowed their heads to power. As the custodians of the human rights norms and standards, OHCHR has a particular duty to defend those standards. Our job, I believe, is to make our voice heard, from the Secretary-General to the newest UN recruit, and horizontally across the wider UN system, insisting that the human rights of the Palestinian people are not up for debate, negotiation, or compromise anywhere under the blue flag.

What, then, would a UN-norm-based position look like? For what would we work if we were true to our rhetorical admonitions about human rights and equality for all, accountability for perpetrators, redress for victims, protection of the vulnerable, and empowerment for rights-holders, all under the rule of law? The answer, I believe, is simple if we have the clarity to see beyond the propagandistic smokescreens that distort the vision of justice to which we are sworn, the courage to abandon fear and deference to powerful states, and the will to truly take up the banner of human rights and peace. To be sure, this is a long-term project and a steep climb. But we must begin now or surrender to unspeakable horror. I see ten essential points:

Legitimate action: First, we in the UN must abandon the failed (and largely disingenuous) Oslo paradigm, its illusory two-state solution, its impotent and complicit Quartet, and its subjugation of international law to the dictates of presumed political expediency. Our positions must be unapologetically based on international human rights and international law.

Clarity of Vision: We must stop the pretense that this is simply a conflict over land or religion between two warring parties and admit the reality of the situation in which a disproportionately powerful state is colonizing, persecuting, and dispossessing an indigenous population on the basis of their ethnicity.

One State based on human rights: We must support the establishment of a single, democratic, secular state in all of historic Palestine, with equal rights for Christians, Muslims, and Jews, and, therefore, the dismantling of the deeply racist, settler-colonial project and an end to apartheid across the land.

Fighting Apartheid: We must redirect all UN efforts and resources to the struggle against apartheid, just as we did for South Africa in the 1970s, 80s, and early 90s.

Return and Compensation: We must reaffirm and insist on the right to return and full compensation for all Palestinians and their families currently living in the occupied terntones, in Lebanon, Jordan, Syria, and in the diaspora across the globe.

Truth and Justice: We must call for a transitional justice process, making full use of decades of accumulated UN investigations, enquiries, and reports, to document the truth, and to ensure accountability for all perpetrators, redress for all victims, and remedies for documented injustices.

Protection: We must press for the deployment of a well-resourced and strongly mandated UN protection force with a sustained mandate to protect civilians from the river to the sea.

Disarmament: We must advocate for the removal and destruction of Israel's massive stockpiles of nuclear, chemical, and biological weapons, lest the conflict lead to the total destruction of the region and, possibly, beyond.

Mediation: We must recognize that the US and other western powers are in fact not credible mediators, but rather actual parties to the conflict who are complicit with Israel in the violation of Palestinian rights, and we must engage them as such.

Solidarity: We must open our doors (and the doors of the SG) wide to the legions of Palestinian, Israeli, Jewish, Muslim, and Christian human rights defenders who are standing in solidarity with the people of Palestine and their human rights and stop the unconstrained flow of Israel lobbyists to the offices of UN leaders, where they advocate for continued war, persecution, apartheid, and impunity, and smear our human rights defenders for their principled defense of Palestinian rights.

This will take years to achieve, and western powers will fight us every step of the way, so we must be steadfast. In the immediate term, we must work for an immediate ceasefire and an end to the longstanding siege on Gaza, stand up against the ethnic cleansing of Gaza, Jerusalem, and the West Bank (and elsewhere), document the genocidal assault in Gaza, help to bring massive humanitarian aid and reconstruction to the Palestinians, take care of our traumatized colleagues and their families, and fight like hell for a principled approach in the UN's political offices.

The UN's failure in Palestine thus far is not a reason for us to withdraw. Rather it should give us the courage to abandon the failed paradigm of the past, and fully embrace a more principled course. Let us, as OHCHR, boldly and proudly join the anti-apartheid movement that is growing all around the world, adding our logo to the banner of equality and human rights for the Palestinian people. The world is watching. We will all be accountable for where we stood at this crucial moment in history. Let us stand on the side of justice.
