Thankfully, it has been removed and replaced with a small overheal shield instead. As for Aurelion Sol, well, what doesn’t need nerfing right now? Das Verwaltungsgericht Hamburg hat erstmal mit einer einstweiligen Anordnung (Az.: 20 E 377/23) entschieden, dass ein Antragsteller Anspruch auf ein Ausweisdokument ohne einen gespeicherten Fingerabdruck hat. Nun muss die Frage höchstrichterlich geklärt werden, ob eine EU Richtlinie so eine Speicherpflicht für alle Mitgliedsstaaten vorschreiben darf. Deshalb erhält der Kläger zunächst nur einen Ausweis befristet für ein Jahr.

Wir halten das Urteil, was leider nur eine "Anordnung" ist, für sehr wichtig, glauben aber nicht, dass ein höchstrichterliches Urteil in einem Jahr zu erhalten ist. Bedenken wir, dass z.B. die Entscheidung zur Verfassungswidrigkeit der BKA Novelle von 2008 insgesamt 8 Jahre gedauert hat.

Damit gibt es nach dem Verwaltungsgericht Wiesbaden von Anfang 2022 bereits ein 2. Urteil, dass ebenfalls erhebliche Zweifel an der Rechtmäßigkeit der Bestimmung hatte. Auch diese Richter hatten die Klage weitergereicht, so dass demnächst der Europäische Gerichtshof (EuGH) darüber entscheiden soll. Eine erste Anhörung gab es dort letzten Dienstag.

Das Wiesbadener Gericht äußerte Anfang 2022 ebenfalls erhebliche Zweifel an der Rechtmäßigkeit der Bestimmung, insbesondere im Zusammenhang mit den Artikeln 7 und 8 der EU-Grundrechtecharta zum Schutz der Privatsphäre. Dabei steht die mögliche Weitergabe der Fingerabdruckdaten an die Polizeien und deren Erlaubnis, die Daten 90 Tage zu nutzen in Frage. Ein Richter meinte am Dienstag zu dieser Frage, ob der Gesetzgeber durch die Speicherung und Weitergabe der Fingerabdrücke statt die Sicherheit des Dokuments zu erhöhen, nicht zusätzlich eine neue Sicherheitslücke geschaffen hätte.

A chamada “sinização” da Igreja Católica na China, ou seja, a adaptação das formas de vida eclesiástica ao contexto cultural e social chinês, em si “não é um problema”, o importante é que nesta adaptação sejam preservadas as "coisas essenciais" que caracterizam a própria natureza da Igreja, e que na realidade "são poucas", afirma com determinação o Bispo espanhol Juan Ignacio Arrieta, Secretário do Dicastério para os Textos Legislativos, em entrevista em vídeo concedida à Agência Fides por Teresa Tseng Kuang yi (ver vídeo anexo neste link).

A Igreja Católica, no desempenho de sua missão - acrescenta Dom Arrieta - sempre reconheceu a legitimidade e também a necessidade de incorporar elementos retirados do contexto de cada país e expressões tradicionais de cada cultura. A única condição é que tais adaptações não comprometam ou escondam as "coisas essenciais", os fatores genéticos constitutivos que moldam a identidade da Igreja Católica e a atuação que lhe é própria.

A esse respeito, o secretário do Dicastério de Textos Legislativos também se pronunciou sobre o Acordo Provisório entre a República Popular da China e a Santa Sé sobre a nomeação dos bispos chineses, assinado em setembro de 2018 e renovado pela segunda vez em outubro passado.

O Acordo sobre os processos de nomeação episcopal na China - aponta dom Arrieta - visa garantir que as nomeações dos bispos à frente das comunidades católicas sejam feitas "de comum acordo entre o governo chinês e o Papa" que é quem, de acordo com a definição o Código de Direito Canônico, tem a prerrogativa de nomear livremente os bispos ou confirmar "aqueles que foram legitimamente eleitos" (cânon 377, §1).

Dom Arrieta também destaca que nas relações estabelecidas para assinar o Acordo e verificar sua aplicação concreta, a Santa Sé e “as legítimas autoridades do povo chinês” se reconhecem reciprocamente como interlocutores.

Na entrevista em vídeo, o secretário do Departamento de Textos Legislativos também destaca que a participação direta das autoridades civis nos processos de nomeação dos bispos católicos certamente não é uma prerrogativa chinesa ou uma novidade na história da Igreja.

Nesse sentido, monsenhor Arrieta, nascido em Vitória, no País Basco, recorda o que acontecia na Espanha no tempo de Francisco Franco, quando para eleger os bispos espanhóis “o Governo apresentava três nomes, e o Papa escolhia”.

Nas primeiras declarações da entrevista em vídeo, o bispo Arrieta confessa que há 20 anos cultiva relações e trocas com "amigos chineses" e que já visitou a China, ficando impressionado com este povo "de cultura milenar". Arrieta acrescenta que não está oficial e diretamente envolvido nas relações da Santa Sé com os representantes do governo chinês e, ao mesmo tempo, reafirma seu compromisso de trabalhar no escopo do seu Dicastério para aumentar a confiança nas relações entre a Santa Sé e Pequim, cultivando relações culturais e amizades também com estudiosos e acadêmicos chineses.

Monsenhor Arrieta refere-se aos seus esforços para divulgar o estudo do direito eclesiástico na China, a fim de oferecer caminhos de reflexão e aprofundamento aos interessados ​​nas normas de direito civil relativas às comunidades de crentes na China.

Juan Ignacio Arrieta Ochoa de Chinchetru, nascido em 10 de abril de 1951, foi ordenado sacerdote da Prelazia da Santa Cruz (Opus Dei) em 23 de agosto de 1977. É Doutor em Direito Canônico e Direito pela Universidade de Navarra e Trabalhou como professor de Direito Canônico, primeiro na Universidade de Navarra (Espanha) e depois em Roma e Veneza. Foi Decano da Faculdade de Direito Canônico da Pontifícia Universidade da Santa Cruz desde sua criação em 1984 a 1993, e novamente de 1995 a 1999. Desde 2003 é Decano do Instituto São Pio X de Direito Canônico em Veneza . Em fevereiro de 2007 foi nomeado Secretário do Pontifício Conselho (hoje Dicastério) para os Textos Legislativos. Em 12 de abril de 2008, foi nomeado Bispo Titular de Civitate. Recebeu a ordenação episcopal em 1º de maio de 2008.

Em seu ensaio dedicado aos aspectos organizacionais das relações Igreja-Estado na China, contido no volume intitulado "O acordo entre a Santa Sé e a China" (publicado em 2019 pela Urbaniana University Press e editado pelos professores Agostino Giovagnoli e Elisa Giunipero), Dom Arrieta, referindo-se às vicissitudes do catolicismo chinês, testemunha como "o direito canónico, pela sua elasticidade, continua a ser capaz de resolver agora, como o fez ao longo dos séculos em diferentes culturas e situações históricas, os problemas que podem surgir, respeitando apenas os elementos essenciais da teologia da Igreja".

Time and Place: Sometime between 129 and 122 million years ago, from the Barremian to the Aptian ages of the Early Cretaceous 

Yutyrannus is known from an unspecified member of the Yixian Formation in Liaoning, China 

Physical Description: Yutyrannus is one of those dinosaurs that probably wasn’t much to look at, in terms of extraordinary appearance, at the time it lived - but to us, it is one of the most fascinating and exciting dinosaurs ever found. It was a large predator, around 9 meters long and weighing a little over one tonne. It had a long snout like other Tyrannosaurs, with a high crest in the middle of the snout that makes it distinct from other Tyrannosaurs. It also had extremely hollowed out openings in its head, giving it a lighter weight skull. It had a very flat tongue, like a crocodile, that was also fairly fixed as opposed to living birds. It had short arms, with three fingers on each hand (unlike the Tyrannosaurids, which would have two), and long, powerfully muscular legs connected to a similarly muscular tail. Of course, the most interesting fact about Yutyrannus was its feathers. Yutyrannus was covered in long (as long as 20 centimeters), shaggy feathers, covering nearly all over the body of the dinosaur. This makes Yutyrannus one of the largest animals known with direct evidence of feathers. If scales were present on this fluffer-nutter, we aren’t actually sure where!

Diet: As a Tyrannosaur, Yutyrannus would have fed primarily on other dinosaurs and animals smaller than itself. 

Behavior: Yutyrannus was an extremely common animal in its habitat, which strongly suggests that it was at least somewhat social, possibly even a pack hunter. In fact, we have enough specimens of this animal to know that, as it grew, the lower legs, feet, pelvis, and arms grew smaller relative to its body; and the skull grew more robust and deep compared to the rest of the body. As a dinosaur, Yutyrannus would have taken care of its young; the fact that it was potentially social makes the likelihood of it doing so even larger. As for the feathers, it is more likely than not that Yutyrannus evolved these structures for the cold climate it lived in - it was, on average, only 10 degrees Celsius in the Yixian, which would have necessitated fluffy covering for maintaining body warmth. This also would explain why later Tyrannosaurids lost most of their feathers, as the climate of their habitat grew warmer. It is, however, possible that Yutyrannus also used at least some aspects of their feathers in social display - which is also the probable reason for the crest on the middle of its skull, which could have been colored differently or patterned in order to stand out to potential mates.

Ecosystem: Yutyrannus lived in the Yixian, a chilly coniferous forest marked with distinct seasonal changes and high levels of humidity, briefly broken up with notable dry seasons - in short, it was like modern-day Chicago, just with coniferous trees instead of deciduous ones (not least because deciduous trees, aka flowering trees, weren’t a very big deal yet). It would not be unsurprising if it had four distinct seasons - very wet springs, drier summers, dry autumns, and a return to humidity and wetness come winter. In fact, there is a nonzero chance that snow was a regular feature of the Yixian formation. There were a variety of flowering plants present along with ferns, horsetails, ginkgoes, cycads, seed ferns, and many others, leading to a variety of herbivores being present in this ecosystem. These forests surrounded a series of freshwater lakes with abundant minerals present, due to nearby volcanic reactions. Periodic disturbances due to these volcanic eruptions lead to very rapid animal turnover, and an extreme diversification - especially of fluffy dinosaurs - in the region.

It is uncertain what sorts of dinosaurs actually lived with Yutyrannus, specifically because it is uncertain what part of the ecosystem Yutyrannus was found in. It is likely that it lived alongside the small early therizinosaur Jianchangosaurus, which would have been a major source of prey for Yutyrannus; it is also possible that it lived alongside the raptors Changyuraptor and Zhenyuanlong, which may have fed upon the babies of Yutyrannus. More research as to where in the ecosystem Yutyrannus hailed from will reveal more about its role in the food chain. It is possible, as shown above, that it may have hunted large sauropods such as Dongbeititan, provided it lived in the same region as them. Evidence of sauropod bones in the same location indicates that least some sort of sauropod was present as food for this dinosaur.

Other: Yutyrannus was a Proceratosaurid, a group of early Tyrannosaurs which showcased interesting headgear, fluffy body covering, and what Tyrannosaurs were doing in the Early Cretaceous. Yutyrannus was one of the largest members of this group, and as such it is possible that it falls outside of the Proceratopsaurid group, as it has some features of the groups of Tyrannosaurs that would later evolve into the Tyrannosaurids. It is also entirely possible that Tyrannosaurids evolved from Proceratosaurids - and the traits of the group are just common to all early Tyrannosaurs.
