ICJ RULES AGAINST STOPPING GERMAN ARMS EXPORTS TO THE ISRAELI OCCUPATION

The International Court of Justice (ICJ) at the Hague has ruled against Nicaragua in its case asking the Court to stop German arms exports to the Israeli occupation in support for its genocide in Gaza.

"The circumstances are not such as to require the exercise of its power under Article 41 of the statute to indicate provisional measures," stated presiding Judge Nawaf Salam.

Nicaragua previously argued before the Court that Germany was in violation of the 1948 Genocide Conventions by supplying arms to the Israeli occupation at a time when it would be plausibly used to commit acts of genocide in Gaza.

Germany continues to be one of the largest suppliers of weaponry to the Israeli occupation army, providing $353.7 million in equipment and munitions in 2023.

"Speaking to Al Jazeera, Omer Bartov, a professor of Holocaust and Genocide Studies at Brown University, says Israeli officials, both in Netanyahu’s coalition and in the opposition, have been speaking more openly about making Gaza unlivable for Palestinians.

“There have been ongoing statements in recent days … which seem to indicate a particular plan the Israeli government seems to want to implement, which is not only to create unbearable conditions for the population of Gaza, but actually to speak about removing the population,” he said.

“Or as one minister [far-right finance minister] Smotrich said, to encourage them to leave Gaza either to the Sinai Peninsula or to other countries that would welcome them,” Bartov said.

“Or that Israel would rule that area and as this particular minister said, there should be discussions about settling the Gaza Strip,” he said, adding if the current trajectory continues, the world is witnessing an operation of “ethnic cleansing under the mantle of humanitarian action”.

American Muslim leaders carried on a campaign launched earlier this month against President Joe Biden over his handling of the Gaza conflict.

Saturday’s plan to actively campaign against Biden in all 50 US states was announced in Chicago, Illinois at the end of a national convention organised by the Muslim American Society and Islamic Circle of North America.

The leaders say they intend to guarantee Biden’s loss in the upcoming 2024 election over his refusal to call for a ceasefire in Gaza, where Israeli attacks have killed more than 21,000 people, mostly children and women.

“The president betrayed us because he violated the value of dignity and life. What’s the point of voting for you when you deny 2.2 million [in Gaza] people water?” said Hassan Abdel Salam, a spokesperson for the campaign.

" Prime Minister Netanyahu thanked the Biden administration for its continued backing, including approval for a new emergency weapons sale, the second this month.

Secretary of State Antony Blinken made a similar decision on December 9 to approve the sale to Israel of nearly 14,000 rounds of tank ammunition worth more than $106m.

Some Democratic lawmakers have spoken of making a proposed $14.3bn in American military assistance to Israel contingent on concrete steps by Netanyahu’s government to reduce civilian casualties in Gaza.

Judges at the top United Nations court ordered Israel to halt its offensive in the southern Gaza city of Rafah and withdraw from the enclave, in a case brought by South Africa accusing Israel of genocide, citing “immense risk” to the Palestinian population. Friday’s decision marked the third time this year the 15-judge panel has issued preliminary orders seeking to rein in the death toll and alleviate humanitarian suffering in Gaza. While orders are legally binding, the court has no police to enforce them. Reading out a ruling by the International Court of Justice or World Court, the body’s president, Nawaf Salam, said provisional measures ordered by the court in March did not fully address the situation in the besieged Palestinian enclave now, and conditions had been met for a new emergency order. Israel must “immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part,” Salam said, and called the humanitarian situation in Rafah “disastrous”. The Hague, 26 January 2024. The International Court of Justice today delivered its Order on the Request for the indication of provisional measures submitted by South Africa in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel).

It is recalled that, on 29 December 2023, South Africa filed an Application instituting proceedings against Israel concerning alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) in relation to Palestinians in the Gaza Strip. In its Application, South Africa also requested the Court to indicate provisional measures in order to “protect against further, severe and irreparable harm to the rights of the Palestinian people under the Genocide Convention” and “to ensure Israel’s compliance with its obligations under the Genocide Convention not to engage in genocide, and to prevent and to punish genocide” (see press release No. 2023/77).

Public hearings on South Africa’s request for provisional measures were held on Thursday 11 and Friday 12 January 2024.

In its Order, which has binding effect, the Court indicates the following provisional measures:

The wave of book bans sweeping the US, typically reserved for works of fiction deemed controversial, has hit textbooks used in public schools, marking the next step in Republicans’ war on education. The board of trustees for the Cypress Fairbanks independent school district in Houston voted 6-1 earlier this month to redact certain chapters in science textbooks, including those about vaccines, human growth, diversity and climate change. The motion to remove the chapters was made by the board’s vice-president, Natalie Blasingame, and almost unanimously supported. Blasingame, who has served on the board since 2021, did not give a specific explanation for the decision, but said the subjects go beyond what the state requires to teach and creates “a perception that humans are bad”. Last year, the Republican-controlled state board approved textbooks for the schools’ science curriculums, rejecting several books on climate, so the local school district’s censorship of these textbooks is even more restrictive.

Education experts say the move could have far-reaching consequences, prompting similar decisions to omit information in other subjects, and by public school districts across the country. The board’s decision drew the ire of local parents and education groups. Bryan Henry, a local parent and founder of the non-partisan group Cypress Families for Public Schools, said he was concerned about the precedent this decision sets. “Will trustees at the local school board level be able to just delete chapters about civil rights because they just mentioned the history of same-sex marriage?” Henry, 37, said. “It’s really kind of alarming what this could mean for ideological influence and control over what is taught in schools.” Henry describes Cypress, a sprawling suburb of Houston with a population of nearly 200,000, as an increasingly diverse community with a loud minority of political extremists.

“A lot of Republicans in the Cy-Fair area, who are very conservative but are pro-public education, are having to now grapple with the fact that [the] governor, state representatives – they’re really not pro-public education,” he said. “And so people are struggling with how to reconcile that, because they don’t want to vote for Democrats.” Henry added this “level of oversight, micromanagement and interference” was “scary.” The Texas Freedom to Read Project, an organization that fights book bans, swiftly condemned the decision. “To ban entire chapters of textbooks and withhold that information from students is not only unconstitutional, but it is taking away their access to real-life ideas that exist in this world,” said Laney Hawes, co-founder of the group. “Access to a diverse and wide range of information is what prepares students to navigate this world successfully. When we ban books and limit students’ ability to access ideas, we are closing doors to their futures.”

The idea that we’re redacting chapters from state-approved textbooks is almost unheard of. It’s so outlandish,” Meehan said. Book bans have become a core element of platforms of well funded far-right politicians, who have tried to win a larger presence on school boards across the US. “I’m almost worried about a concerning trend where far-right Republican candidates are replacing moderate Republicans on school boards, not because citizens believe they are better suited for the job, but because rightwing billionaires and Pacs [political action committees] are starting to pour money into these local elections,” said David DeMatthews, an education professor at the University of Texas at Austin, who previously worked as a public school teacher and district administrator.

Public school textbooks are the next battleground item in the right-wing’s dangerous and censorious book-banning crusade in schools.

I know the ICJ ruling sounds underwhelming, and there are aspects that are less than what we hoped, but we cannot downplay the significance of what happened.

The ICJ ruled that what Israel is doing is wrong. And that continuing to do it is signs of genocide. This will not stop Israel from doing it, but when they continue to do it, and others continue to fund them, then they all will be hit for it.

What is crucial now is not relying on the ICJ for action, but recognizing that failure to stop this IS what the ICJ will go after. So now is the time to ramp up the work, pressuring politicians, blocking weapons. Anyone who supports Israel’s crimes is now legally complicit.

The very fact that the responsibility of adjudicating on this case has fallen upon your shoulders underscores a disheartening truth – the failure of existing systems of checks and balances within the international community. It is disconcerting that national interests have tainted the operations of our global systems, allowing the mass killing of civilians to persist without intervention. I find this reality appalling, as do countless citizens around the world who have expressed their horror through protests on the streets of cities across the globe.

The upcoming case is a litmus test for humanity's commitment to the solemn pledge of 'Never Again.' Generations have been educated about the horrors of the Holocaust, and this case challenges us to live up to the principles we profess. It is a stark reminder that the values we hold dear are being tested in real-time, with devastating consequences.

In March 2022, the International Court of Justice ordered Russia to immediately suspend military operations in Ukraine and ensure that affiliated units take no further steps in furtherance of the military operations. Despite this intervention, an estimated 10,000 civilians have tragically lost their lives in Ukraine since Russia's military operation in 2022. Moreover, and by comparison, the death toll in Gaza has already surpassed 22,000 since October 2023, with a staggering 70% of the victims being women and children.

In an age where mainstream media faces scepticism due to perceived biases, the global community has been witness to Israel's actions in real-time through various social media platforms such as X, TikTok, and Telegram. Enclosed with this letter, you'll find compelling evidence pointing towards Israel's culpability in intending to commit genocide and engaging in genocidal military actions, among other alleged war crimes.

We find ourselves in a world where trust in global institutions is eroding rapidly. The International Court of Justice, in particular, cannot afford to make an erroneous judgment in the #SouthAfrica v. #Israel genocide case. A misjudgement in this matter would not only underscore the ICJ's ineffectiveness but also prompt scrutiny regarding its autonomy from nation-state political influences, potentially compromising the esteemed moral character of the individuals involved.

In 1945 we celebrated Winston Churchill as the leader that brought the world together in war to put-down the threat of Nazi Germany and the horror it inflicted. That war claimed over 50 million lives. We do not wish to celebrate a wartime hero again; we wish to celebrate new heroes who averted a war by presiding over justice without fear or favour.

MASS MURDER OF PALESTINIAN CIVILIANS CONTINUES ON THE 195TH DAY OF "ISRAEL'S" ONGOING GENOCIDE

On the 195th day of "Israel's" special genocide operation in the Gaza Strip, the Israeli occupation forces (IOF) committed a total of 7 new massacres of Palestinian families, resulting in the deaths of no less than 71 civilians, mostly women and children, while another 106 others were wounded over the previous 24-hours.

In a small bit of positive news amongst the horrors of Gaza, Algeria has announced it would be donating $15 million to the United Nations Relief and Works Agency for Palestine (UNRWA).

The announcement was made by Algeria's Foreign Minister, Ahmed Attaf, who stated that Algeria was making an "exceptional financial contribution" to the UNRWA, worth over $15 million.

“Algeria, by decision of the President of the Republic, Abdelmadjid Tebboune, announces the provision of an exceptional financial contribution of $15 million to UNRWA," adding that Algeria considers the initiative “a true duty and a firm responsibility that falls on us and on other members of the international community.”

Meanwhile, the criminal Israeli occupation war of genocide continued, and even intensified, with several new deadly airstrikes pummeling the Palestinian people over the previous day, committing several new massacres and slaughtering civilian families, including large numbers of women and children.

In just one example, Zionist air forces bombed a tract of land and a residential building housing displaced civilian families late on Wednesday evening in the city of Rafah, in the southern Gaza Strip, resulting in the murder of 7 civilians, including three children and a woman, which was later revised upwards.

Further reports of the Rafah strike stated that the number of civilians killed rose to 11 overnight following the work of civil defense crews, who managed to recover three additional corpses of Palestinian victims.

Additionally, the tract of agricultural land that was bombed by Zionist forces in the Al-Salam neighborhood of Rafah city, held a room that was occupied by the Ayyed family who were displaced from Gaza City, resulting in the martyredom of 8 family members, including 5 children and 2 women.

The Israeli occupation has been purposefully targeting displaced civilian families in Rafah, who were forced into the southern Gazan city following the start of the war.

In a previous example, another massacre occured on Tuesday when IOF fighter jets bombed the al-Hanoud family home, in which displaced families were sheltering, also in Rafah, resulting in the deaths of 7 Palestinians, including 4 children.

"Israel's" criminal behavior continued into Thursday morning with the wounding of three Palestinian civilians who were injured following an Israeli occupation airstrike which targeted residential homes in the town of Al-Mughraqa, in the central Gaza Strip.

What little remains of Gaza City was also a focus of the Israeli occupation army, with Zionist warplanes and artillery concentrated on shelling the Sheikh Ajlin and Al-Zaytoun neighborhoods, resulting in a number of casualties.

Occupation aircraft further bombarded residential homes and buildings in the Tal al-Hawa neighborhood and the Beach Camp area of Gaza City as well.

Following the withdrawal of Zionist forces from the Nuseirat Camp area of central Gaza, local civil defense crews worked to recover the bodies of those killed, however, crews say many still remain buried under the rubble and have yet to be uncovered.

Civil Defense personnel also said they'd recovered the bodies of at least 11 Palestinians from under the debris of the Khan Yunis governate, in the south of Gaza.

The Zionist crimes continued when Israeli warplanes bombed a residential building belonging to the Shaat family in the Yabna Camp area of the city of Rafah, in the southern Gaza Strip, resulting in several casualties.

As a result of "Israel's" ongoing special genocide operation in the Gaza Strip, the death toll among the Palestinian civilian population has now risen to exceed 33'970 Palestinians killed, including over 14'560 children and 9'582 women, while an additional 76'770 others have been wounded since the start of the current round of Zionist aggression, beginning with the events of October 7th, 2023.

"The United Nations’ top court on Monday heard a final day of arguments on the legality of Israel’s decades-long occupation of Palestinian territories, proceedings that have added pressure to Israel at a time when attention focuses on the war in Gaza. The hearings, which began last Monday, were the first time that the court, the International Court of Justice, had been asked to detail the legal consequences of Israel’s “prolonged occupation, settlement and annexation” of the territories, including the West Bank and East Jerusalem, since 1967 — issues that have been the subject of years of debate and resolutions at the United Nations. The U.N. General Assembly asked the court to give an advisory opinion. Judge Nawab Salam, the president of the court, ended the hearings saying that the judges’ conclusions would be announced at a public hearing. The conclusions were expected to take at least six months, lawyers at the court said." The sessions, held at the Peace Palace in The Hague, heard from representatives of more than 50 countries, an unusually high number for the court. Most sided with the Palestinian representatives, who argued that Israel had long abused Palestinian rights with impunity and denied their right to self-determination.

“Israel has arrogated to itself the right to decide who owns land, who may live on it, how it is used,” Philippe Sands, a member of the Palestinian delegation’s legal team, argued last week. “It has confined Palestinians to enclaves,” he added, and broken up its territory with hundreds of settlements “regarded as a permanent part of Israel.” Israel did not appear at the hearings, but, in a written submission, it rejected the questions raised by the proceedings as biased.

The proceedings have been given urgency by Israel’s war against Hamas in the Gaza Strip. Health authorities in Gaza say that Israel’s military campaign has killed more than 29,000 people, the majority civilians, and provoked what the United Nations says is a humanitarian disaster. Since the war began, Israeli forces have also detained hundreds of Palestinians in West Bank raids. Deadly violence against Palestinians by Israeli settlers has increased and Palestinian attacks on Israelis have also risen.

A few speakers at the court, including those from the United States, Britain and Hungary, have sided with Israel. On Wednesday, a State Department official argued before the court that Israel’s policies toward the Palestinians were determined by its “very real security needs.” But Israel’s campaign in Gaza has presented a dilemma to President Biden’s administration, which has continued to supply Israel with military aid while expressing growing concern over the treatment of Palestinians. Mr. Biden has said that Prime Minister Benjamin Netanyahu’s government has been “over the top” in its conduct of the war in Gaza. And on Friday, Secretary of State Antony J. Blinken said that the American government was reversing a Trump administration policy and would now consider new Israeli settlements in Palestinian territories to be “inconsistent with international law.”
