A federal judge in Austin on Thursday halted a new state law that would allow Texas police to arrest people suspected of crossing the Texas-Mexico border illegally.
The law, Senate Bill 4, was scheduled to take effect Tuesday. U.S. District Judge David Ezra issued a preliminary injunction that will keep it from being enforced while a court battle continues playing out. Texas is being sued by the federal government and several immigration advocacy organizations. Texas appealed the ruling to the conservative 5th U.S. Circuit Court of Appeals.
Ezra said in his order Thursday that the federal government “will suffer grave irreparable harm” if the law took effect because it could inspire other states to pass their own immigration laws, creating an inconsistent patchwork of rules about immigration, which has historically been upheld as being solely within the jurisdiction of the federal government.
“SB 4 threatens the fundamental notion that the United States must regulate immigration with one voice,” Ezra wrote.
Ezra also wrote that if the state arrested and deported migrants who may be eligible for political asylum, that would violate the Constitution and also be "in violation of U.S. treaty obligations."
"Finally, the Court does not doubt the risk that cartels and drug trafficking pose to many people in Texas," Ezra wrote in his ruling. "But as explained, Texas can and does already criminalize those activities. Nothing in this Order stops those enforcement efforts. No matter how emphatic Texas’s criticism of the Federal Governments handling of immigration on the border may be to some, disagreement with the federal government’s immigration policy does not justify a violation of the Supremacy Clause."
Gov. Greg Abbott signed SB 4 in December, marking Texas’ latest attempt to try to deter people from crossing the Rio Grande after several years of historic numbers of migrants arriving at the Texas-Mexico border.
In a statement, Abbott said the state "will not back down in our fight" and that he expects this case would eventually be decided by the U.S. Supreme Court. On social media, he wrote that he is "not worried" because "this was fully expected."
"Texas has solid legal grounds to defend against an invasion," he added.

State Attorney General Ken Paxton, whose office is defending SB 4 in court, said in a statement that he "will do everything possible to defend Texas’s right to defend herself."
The law seeks to make illegally crossing the border a Class B misdemeanor, carrying a punishment of up to six months in jail. Repeat offenders could face a second-degree felony with a punishment of two to 20 years in prison.
The law also seeks to require state judges to order migrants returned to Mexico if they are convicted; local law enforcement would be responsible for transporting migrants to the border. A judge could drop the charges if a migrant agrees to return to Mexico voluntarily.
In December, the American Civil Liberties Union, the ACLU of Texas and the Texas Civil Rights Project sued Texas on behalf of El Paso County and two immigrant rights organizations — El Paso-based Las Americas Immigrant Advocacy Center and Austin-based American Gateways — over the new state law. The following month, the U.S. Department of Justice filed its lawsuit against Texas. The lawsuits have since been combined.
During a court hearing on Feb. 15 in Austin, the Department of Justice argued that SB 4 is unconstitutional because courts have ruled that immigration solely falls under the federal government’s authority.
The lawyer representing Texas, Ryan Walters, argued that the high number of migrants arriving at the border — some of them smuggled by drug cartels — constitutes an invasion and Texas has a right to defend itself under Article I, Section 10 of the U.S. Constitution, which prohibits states from engaging in war on their own “unless actually invaded.”
Ezra said that he “is not unsympathetic to the concerns raised by Abbott,” but appeared unconvinced by Walters’ argument.
"I haven't seen, and the state of Texas can't point me to any type of military invasion in Texas," Ezra said. "I don't see evidence that Texas is at war."
Immigrant rights advocates around the state celebrated the ruling because they worried that SB 4 would lead to border residents' rights being violated.
"We celebrate today’s win, blocking this extreme law from going into effect before it has the opportunity to harm Texas communities," said Aron Thorn, senior attorney for the Beyond Border Program at Texas Civil Rights Project. "This is a major step in showing the State of Texas and Governor Abbott that they do not have the power to enforce unconstitutional, state-run immigration policies."
Edna Yang, co-executive director at American Gateways, said that SB 4 does not fix “our broken immigration system” and it will divide communities.
“This decision is a victory for all our communities as it stops a harmful, unconstitutional, and discriminatory state policy from taking effect and impacting the lives of millions of Texans," she said. "Local officials should not be federal immigration agents, and our state should not be creating its own laws that deny people their right to seek protection here in the U.S."
David Donatti, senior staff attorney at the ACLU of Texas, said the ruling is an "important win for Texas values, human rights, and the U.S. Constitution."
"Our current immigration system needs repair because it forces millions of Americans into the shadows and shuts the door on people in need of safety. S.B. 4 would only make things worse," he said. "Cruelty to migrants is not a policy solution.”

The GOP wonders why young people (and others) don't want to vote for them. Some wise scribe assembled this list.
1.) Your Reagan-era “trickle-down economics” strategy of tax breaks for billionaires that you continue to employ to this day has widened the gap between rich and poor so much that most of them will never be able to own a home, much less earn a living wage.
2.) You refuse to increase the federal minimum wage, which is still $7.25 an hour (since 2009). Even if it had just kept up with inflation, it would be $27 now. You’re forcing people of all ages but especially young people to work multiple jobs just to afford basic necessities.
3.) You fundamentally oppose and want to kill democracy; have done everything in your power to restrict access to the ballot box, particularly in areas with demographics that tend to vote Democratic (like young people and POC). You staged a fucking coup the last time you lost.
4.) You have abused your disproportionate senate control over the last three decades to pack the courts with religious extremists and idealogues, including SCOTUS—which has rolled back rights for women in ways that do nothing but kill more women and children and expand poverty.
5.) You refuse to enact common sense gun control laws to curb mass shootings like universal background checks and banning assault weapons; subjecting their entire generation to school shootings and drills that are traumatizing in and of themselves. You are owned by the NRA.
6.) You are unequivocally against combatting climate change to the extent that it’s as if you’ve made it your personal mission to ensure they inherit a planet that is beyond the point of no return in terms of remaining habitable for the human race beyond the next few generations.
7.) You oppose all programs that provide assistance to those who need it most. Your governors refused to expand Medicaid even during A PANDEMIC. You are against free school lunches, despite it being the only meal that millions of children can count on to actually receive each day
8.) You are banning books, defunding libraries, barring subject matter, and whitewashing history even more in a fascistic attempt to keep them ignorant of the systemic racism that this nation was literally founded upon and continues to this day in every action your party takes.
9.) You oppose universal healthcare and are still trying to repeal the ACA and rip healthcare from tens of millions of Americans and replace it with nothing. You are against lowering the cost of insulin and prescription drugs that millions need simply to LIVE/FUNCTION in society.
10.) You embrace white nationalists, Neo-Nazis, and other groups that are defined by their intractable racism, xenophobia, bigotry, and intolerance. You conspired with these groups on January 6th to try to overthrow the U.S. government via domestic terrorism that KILLED PEOPLE.
11.) You oppose every bill aimed at making life better for our nation’s youth; from education to extracurricular and financial/nutritional assistance programs. You say you want to “protect the children” while you elect/nominate pedophiles and attack trans youth and drag queens.
12.) You pretend to be offended by “anti-semitism” while literally supporting, electing, and speaking at events organized by Nazis. You pretend to hate “cancel culture” despite the fact that you invented it and it’s basically all you do.
13.) Every word you utter is a lie. You are the party of treason, hypocrisy, crime, and authoritarianism. You want to entrench rule by your aging minority because you know that you have nothing to offer young voters and they will never support you for all these reasons and more.
14.) You’re so hostile to even the notion of helping us overcome the mountain of debt that millions of us are forced to take on just to pay for our post K-12 education that you are suing to try to prevent a small fraction of us from getting even $10,000 in loan forgiveness.
15.) You opened the floodgates of money into politics via Citizens United; allowing our entire system of government to become a cesspool of corruption, crime, and greed. You are supposed to represent the American people whose taxes pay your salary but instead cater to rich donors.
16.) You respond to elected representatives standing in solidarity with their constituents to protest the ONGOING SLAUGHTER of children in schools via shootings by EXPELLING THEM FROM OFFICE & respond to your lack of popularity among young people by trying to raise the voting age.
17.) You impeach Democratic presidents over lying about a BJ but refuse to impeach (then vote twice to acquit) a guy whose entire “administration” was an international crime syndicate being run out of the WH who incited an insurrection to have you killed.
18.) You steal Supreme Court seats from democrats to prevent the only black POTUS we’ve ever had from appointing one and invent fake precedents that you later ignore all to take fundamental rights from Americans; and even your “legitimate” appointments consist of people like THIS (sub-thread refuting CJ Roberts criticisms of people attacking SCOTUS' legitimacy).
19.) You support mass incarceration even for innocuous offenses or execution by cop for POC while doing nothing but protect rich white criminals who engage in such things as tax fraud, money laundering, sex trafficking, rape/sexual assault, falsifying business records, etc.
20.) You are the reason we can’t pass:—Universal background checks—An assault weapons ban—The ‘For the People/Freedom to vote’ Act or John Lewis Voting Rights Act—The ERA & Equality Act—The Climate Action Now Act—The (Stopping) Violence Against Women Act—SCOTUS expansion.
21.) You do not seek office to govern, represent, or serve the American people. You seek power solely for its own sake so you can impose your narrow-minded puritanical will on others at the expense of their most fundamental rights and freedoms like voting and bodily autonomy.
22.) Ok, last one. You are trying to eliminate social security and Medicare that tens of millions of our parents rely on and paid into their entire lives. And you did everything to maximize preventable deaths from COVID leaving millions of us in mourning.

URGENT: Congress about to pass a mass censorship and surveillance bill under the guise of "protecting children"

The Senate has been in a "do something!" mode regarding children's online safety. They're using this as an excuse to push for widespread internet censorship and surveillance. The EARN IT Act, has a slimmer chance of passing with widespread opposition and some senators saying they won't vote for it. TLDR;The real threat is actually KOSA (s.1409), the Kid's Online Safety Act, which will mass censor and surveill the entire internet by giving all 50 state attorney generals the power to remove content that is "harmful" for kids, and force you to upload your govt ID online to access the internet. I'll explain how it works below the action items but it's absolutely urgent that anyone who likes having a free and open internet fights back. It's all hands on deck, because this has so much public support it's insane:

The opposition is getting absolutely drowned online. Dove has nearly 100k signatures to push for KOSA. Influencers on tiktok are pushing for this without ever having read the bill. Fucking Lizzo is sponsoring it. If you have twitter, reddit, tiktok, are in any community, SPREAD THE WORD, PLEASE.

HOW KOSA WORKS
First, KOSA pressures platforms to install filters that would wipe the net of anything deemed “inappropriate” for minors. This means instructing platforms to censor. We saw how these filters impacted websites firsthand with tumblr in 2018, with not only blocking all adult content but also sfw queer content such as suicide hotlines, art archives, wiping out entire blogs because they had queer fandom related posts, etc. Places that already use content filters have restricted important information about suicide prevention and LGBTQ+ support groups. KOSA would spread this kind of censorship to every corner of the internet. And who gets to decide what is and isn't harmful for minors? Oh don't worry, just every single state attorney general and the FTC, which is appointed by the president. You know, the same attorney generals that just banned gender-affirming healthcare under the guise that it "ruins mental health" of minors. This is why the Heritage Foundation was one of the first to sponsor the bill because they can use it to censor trans content, and Senator Marsha Blackburn of Tennessee is it's co-author.
Second, KOSA would ramp up the online surveillance of all internet users by forcing websites to use age verification and parental monitoring tools. Yup, that's right. Now every single person who wants to access the internet has to upload their govt ID online to third party apps that get hacked all the time. You queer in a red state? You undocumented? You an activist? Have fun getting all your online activity and metadata attached to your govt ID.  
Over 90+ human and LGBT rights groups agree that KOSA is dangerous and updates to the 2023 version won’t and can’t address the big problems with the bill. This bill has MASSIVE bipartisan support, and the authors Blumenthal and Blackburn (yes, that Blumenthal that's pushing the EARN IT Act, and who also sponsored the RESTRICT Act and SOPA/PIPA if you remember) are using the tragedy of mothers who lost their kids to online harassment and young adults who've been traumatized online to lobby for it, and got Dove the company to use a bunch of influencers to push for this under the guise it prevents eating disorders...I wish I was lying. There are already 30 co-sponsors.
It is all hands on deck. I'm dead serious when I say if this bill is passed it is the beginning if not end of the open and free internet.

So, in Brazilian feminism and technology news, the Chamber of Deputies has approved a bill that criminalizes the creation and sharing of nude images and videos created by artificial intelligence.

The text, authored by deputy Erika Kokay (Workers' Party) and reported by deputy Luisa Canziani (Social Democratic Party), sets a penalty of 1 to 4 years in prison, in addition to a fine, for anyone who creates or disseminates “montages or modifications that aim to include a person in a nude scene or sexual act, including the use of artificial intelligence in video, audio or photography."
The bill now heads to the Senate.

"France became the first country in the world to make abortion a constitutional right Monday [March 4, 2024], with French lawmakers adopting the bill in a 780-72 vote in a move inspired by the U.S. reversal of Roe vs. Wade.
The law gives women a "guaranteed freedom" to choose for themselves if an abortion is the right choice to make.
The amendment won the support of the three-fifths of the 925 National Assembly and Senate members required to pass in an extraordinary afternoon session at the Palace of Versailles just outside Paris in a move that was overwhelmingly supported by the public.
Prime Minister Gabriel Attal said to those assembled in Congress Hall that "we owe a moral debt" to the women who had to suffer through illegal abortions in the past.
After the vote to approve the constitutional change, Paris' Eiffel Tower was lit with the words in French "my body my choice" in the country where abortion was first legalized in 1975, two years after the United States' first ruling on Roe vs. Wade...
While limiting abortion ranked very low on France's political agenda, lawmakers were prompted to take action to protect abortion rights in 2022 following the U.S. Supreme Court's overturning of the 1973 Roe ruling that legalized abortion. Subsequently, several American states have passed laws to restrict or outlaw the procedure.
"I say to all women within our borders and beyond, that today, the era of a world of hope begins," said Attal, who at 34 became the country's youngest prime minister.
This was the first time since 2008 that France took steps to change its constitution. There will be a ceremony to finalize the amendment on Friday [March 8, 2024], which is also International Women's Day."

So, while I've talked about this in other posts, I figured I may as well compile it in one post with this nifty propaganda poster (more on that later)
Long story short, they're bringing back KOSA/the Kids Online Safety Act in the US Senate, and they're going to mark it up next Thursday as of the time of this post (4/23/2023).
If you don’t know, long story short KOSA is a bill that’s ostensibly one of those “Protect the Children” bills, but what it’s actually going to do is more or less require you to scan your fucking face every time you want to go on a website; or give away similarly privacy-violating information like your drivers’ license or credit card info. 
Either that or force them to censor anything that could even remotely be considered not “kid friendly.” Not to mention fundies are openly saying they’re gonna use this to hurt trans kids. Which is, uh, real fucking bad. 
As per usual, I urge you to contact your congresscritters, and especially those on the Commerce Committee, who'll likely be the ones marking it up.

They also voted to block to student debt relief, cut tax breaks and subsidies for renewable energy, added work requirements for financial assistance, take back COVID relief money from states, and boost fossil fuel production.
And a very insidious cap on government spending that only grows 1% every year (less than the rate of inflation). Meaning that every year would necessarily require even more cuts.
The worst part is that they made it all a condition for the federal government to pay its debt. Their plan being that if Biden doesn't capitulate to their demands, the US government goes into default, which would cause a global financial crisis.
Oh, and don't think that the 4 Republicans who voted Nay are reasonable. They're voted against it because this bill didn't go far enough for them.
The good news is that the Democrats control the Senate and White House, so this bill won't get enacted.
TL;DR: House Republicans passed an extorsion bill that threatens to blow up the world economy if Biden doesn't capitulate to their demands to hurt poor Americans and make climate change worse.
Abolish the Republican Party!

Senate Bill 686 of the 118th Congress (The Restrict Act)
I’m honestly a bit disappointed here at Tumblr for not talking about this bill more, so I’m going to share what I’ve learned about it with you all

The link above goes to a pdf file going over the entire bill that has only been introduced atm as shown in the image just above from congress.gov.
Now, people only see this as a means to ban Tiktok, but that’s just the mask this truly cruel bill is hiding behind.
To boil it all down, this bill lets the Secretary of Commerce to have the power to ban…basically ANYTHING on the internet.
This includes hardware like video game consoles or Wifi networks as well as software and applications such as VPNs.
It also gives the government the power to monitor, basically everything you do online, private messages, posts on social media, streams, you name it, they can monitor it.
And the punishment for using, say, a VPN to access Tiktok, will result in 20 years in prison with a 1/4 million fine, a full million if you did it on purpose.
Now, I please ask you all to go to your representatives and tell them about how you don’t want this bill to be passed whatsoever. Heck, if you have to, (passively) threaten them with supporting their opponent in the next primary in any way they can. Just remember to be respectful and civil.
If you don’t want to do that, I respect that decision, and I understand that you wouldn’t want to deal with politics. But, I at least ask you to signal boost this post by reblogging it to your own followers and give any other thoughts about this that you might have in the tags or just normally.
I don’t want this lovable hellsite we all call home and made such good friends and memories on to be under the eyes of those pedophilic heathens who can’t seem to even know how to unlock a smartphone.

Bill Criminalizing Librarians Revived - again.
April 21, 2023: After the sound defeat of language calling for felony charges against librarians and educators in SB 12 and SB 380 earlier in April, the Indiana legislature is once more considering criminalizing librarians and educators for the materials on their shelves.
Here's the Indiana Capital Chronicle on the situation:
The legislators themselves don't know yet what bill the language will be slipped into, but we expect they'll hear it next week, possibly as early as Monday, April 24.
What To Do:
They're moving fast, so if you live in Indiana and feel strongly about libraries and censorship, please call your reps and senators NOW. Even if you already contacted them earlier this session!

Here are some talking points and the general gist of our concerns:
Charging librarians and educators with felonies is not an appropriate response to the issue of challenging books.
It is a librarian or educator’s job to ensure that children have access to a range of well-reviewed quality books. They are trained and follow objective processes for material selection.
Libraries and schools already have processes in place for challenging books on their shelves, and these processes work.

1. A branch of the flu family tree has died and won't be included in future US vaccines

A type of flu virus that used to sicken people every year hasn't been spotted anywhere on Earth since March 2020. As such, experts have advised that the apparently extinct viruses be removed from next year's flu vaccines.
The now-extinct viruses were a branch of the influenza B family tree known as the Yamagata lineage. Scientists first reported the apparent disappearance of Yamagata viruses in 2021.
2. Hospitals must obtain written consent for pelvic and similar exams, the federal government says

Hospitals must obtain written informed consent from patients before subjecting them to pelvic exams and exams of other sensitive areas — especially if an exam will be done while the patient is unconscious, the federal government said Monday.
New guidance from the U.S. Department of Health and Human Services now requires consent for breast, pelvic, prostate and rectal exams for “educational and training purposes” performed by medical students, nurse practitioners or physician assistants.
3. Germany approves new law that will allow adults to carry up to 25 grams of cannabis for their own consumption and store up to 50 grams at home.

Germany's upper house, the Bundesrat, cleared the way to partially legalize cannabis on Friday. Adults aged 18 and over will be allowed to carry up to 25 grams of cannabis for their own consumption.
4. Tick-killing pill shows promising results in human trial | Should it pan out, the pill would be a new weapon against Lyme disease.

Tarsus Pharmaceuticals is developing a pill for humans that could provide protection against the tick-borne disease for several weeks at a time. In February, the Irvine, California–based biotech company announced results from a small, early-stage trial showing that 24 hours after taking the drug, it can kill ticks on people, with the effects lasting for up to 30 days.
5. Thailand moves to legalise same-sex marriage

Thailand has taken a historic step closer to marriage equality after the lower house passed a bill giving legal recognition to same-sex marriage.
It still needs approval from the Senate and royal endorsement to become law but it is widely expected to happen by the end of 2024, making Thailand the only South East Asian country to recognise same-sex unions.
6. French Revolution: Cyclists Now Outnumber Motorists In Paris

Official measurements have found that Paris is rapidly becoming a city of transportation cyclists. In the suburbs, where public transit is less dense, transport by car was found to be the main form of mobility. But for journeys from the outskirts of Paris to the center, the number of cyclists now far exceeds the number of motorists, a huge change from just five years ago.
7. 'Miracle' operation reverses blindness in three-year-old girl giving her 'promising' future

A three year old with a genetic condition that causes blindness is doing incredibly well after unique pioneering operation to restore her sight.
The UK is the only country performing keyhole eye surgery to inject healthy copies of a gene into sufferers’ eyes. I looked at the website and yes, there *is* no mention of any voting on KOSA happening before or past March 13th, March 13th is where the schedule ends. I'm still not sure, so keep digging for more info.

So, today I was on Reddit reading about KOSA, and I found this on r/AO3

Here's the Invest in Child Safety Act, it only has five cosponsors compared to KOSA's sixty-three.. wonder why..
Anyways, I was wondering, could steering reps away from KOSA while leading them towards other and SAFER bills help? :P
If these bills really ARE safer, wouldn't it give us a better chance of KOSA not being passed if we gave our Senators and Reps examples of alternative bills they could support?
Like, instead of just saying "DON'T DO THIS!!!" We could say "DON'T DO THIS, but THIS is a better alternative that will keep everyone safe AND actually be helpful."
I have a feeling most of the Democrats supporting this bill have fallen for the "We're protecting the children!!" farse. So, let's not just tell them the problem, but offer a solution! An alternative that will ACTUALLY protect children.
I posted this as it's own thing, but I wanted to add it to this update thread so people are more likely to see it.
