New York Gov. Kathy Hochul wants to ban the use of real estate management software that sets rent prices via algorithm—what federal prosecutors say can amount to collusion that artificially inflates rents during a nation-wide housing crisis. Hochul is expected to announce the proposal in her State of the State speech Tuesday, a week after the U.S. Justice Department sued six of the country’s biggest landlords for allegedly using “anticompetitive pricing algorithms” to set rents. “I’ve said it before and I’ll say it again: the rent is too damn high and New Yorkers need our help,” Gov. Hochul said in a statement shared with City Limits ahead of her annual address.
“Last year, we passed the most significant housing legislation in generations, working to build more supply and increase tenant protections,” Hochul continued. “There’s more work to do, which is why I’m proposing new legislation to crack down on algorithmic abuses that increase the cost of living and force rents sky-high. We need to ban the sale or use of price-fixing software—so tenants have a fair shot at an affordable home.”
Should her proposal pass, New York would join jurisdictions like San Francisco and Philadelphia in prohibiting such software, which often uses competitor data to set suggested rents. A report by the White House’s Council of Economic Advisers in December that sought to “quantify the anticompetitive impact of algorithmic pricing on rents across the country” estimated the practice cost renters $3.8 billion in 2023, what its authors warned “is likely a lower bound on the true costs.”
“Algorithmic pricing weakens competition because it can facilitate price coordination among landlords who would otherwise be competing,” the White House report reads. “Our analysis indicates that if price coordination was eliminated, there would be an economically meaningful decrease in price mark-ups for rental units using pricing algorithms.”
Among the most popular of these technologies comes from the company RealPage, which is the target of an antitrust lawsuit filed by the Justice Department, following reporting on its practices by the investigative news outlet ProPublica. RealPage has characterized the criticism against it as “demonstrably false,” saying its customers have “100 [percent] discretion to accept or reject software price recommendations.”
But in its legal complaint against the company and six major landlords who used the software, the DOJ alleges that, “RealPage replaces competition with coordination.”
“It substitutes unity for rivalry. It subverts competition and the competitive process,” the complaint reads. “It does so openly and directly—and American renters are left paying the price.”
Nationwide, nearly half of the 42.5 million renter households in the U.S. are considered rent-burdened, meaning they spend at least a third of their income on housing, according to the U.S. Census Bureau.
In New York, that rate is even higher, with more than 52 percent of renters meeting that threshold, according to an analysis by the state comptroller last year.
Gov. Hochul is set to deliver her State of the State beginning at 1 p.m. Tuesday. The speech will be livestreamed on the governor’s website here.

CA Internet Bills Status as of 7/17/2024
I had wanted to wait to make this post until all of the bills updated texts had been uploaded to the usual sites, but it appears what whoever's supposed to be updating AB 3080 has been lagging, so I'll just go with what I have for now. It'll be long as I'll be looking at their statuses and analyzing their updated texts so I'll put it under a cut for now.
A reminder that California's legislature is currently on recess and will be until August 5th. So no immediately imminent bills at this exact moments. But please read below the cut to get more information on the deadlines coming up.
When I last posted, all three of the bills had gone into review in their respective committees and sadly all of them passed out.
AB 3080: 11 Aye - 0 Nay
AB 1949: 11 Aye - 0 Nay
SB 976: 7 Aye - 4 No Vote
All three bills have been amended during their time in committees.
Ab 3080
AB 3080 was amended and passed from committee as amended, it is now available for a floor vote. This is the only one of the three bills where its amended text hasn't been posted anywhere I can find. However, in the analysis of the July 3rd meeting, there were acknowledgements made that not only is there no effective and safe way to verify age to view online content, but also that the existence of VPNs can circumvent any attempts to region lock sites designated as "adult" (the definition as it stands still appears to be limited to commercial websites where more than 1/3 of their content annually is sexually explicit). And that the methods to implement such a thing on commercial and non-commercial websites alike can be prohibitively expensive. So the author of the bill agreed to amendments in the bill as such according to the analysis:
"In response to the concerns of opposition, the author has agreed to amendments that allow a less restrictive means to suffice in meeting the obligation of the bill, mitigating the impact on protected speech and expression. The amendments provide that “reasonable steps” includes the business implementing a system that includes metadata or response headers identifying the product as sexually explicit to parental control software, embedded hardware applications, and other similar services designed to block, filter, monitor or otherwise prevent a minor’s access to inappropriate online content, or that blocks users designated as minors by the operating system of the device used to access the website. It also limits enforcement of this new cause of action to the Attorney General and requires the Attorney General to promulgate regulations to provide better direction for reasonable steps to verify age in addition to those listed."
So it appears that the bill may allow more websites instead to mark themselves or certain portions of their content as adult in order to be properly vetted by in-device content filters and parental controls that can be set by the device operators (or their parents in the case of minors), rather than a method that would require users to provide identification.
It's eased up quite a bit since its initial incarnation. But it's still better safe than sorry with this kind of bill, so Californians let's still push the state senators to veto this bill completely.

AB 1949
AB 1949 was amended and passed from committee as amended, and is currently referred to the Senate Appropriations Committee.
This one has also seen some fairly positive changes during this committee analysis as can be seen in the latest version of the bill. The latest version has removed any indications towards age verification. As well as it having changed several of its details. The bill only comes into effect and prevents the sale of data if the website has actual knowledge of the users' age, and that there shall be an option for the user to transmit a signal that they are under 18 for this purpose. Which again should help the argument against strict age verification barriers due to advertising purposes.
"a business shall not use or disclose the personal information of a consumer if the business has actual knowledge that the consumer is less than 18 years of age, unless the consumer, in the case of a consumer at least 13 years of age and less than 18 years of age, or the consumer’s parent or guardian, in the case of a consumer less than 13 years of age, has affirmatively authorized the use or disclosure of the consumer’s personal information."
"A business shall treat a consumer as under 18 years of age if the consumer, through a platform, technology, or mechanism, transmits a signal indicating that the consumer is less than 18 years of age."
But, once again, it is best to still work against this bill and prevent its passing at all in case it there's push to use it as a stepping stone for any bills which may further push an age verification agenda.

SB 976
This bill passed with amendments and is currently referred to the California Assembly Appropriations Committee. Unfortunately no major changes have been made. Only an amendment clarifying that any parental controls are only meant to limit access to "addictive feeds" and limit access to school hours, not any of the content. As this function still requires a "verified adult parent to a minor", this still holds open the door to potential future age verification dangers. As it still states that an application may choose to withhold services to minors altogether, and explicitly leaves open the possibility to allow provisions for age "assurance". So we definitely want to strike this one down if we can.

As of this moment, the California Legislature is out on recess until August 5.
The Senate Appropriations Committee (AB 1949) is set to meet on August 5, no word on whether it will be heard that day or on the next set hearing, August 12. So if you wish to send a position letter to the committee it would be best to do so a week before that date, so by July 29. Just to be safe.
No word on when the Assembly Appropriations Committee is set to meet, but the deadline for fiscal committees to pass bills through is August 16, so I expect that SB 976 will be heard before that day at least.
And AB 3080 is set to go to the senate floor rather than be seen by another committee before being read. No word on when the next bill readings will be on the assembly floor after it's reconvened August 5th, but I'll keep an ear to the ground for that.
The last day for each house to pass their bills for the year will be August 31st. So any bills we can stop before then are halted for good for the year.
And for any bills that do slip through, the last day for the governor to sign, let pass without signing, or veto bills is September 30th. So even if the bills pass from the floor to his desk, there's still time to send him messages to urge him to oppose any that slip through.

UNC5537: Extortion and Data Theft of Snowflake Customers

Targeting Snowflake Customer Instances for Extortion and Data Theft, UNC5537 Overview. Mandiant has discovered a threat campaign that targets Snowflake client database instances with the goal of extortion and data theft. This campaign has been discovered through Google incident response engagements and threat intelligence collections. The multi-Cloud data warehousing software Snowflake can store and analyze massive amounts of structured and unstructured data.
Mandiant is tracking UNC5537, a financially motivated threat actor that stole several Snowflake customer details. UNC5537 is using stolen customer credentials to methodically compromise Snowflake client instances, post victim data for sale on cybercrime forums, and attempt to blackmail many of the victims.
Snowflake instance According to Mandiant’s analysis, there is no proof that a breach in Snowflake’s enterprise environment led to unauthorized access to consumer accounts. Rather, Mandiant was able to link all of the campaign-related incidents to hacked client credentials.
Threat intelligence about database records that were later found to have come from a victim’s Snowflake instance was obtained by Mandiant in April 2024. After informing the victim, Mandiant was hired by the victim to look into a possible data theft affecting their Snowflake instance. Mandiant discovered during this investigation that a threat actor had gained access to the company’s Snowflake instance by using credentials that had previously been obtained through info stealer malware.
Using these credentials that were taken, the threat actor gained access to the customer’s Snowflake instance and eventually stole important information. The account did not have multi-factor authentication (MFA) activated at the time of the intrusion.
Following further intelligence that revealed a wider campaign aimed at more Snowflake customer instances, Mandiant notified Snowflake and potential victims via their Victim Notification Programme on May 22, 2024.
Snowflakes Mandiant and Snowflake have notified about 165 possibly vulnerable organizations thus far. To guarantee the security of their accounts and data, these customers have been in direct contact with Snowflake’s Customer Support. Together with collaborating with pertinent law enforcement organizations, Mandiant and Snowflake have been undertaking a cooperative investigation into this continuing threat campaign. Snowflake released comprehensive detection and hardening guidelines for Snowflake clients on May 30, 2024.
Campaign Synopsis According to Google Cloud current investigations, UNC5537 used stolen customer credentials to gain access to Snowflake client instances for several different organizations. The main source of these credentials was many info stealer malware campaigns that compromised systems controlled by people other than Snowflake.
As a result, a sizable amount of customer data was exported from the corresponding Snowflake customer instances, giving the threat actor access to the impacted customer accounts. Subsequently, the threat actor started personally extorting several of the victims and is aggressively trying to sell the stolen consumer data on forums frequented by cybercriminals.
Mandiant Mandiant discovered that most of the login credentials utilized by UNC5537 came from infostealer infections that occurred in the past, some of which were from 2020. Three main causes have contributed to the multiple successful compromises that UNC5537’s threat campaign has produced:
Since multi-factor authentication was not enabled on the affected accounts, successful authentication just needed a working login and password. The credentials found in the output of the infostealer virus were not cycled or updated, and in certain cases, they remained valid years after they were stolen. There were no network allow lists set up on the affected Snowflake client instances to restrict access to reliable sources. Infostealer Mandiant found that the first infostealer malware penetration happened on contractor computers that were also used for personal purposes, such as downloading pirated software and playing games. This observation was made during multiple investigations related to Snowflake.
Customers that hire contractors to help them with Snowflake may use unmonitored laptops or personal computers, which worsen this initial entry vector. These devices pose a serious concern because they are frequently used to access the systems of several different organizations. A single contractor’s laptop can enable threat actors to access numerous organizations if it is infected with infostealer malware, frequently with administrator- and IT-level access.
Identifying The native web-based user interface (SnowFlake UI, also known as SnowSight) and/or command-line interface (CLI) tool (SnowSQL) on Windows Server 2022 were frequently used to get initial access to Snowflake customer instances. Using an attacker-named utility called “rapeflake,” which Mandiant records as FROSTBITE, Mandiant discovered more access.
Mandiant believes FROSTBITE is used to conduct reconnaissance against target Snowflake instances, despite the fact that Mandiant has not yet retrieved a complete sample of FROSTBITE. Mandiant saw the use of FROSTBITE in both Java and.NET versions. The Snowflake.NET driver communicates with the.NET version. The Snowflake JDBC driver is interfaced with by the Java version.
SQL recon actions by FROSTBITE have been discovered, including a listing of users, current roles, IP addresses, session IDs, and names of organizations. Mandiant also saw UNC5537 connect to many Snowflake instances and conduct queries using DBeaver Ultimate, a publicly accessible database management tool.
Finish the mission Mandiant saw UNC5537 staging and exfiltrating data by continuously running identical SQL statements on many client Snowflake systems. The following instructions for data staging and exfiltration were noted.
Generate (TEMP|TEMPORARY) STAGE UNC5537 used the CREATE STAGE command to generate temporary stages for data staging. The data files that are loaded and unloaded into database tables are stored in tables called stages. When a stage is created and designated as temporary, it is removed after the conclusion of the creator’s active Snowflake session.
UNC5537 Credit Since May 2024, Mandiant has been monitoring UNC5537, a threat actor with financial motivations, as a separate cluster. UNC5537 often extorts people for financial benefit, having targeted hundreds of organizations globally. Under numerous aliases, UNC5537 participates in cybercrime forums and Telegram channels. Mandiant has recognized individuals who are linked to other monitored groups. Mandiant interacts with one member in Turkey and rates the composition of UNC5537 as having a moderate degree of confidence among its members who are located in North America.
In order to gain access to victim Snowflake instances, Attacker Infrastructure UNC5537 mostly leveraged Mullvad or Private Internet Access (PIA) VPN IP addresses. Mandiant saw that VPS servers from Moldovan supplier ALEXHOST SRL (AS200019) were used for data exfiltration. It was discovered that UNC5537 was storing stolen victim data on other foreign VPS providers in addition to the cloud storage provider MEGA.
Prospects and Significance The campaign launched by UNC5537 against Snowflake client instances is not the product of a highly advanced or unique method, instrument, or process. The extensive reach of this campaign is a result of both the expanding infostealer market and the passing up of chances to further secure credentials:
UNC5537 most likely obtained credentials for Snowflake victim instances by gaining access to several infostealer log sources. There’s also a thriving black market for infostealerry, with huge lists of credentials that have been stolen available for purchase and distribution both inside and outside the dark web.
Infostealers Multi-factor authentication was not necessary for the impacted customer instances, and in many cases, the credentials had not been changed in up to four years. Additionally, access to trusted locations was not restricted using network allow lists.
This ad draws attention to the ramifications of a large number of credentials floating throughout the infostealer market and can be a sign of a targeted attack by threat actors on related SaaS services. Mandiant predicts that UNC5337 will carry on with similar intrusion pattern, soon focusing on more SaaS systems.
