Hmmmm. Contemplating today whether how much of my ‘don’t care, Jason’ attitude towards Under the Red Hood and Jason’s whole schtick is due to my general boredom with conflicted antihero mass murderers, and how much of it has to do with having a LOT of very specific cultural and educational training that: the death penalty is wrong; death is never an appropriate punishment for crime; even the worst people deserve proper representation; the common law criminal justice system is very specifically not for victims and indeed there are quite good reasons why; demanding acknowledgement of your pain from a system designed to note it and move on is not going to go well for you or for the system; Victim Impact work is important but also the resolved tension point is currently sitting at ‘acknowledgement’; etc.
Guess it’s another day when I recite to myself “the Event is the worst thing that’s happened in that person’s life. It’s also just Wednesday at the office to you. Keep that in mind”.

Like I'll be real and add a disclaimer: it might seem like I'm spiritually obsessed if someone were to stumble across my social media, ie. This blog, but that's just because of how I organize my social media. I keep separate socials for separate themes with only some overlap. If you met me in person without knowing me ahead of time, you likely wouldn't know that I'm religious or that I study theology, several religions, and angelology unless the topics came up in conversation. I don't advertise it except for in appropriate spaces.

the most frustrating thing about AI Art from a Discourse perspective is that the actual violation involved is pretty nebulous
like, the guys "laundering" specific artists' styles through AI models to mimic them for profit know exactly what they're doing, and it's extremely gross
but we cannot establish "my work was scraped from the public internet and used as part of a dataset for teaching a program what a painting of a tree looks like, without anyone asking or paying me" as, legally, Theft with a capital T. not only is this DMCA Logic which would be a nightmare for 99% of artists if enforced to its conclusion, it's not the right word for what's happening
the actual Violation here is that previously, "I can post my artwork to share with others for free, with minimal risk" was a safe assumption, which created a pretty generous culture of sharing artwork online. most (noteworthy) potential abuses of this digital commons were straightforwardly plagiarism in a way anyone could understand
but the way that generative AI uses its training data is significantly more complicated - there is a clear violation of trust involved, and often malicious intent, but most of the common arguments used to describe this fall short and end up in worse territory
by which I mean, it's hard to put forward an actual moral/legal solution unless you're willing to argue:
Potential sales "lost" count as Theft (so you should in fact stop sharing your Netflix password)
No amount of alteration makes it acceptable to use someone else's art in the production of other art without permission and/or compensation (this would kill entire artistic mediums and benefit nobody but Disney)
Art Styles should be considered Intellectual Property in an enforceable way (impossibly bad, are you kidding me)
it's extremely annoying to talk about, because you'll see people straight up gloating about their Intent To Plagiarize, but it's hard to stick them with any specific crime beyond Generally Scummy Behavior unless you want to create some truly horrible precedents and usher in The Thousand Year Reign of Intellectual Property Law

the legal discussion around ai is so fucking frustrating because the country in which i live has a stupid fucking legal system based strongly off of precedent which in practice means every decision has to be something along the lines of "well according to these laws from 200 years ago, if you think about it in a certain way, supports a ruling for an issue that the people who came up with this bitch ass government could never have dreamed of".
and then some people's response will be to just make all ai illegal (how) or that we should just give up and don't even try because government bad (???????????)

Why You're Writing Medieval (and Medieval-Coded) Women Wrong: A RANT
(Or, For the Love of God, People, Stop Pretending Victorian Style Gender Roles Applied to All of History)
This is a problem I see alllll over the place - I'll be reading a medieval-coded book and the women will be told they aren't allowed to fight or learn or work, that they are only supposed to get married, keep house and have babies, &c &c.
If I point this out ppl will be like "yes but there was misogyny back then! women were treated terribly!" and OK. Stop right there.
By & large, what we as a culture think of as misogyny & patriarchy is the expression prevalent in Victorian times - not medieval. (And NO, this is not me blaming Victorians for their theme park version of "medieval history". This is me blaming 21st century people for being ignorant & refusing to do their homework).
Yes, there was misogyny in medieval times, but 1) in many ways it was actually markedly less severe than Victorian misogyny, tyvm - and 2) it was of a quite different type. (Disclaimer: I am speaking specifically of Frankish, Western European medieval women rather than those in other parts of the world. This applies to a lesser extent in Byzantium and I am still learning about women in the medieval Islamic world.)
So, here are the 2 vital things to remember about women when writing medieval or medieval-coded societies
FIRST. Where in Victorian times the primary axes of prejudice were gender and race - so that a male labourer had more rights than a female of the higher classes, and a middle class white man would be treated with more respect than an African or Indian dignitary - In medieval times, the primary axis of prejudice was, overwhelmingly, class. Thus, Frankish crusader knights arguably felt more solidarity with their Muslim opponents of knightly status, than they did their own peasants. Faith and age were also medieval axes of prejudice - children and young people were exploited ruthlessly, sent into war or marriage at 15 (boys) or 12 (girls). Gender was less important.
What this meant was that a medieval woman could expect - indeed demand - to be treated more or less the same way the men of her class were. Where no ancient legal obstacle existed, such as Salic law, a king's daughter could and did expect to rule, even after marriage.
Women of the knightly class could & did arm & fight - something that required a MASSIVE outlay of money, which was obviously at their discretion & disposal. See: Sichelgaita, Isabel de Conches, the unnamed women fighting in armour as knights during the Third Crusade, as recorded by Muslim chroniclers.
Tolkien's Eowyn is a great example of this medieval attitude to class trumping race: complaining that she's being told not to fight, she stresses her class: "I am of the house of Eorl & not a serving woman". She claims her rights, not as a woman, but as a member of the warrior class and the ruling family. Similarly in Renaissance Venice a doge protested the practice which saw 80% of noble women locked into convents for life: if these had been men they would have been "born to command & govern the world". Their class ought to have exempted them from discrimination on the basis of sex.
So, tip #1 for writing medieval women: remember that their class always outweighed their gender. They might be subordinate to the men within their own class, but not to those below.
SECOND. Whereas Victorians saw women's highest calling as marriage & children - the "angel in the house" ennobling & improving their men on a spiritual but rarely practical level - Medievals by contrast prized virginity/celibacy above marriage, seeing it as a way for women to transcend their sex. Often as nuns, saints, mystics; sometimes as warriors, queens, & ladies; always as businesswomen & merchants, women could & did forge their own paths in life
When Elizabeth I claimed to have "the heart & stomach of a king" & adopted the persona of the virgin queen, this was the norm she appealed to. Women could do things; they just had to prove they were Not Like Other Girls. By Elizabeth's time things were already changing: it was the Reformation that switched the ideal to marriage, & the Enlightenment that divorced femininity from reason, aggression & public life.
For more on this topic, read Katherine Hager's article "Endowed With Manly Courage: Medieval Perceptions of Women in Combat" on women who transcended gender to occupy a liminal space as warrior/virgin/saint.
So, tip #2: remember that for medieval women, wife and mother wasn't the ideal, virgin saint was the ideal. By proving yourself "not like other girls" you could gain significant autonomy & freedom.
Finally a bonus tip: if writing about medieval women, be sure to read writing on women's issues from the time so as to understand the terms in which these women spoke about & defended their ambitions. Start with Christine de Pisan.
I learned all this doing the reading for WATCHERS OF OUTREMER, my series of historical fantasy novels set in the medieval crusader states, which were dominated by strong medieval women! Book 5, THE HOUSE OF MOURNING (forthcoming 2023) will focus, to a greater extent than any other novel I've ever yet read or written, on the experience of women during the crusades - as warriors, captives, and political leaders. I wonder how fast I'd die of alcohol poisoning if I did a shot every time someone in my notes boiled one of my posts down to "but are you pro or anti ship."
How many times, tumblr? How many times must I say that "proship/antiship" is a completely asinine way to frame this discussion, and no matter how much my opinions may align with one side, I'm not using a fucking shipping discourse label to discuss my media studies and censorship research?
"Are you pro or anti ship?" Neither. I am not engaged in shipping discourse. I am much more concerned with the ways that censorship is used to specifically target marginalized people raising awareness and making art about their own experiences and worldviews. You cannot enact any form of censorship without it hitting marginalized people the hardest.
I do not care about your ship wars when I am discussing things such as the Hays Code and 2024 book bans, and I am incredibly exhausted by how often people derail my posts into shipping arguments. It's slightly more tolerable when teenagers do it, because they're still figuring out how shit works and lord knows I fell into my fair share of rancid discourse as a teenager, but I am appalled at how often it's dragged into my notes by grown-ass adults.
"Proship/antiship" is a reductive framework grounded in bad-faith internet discourse drenched in purity culture. It is not a useful framework to use when discussing dark fiction, censorship, free speech, or obscenity laws. "Proship" and "antiship" are loaded buzzwords that make people stop thinking critically and engaging in good faith, and I have no tolerance for it.
I'm not interested in declaring my side in tumblr ship wars when I'm focused on things like, "when is the next local school board meeting regarding book bans, and am I eligible to run for the citizen advisory council that helps decide the fate of specific books?" and, "with the overturn of Roe v. Wade, in what ways do we need to be concerned about, and what ways can we raise awareness about, the enforcement of the Comstock Act?" and, "as a trans person living in Florida, how do I navigate my existence being treated as an inherent pornographic threat to children that should be censored and legislated out of existence?"

I don’t care about accusations of ”pedophilia.” I will not give a fuck, I won't investigate your claims, I will just ignore it.
For one thing the accusation of pedophilia is often entirely meaningless. This is because pedophile/pedo etc are words that carry the taint of child rape, of calling up the disgust such an act naturally produces, but are accusations that don’t require such an act or a victim of it. If you call someone a “child rapist” that has weight, but you also have to back it up with a victim this person supposedly raped for the accusation to actually be meaningful. But words like “pedophile” carries no such demands, it literally just means “someone who has an attraction to children.” It doesn’t require an actual victim. It’s an accusation about how someone feels in their head and can thus be liberally applied. Someone criticizes your asinine submarine idea to rescue some children in a cave? Call them a pedo. And even words that once had a more specific meaning, such as “grooming” can be stretched beyond all meaning to mean whatever it wants to. Someone talked to under-18 people about sex and gender in a way you don’t want to? Call them a groomer.
In a culture of pedohysteria, pedojacketing is easy. And it’s especially easy to weaponize it against queer people, the idea that queerness spreads through queers recruiting children by molesting them is one of the oldest queerphobic narrativeness out there. I’m using “queer” here because this is a narrative used both against gay and trans people. But in the present transphobic/transmisogynistic backlash it’s most often used against trans people, especially transfems, as transmasc people are more often infantilized.
But on a more deeper level “pedophilia” is the wrong framing of the real problem of child sex abuse. It’s literally a medical term, a diagnosis. It makes child sex abuse a problem of some sick individuals with a diseased attraction.
This is of course a bad and antifeminist understanding of what rape and sexual violence is. It’s an inevitable and natural expression of power. The widespread rape of women is caused by the patriarchy, of men having power over women. And the misogynist oppression of women with sexual violence naturally extends to young girls. But all children are disempowered in our society. Adults have power over them in the patriarchal family, in the capitalist school system and other institutions of our society. Sexual violence against children flows from the power adults institutionally and systemically have over them. The vast majority of sexual violence towards children comes from the family and schools, not the “stranger danger” of creepy weirdoes hiding in bushes.
This is the reality that the framing of sexual violence as the result of sick individuals with a diseased attraction obscures. And it inevitably calls for a reactionary carceral and psychiatric response, justifying the police, prisons and psychiatric institutions. That’s why “what will we then do with the pedophiles?” is such a popular clichéd response to prison and police abolitionism. This very framing of the problem calls for a carceral response. If the problem of child sex abuse is sick individuals instead of the system, if we constantly root out and punish individuals we will eventually solve the problem.
In reality carceral responses actually make the problem of sexual violence much worse. The police, prisons and involuntary psychiatric hospitals are violent expressions of power and thus create the conditions for rape.
Pedohysteria is constantly used to justify the expansion of state power. Here in European Union we have had a legislative push to ban end-to-end encryption and make all online communication accessible to law enforcement, total online surveillance. And the reasoning is because otherwise pedophiles can use e2e communication to secretly send child porn to each other without the police being able to do anything, which is of course true, that does and will happen, but doesn’t justify killing all online privacy. This “chat control” act is literally called “regulation to prevent and combat child sexual abuse.”
The pedohysteria also justifies vigilantism, which tumblr callout culture is part of and is also a deeply reactionary and even fascist phenomenon. Vigilantism rests on the idea that what the police do is right, but they are not doing it well enough, because they are too reigned in by liberal ideas such as laws and regulations and the courts. So random people should take on the role of police to punish “criminals”, like pedophiles. And this goes through tumblr callout culture. A subtext running through pedojacketing callouts of transfems is the idea that transmisogyny does not exist and does not lead to transfems being disproportionately punished, but instead transfems are using their minority status to get away with sex crimes.
This standard conservative rhetoric about how liberals often literally let minorities get away with murder justifies their reactionary vigilantism. Of course in reality, transfems are far less likely to commit sexual abuse of children than other groups of people, because we are systematically excluded from the very institutions where such abuse happens, such as parenthood/the family or schools, because of the transmisogynist stereotype that we are all perverted child rapists. And the callouts of transfems as sex predators are in themselves abusive and protect actual abusers, just like how police and prisons are.
So no, I will continue to not give a fuck if you call someone a pedophile.

I'm trying to come up with something clever to say here but I feel like I've been hit by a truck. In a good way. I never thought anything like this would pass in the Midwest, not even in a blue state like IL, because it's simply not the kind of thing anybody campaigns on or even talks about at the gubernatorial level.
This is honestly the perfect legal addendum to NAGPRA, and I'm thrilled it's at the state level. This type of legislation would be way too complex at the federal level, but the individual state responsibilities are manageable, and more importantly, doable.
Here's some of the highlights of what the law does:
It is now the state's responsibility to help return ancestral remains, funerary objects and other important cultural items to tribal nations
The state must follow the lead of tribal nations throughout the repatriation process.
Money must be allocated as part of the state Repatriation and Reinterment Fund to help with the costs of reburial, tribal consultation and the repair of any damage to burial sites, remains or sacred items.
Criminal penalties for the looting and desecration of gravesites are increased, and the law adds a ban on profiteering from human remains and funerary objects through their sale, purchase or exhibition.
Tribal nations must be consulted as soon as possible when Indigenous gravesites are unintentionally disturbed or unearthed — such as during construction projects. (We already had kind of a version of this, but it wasn't strong enough.)
IDNR must set aside and maintain land solely for the reburial of repatriated Native American ancestors and their belongings, as tribal nations have pointed to the lack of protected places for reburial in Illinois as among the highest barriers to repatriation.
Institutions that display human remains that are Native American and any items that were originally buried with those individuals (funerary items) cannot charge admission. You want to display looted grave goods? No money for you. (This is specifically targeting the Dickinson Mounds Museum, which is... well, it started as a guy's private display of Native American skeletons he personally looted. The state took it over in the 90s, but they didn't rebury any of the 230~ human skeletons.)
My favorite comment is this: When asked about what he would say to museums that may push back against the law, Illinois State Rep. Mark L. Walker said: “Too bad.”
