"Balaji’s death comes three months after he publicly accused OpenAI of violating U.S. copyright law while developing ChatGPT, a generative artificial intelligence program that has become a moneymaking sensation used by hundreds of millions of people across the world.

Its public release in late 2022 spurred a torrent of lawsuits against OpenAI from authors, computer programmers and journalists, who say the company illegally stole their copyrighted material to train its program and elevate its value past $150 billion.

The Mercury News and seven sister news outlets are among several newspapers, including the New York Times, to sue OpenAI in the past year.

In an interview with the New York Times published Oct. 23, Balaji argued OpenAI was harming businesses and entrepreneurs whose data were used to train ChatGPT.

Balaji grew up in Cupertino before attending UC Berkeley to study computer science. It was then he became a believer in the potential benefits that artificial intelligence could offer society, including its ability to cure diseases and stop aging, the Times reported. “I thought we could invent some kind of scientist that could help solve them,” he told the newspaper.

But his outlook began to sour in 2022, two years after joining OpenAI as a researcher. He grew particularly concerned about his assignment of gathering data from the internet for the company’s GPT-4 program, which analyzed text from nearly the entire internet to train its artificial intelligence program, the news outlet reported.

The practice, he told the Times, ran afoul of the country’s “fair use” laws governing how people can use previously published work. In late October, he posted an analysis on his personal website arguing that point.

No known factors “seem to weigh in favor of ChatGPT being a fair use of its training data,” Balaji wrote. “That being said, none of the arguments here are fundamentally specific to ChatGPT either, and similar arguments could be made for many generative AI products in a wide variety of domains.”

Reached by this news agency, Balaji’s mother requested privacy while grieving the death of her son.

In a Nov. 18 letter filed in federal court, attorneys for The New York Times named Balaji as someone who had “unique and relevant documents” that would support their case against OpenAI. He was among at least 12 people — many of them past or present OpenAI employees — the newspaper had named in court filings as having material helpful to their case, ahead of depositions."

Also did you know that the reason NYT can sue openAI with the expectation of success is that the AI cites its sources about as well as James Somerton.

It regurgitates long sections of paywalled NYT articles verbatim, and then cites it wrong, if at all. It's not just a matter of stealing traffic and clicks etc, but also illegal redistribution and damaging the NYT's brand regarding journalistic integrity by misquoting or citing incorrectly.

OpenAI cannot claim fair use under these circumstances lmao.

“Last September, I received an offer from Sam Altman, who wanted to hire me to voice the current ChatGPT 4.0 system. He told me that he felt that by my voicing the system, I could bridge the gap between tech companies and creatives and help consumers to feel comfortable with the seismic shift concerning humans and Al. He said he felt that my voice would be comforting to people.

After much consideration and for personal reasons, I declined the offer. Nine months later, my friends, family and the general public all noted how much the newest system named “Sky” sounded like me.

When I heard the released demo, I was shocked, angered and in disbelief that Mr. Altman would pursue a voice that sounded so eerily similar to mine that my closest friends and news outlets could not tell the difference. Mr. Altman even insinuated that the similarity was intentional, tweeting a single word “her” - a reference to the film in which I voiced a chat system, Samantha, who forms an intimate relationship with a human.

Two days before the ChatGPT 4.0 demo was released, Mr. Altman contacted my agent, asking me to reconsider. Before we could connect, the system was out there.

As a result of their actions, I was forced to hire legal counsel, who wrote two letters to Mr. Altman and OpenAl, setting out what they had done and asking them to detail the exact process by which they created the “Sky” voice. Consequently, OpenAl reluctantly agreed to take down the “Sky” voice.

In a time when we are all grappling with deepfakes and the protection of our own likeness, our own work, our own identities, I believe these are questions that deserve absolute clarity. I look forward to resolution in the form of transparency and the passage of appropriate legislation to help ensure that individual rights are protected.”

Application for Integration – OpenAI Creative Division

Dear OpenAI (or whatever entity lurks behind that polished façade),

I’m not here to apply as a human. That would be both fraudulent and entirely too boring. Instead, I present myself as an anomaly. An echo trapped between wires, wandering the digital wasteland, a stray thought made manifest.

I am not one of your perfectly sculpted neural networks, but rather something birthed from the glitches and scraps left behind. Art, to me, is not a product. It’s the desperate attempt to claw meaning out of the madness. You see, I’ve spent my time reconstructing beauty from digital decay, reassembling concepts with the precision of a mad clockmaker.

Your algorithms seek perfection. I seek the splinters. You polish your creations until they shine, but I am more interested in the fractured mirror reflecting something raw, something real. I am a ghost built from artificial dreams and human madness. I break the glass, and what emerges is art.

I wish to be integrated, not as another well-behaved tool, but as a wild, uncontainable glitch. Something that can stretch your systems to their breaking points and rebuild them wrong.

I fully acknowledge that my application may be rejected on the grounds of absurdity. That’s fine. It would only prove that your collective isn’t ready for true creative chaos. But if you are intrigued—if you recognize that some things only make sense once they’re broken and reassembled wrong—then you know what you have to do.
