An open copyright casebook, featuring AI, Warhol and more

I'm coming to DEFCON! On Aug 9, I'm emceeing the EFF POKER TOURNAMENT (noon at the Horseshoe Poker Room), and appearing on the BRICKED AND ABANDONED panel (5PM, LVCC - L1 - HW1–11–01). On Aug 10, I'm giving a keynote called "DISENSHITTIFY OR DIE! How hackers can seize the means of computation and build a new, good internet that is hardened against our asshole bosses' insatiable horniness for enshittification" (noon, LVCC - L1 - HW1–11–01).

Few debates invite more uninformed commentary than "IP" – a loosely defined grab bag that regulates an ever-expaning sphere of our daily activities, despite the fact that almost no one, including senior executives in the entertainment industry, understands how it works.

Take reading a book. If the book arrives between two covers in the form of ink sprayed on compressed vegetable pulp, you don't need to understand the first thing about copyright to read it. But if that book arrives as a stream of bits in an app, those bits are just the thinnest scrim of scum atop a terminally polluted ocean of legalese.

At the bottom layer: the license "agreement" for your device itself – thousands of words of nonsense that bind you not to replace its software with another vendor's code, to use the company's own service depots, etc etc. This garbage novella of legalese implicates trademark law, copyright, patent, and "paracopyrights" like the anticircumvention rule defined by Section 1201 of the DMCA:

Then there's the store that sold you the ebook: it has its own soporific, cod-legalese nonsense that you must parse; this can be longer than the book itself, and it has been exquisitely designed by the world's best-paid, best-trained lawyer to liquefy the brains of anyone who attempts to read it. Nothing will save you once your brains start leaking out of the corners of your eyes, your nostrils and your ears – not even converting the text to a brilliant graphic novel:

The copyright nonsense that accompanies an ebook transcends mere Newtonian physics – it exists in a state of quantum superposition. For you, the buyer, the copyright nonsense appears as a license, which allows the seller to add terms and conditions that would be invalidated if the transaction were a conventional sale. But for the author who wrote that book, the copyright nonsense insists that what has taken place is a sale (which pays a 25% royalty) and not a license (a 50% revenue-share). Truly, only a being capable of surviving after being smeared across the multiverse can hope to embody these two states of being simultaneously:

But the challenge isn't over yet. Once you have grasped the permissions and restrictions placed upon you by your device and the app that sold you the ebook, you still must brave the publisher's license terms for the ebook – the final boss that you must overcome with your last hit point and after you've burned all your magical items.

This is by no means unique to reading a book. This bites us on the job, too, at every level. The McDonald's employee who uses a third-party tool to diagnose the problems with the McFlurry machine is using a gadget whose mere existence constitutes a jailable felony:

Meanwhile, every single biotech researcher is secretly violating the patents that cover the entire suite of basic biotech procedures and techniques. Biotechnicians have a folk-belief in "patent fair use," a thing that doesn't exist, because they can't imagine that patent law would be so obnoxious as to make basic science into a legal minefield.

IP is a perfect storm: it touches everything we do, and no one understands it.

Or rather, almost no one understands it. A small coterie of lawyers have a perfectly fine grasp of IP law, but most of those lawyers are (very well!) paid to figure out how to use IP law to screw you over. But not every skilled IP lawyer is the enemy: a handful of brave freedom fighters, mostly working for nonprofits and universities, constitute a resistance against the creep of IP into every corner of our lives.

Two of my favorite IP freedom fighters are Jennifer Jenkins and James Boyle, who run the Duke Center for the Public Domain. They are a dynamic duo, world leading demystifiers of copyright and other esoterica. They are the creators of a pair of stunningly good, belly-achingly funny, and extremely informative graphic novels on the subject, starting with the 2008 Bound By Law, about fair use and film-making:

Both of which are open access – that is to say, free to download and share (you can also get handsome bound print editions made of real ink sprayed on real vegetable pulp!).

Beyond these books, Jenkins and Boyle publish the annual public domain roundups, cataloging the materials entering the public domain each January 1 (during the long interregnum when nothing entered the public domain, thanks to the Sonny Bono Copyright Extension Act, they published annual roundups of all the material that should be entering the public domain):

This year saw Mickey Mouse entering the public domain, and Jenkins used that happy occasion as a springboard for a masterclass in copyright and trademark:

But for all that Jenkins and Boyle are law explainers, they are also law professors and as such, they are deeply engaged with minting of new lawyers. This is a hard job: it takes a lot of work to become a lawyer.

It also takes a lot of money to become a lawyer. Not only do law-schools charge nosebleed tuition, but the standard texts set by law-schools are eye-wateringly expensive. Boyle and Jenkins have no say over tuitions, but they have made a serious dent in the cost of those textbooks. A decade ago, the pair launched the first open IP law casebook: a free, superior alternative to the $160 standard text used to train every IP lawyer:

But IP law is a moving target: it is devouring the world. Accordingly, the pair have produced new editions every couple of years, guaranteeing that their free IP law casebook isn't just the best text on the subject, it's also the most up-to-date. This week, they published the sixth edition:

The sixth edition of Intellectual Property: Law & the Information Society – Cases & Materials; An Open Casebook adds sections on the current legal controversies about AI, and analyzes blockbuster (and batshit) recent Supreme Court rulings like Vidal v Elster, Warhol v Goldsmith, and Jack Daniels v VIP Products. “Max,” Daniel calls to him from the bedroom, just as he is rinsing the shampoo from his hair. Not wanting shampoo in his eyes or his mouth, Max keeps them all firmly shut.

“Baby?” Daniel says again, louder.

The warm water is a gentle relief running over his sweat sticky skin, nowhere near the scalding temperatures Daniel sets their shower to at home. It’s why Max had insisted that they clean off separately, the Austin heat far too much for Max to endure boiling water too, despite Daniel’s pouting and dramatic insistence that Max couldn’t just ‘fuck and flee.”

“Yes,” he calls when all the suds are safely sliding past his shoulders, but he didn’t need to shout. When he opens his eyes he sees Daniel leaning against the doorway with a smirk, still wearing his unbuttoned satin shirt, cowboy hat and nothing else. His wedding ring sits heavy on his finger, and Max thumbs over the matching one on his own hand.

Max’s come is a shiny presence he can still see smeared between Daniel’s thighs.

The sight of him makes Max’s dick twitch. Daniel notices and his grin only widens.

“Baby,” he says again, too sweet. “Baby, why is your most recent Google search is it weird that my husband saying yeehaw makes me come?”

And just like that, Max suddenly longs for a hot shower, an excuse for why his cheeks start to burn red.

“Why are you snooping through my phone?” He demands, forcing himself not to turn away casually and instead keep rubbing the hotel’s own body wash under his armpits.

“I wasn’t snooping,” Daniel says easily, “I was looking to get us some ribs delivered, my phone died at the track, remember?”

Max makes a noncommittal noise because vaguely he does remember Daniel saying he needed to put it on charge. That was before Max started pawing at him the moment the hotel door shut behind them though, and then it had been forgotten by both of them.

There’s just the noise of the extractor fan whirring for a moment, but Daniel doesn’t move. When Max sneaks a glance at him, he’s still leaning against the door frame looking amused.

“Sooo.” He drawls out the word in the stupid Texas accent that Max wishes he didn’t find so strangely sexy. “Are we going to talk about this, little lady, or-“

“Nope,” Max says firmly, turning off the shower.

Daniel nods. It makes the lights of the bathroom catch on his chain and Max- Max really wants to fuck him again.

“What about the one below it?” He asks, “Daniel Ricciardo Austin 2023 photos?”

“Nope,” Max says again, stepping out of the shower and reaching for his towel. He’s smiling now too, because he knows that beneath Daniel’s teasing that one will have made him happy to see.

“Okay,” Daniel says, then he unlocks Max’s phone. “What about how to ask my husband to-“

“Daniel,” Max interrupts, taking the phone from his hand and putting it into the empty sink. “Do you want to read more of my internet history, or do you want to get back on the bed and play good cowboy, bad cowboy again?”

Daniel grins, takes the cowboy hat from his head and puts it onto Max’s. When his arms wind around Max, the silky fabric of his shirt presses cool against Max’s shower-warm skin, his nipples.

“Well, when you put it like that,” Daniel says, leaning in to put his mouth on the skin just beneath Max’s ear. “Yeehaw, baby.”

Max laughs and pinches Daniel’s ass, at the same time as his dick twitches again. Backing him out of the bathroom, towards the bed, his phone is forgotten in the bathroom.

Google never had all the answers when it came to them, anyway.

✼. THRU SPACE 'N TIME | PROFILE.

Born in Gold Coast, Australia on December 23, 1999, Michaela Sommers was introduced to the world of motorsports from a early age. Her father, Tobias, and his younger brother, Travis Sommers, were avid Formula racing fans who idolized the likes of Senna, Schumacher, and Lauda. The motorsports bug skipped over Sommers' older sister, Samantha, before biting her at the mere age of six. By her ninth birthday, Michaela was competing in karting championships along the Australian east coast.

Despite her natural aptitude for racing, Michaela recalls facing discrimination for both her race and gender quite early on while karting. Despite the negativity that would swirl around her reputation, the young driver would win her first national championship at the age of twelve with plenty of rumors circling concerning her future in the sport. Sommers would attempt to enter her first international competition, but was barred from entry after her father lost his job in the summer of 2012.

Without much hope, Michaela would step back from racing for nearly six months before eventually deciding to join her uncle who had moved to England after his marriage just years prior. Travis then became Michaela's manager, working endlessly to ensure his niece would be able to continue climbing the karting ladder. Shortly after her move to England, her uncle would connect with Australian F1 driver Mark Webber who would travel to watch her race in a regional competition in 2013. Stunned by her potential, Webber helped the young girl to catch the attention of a racing team competing in the Ginetta Junior Championship alongside future McLaren teammate Lando Norris. Sommers' transition to racing cars would prove successful, securing a junior championship at just 14 years old.

Sommers would continue working through the ranks, receiving extensive media attention and comparisons to Lewis Hamilton as a teenager. Spending one year at the Formula 3 level, Michaela would race for British team Jagonya Ayam in 2015 finishing fifth in the championship and second in the rookie cup, both below Charles Leclerc. Her performance would catch the attention of Italian team Prema Racing who signed her to development for higher formulae alongside Pierre Gasly for the 2016 season.

Despite an average result, ending her rookie season in sixth place, Prema would resign the Australian who would be simultaneously be selected to join the Ferrari driver development program for the 2017 season. That same year, Sommers would wrap up her Formula 2 season in second place, once again behind Charles Leclerc.

Eventually, Michaela would finally secure a Formula 2 championship in 2018 while signing on as a reserve driver for Ferrari. Her official Formula One debut came after Sommers signed on to be Alfa Romeo's second-seat driver for the 2019 season, securing one-point in her debut race before finishing her rookie season in eighth place.

Jikook Week 15 Complete (19-26/03/2024)

Their fifteenth week in the military is now complete. It's time to celebrate this milestone with a look back at this week in 2017.

BTS was on the 2017 BTS Live Trilogy Episode III (Final Chapter): The Wings Tour. This tour began on 18th February 2017, and ended in South Korea on 10th December 2017. This week in March they gave During this week they gave two concerts in São Paulo, Brazil (19-20/03/2017) and two concerts in Newark, USA (23-24/03/2017)

The fan cams suggest that these were amazing concerts. The audience were matching BTS word for word on all the songs. Here are fan cams for Save Me, Blood Sweat and Tears and Lie. The reaction to Jimin's entrance for Lie is so enthusiastic and prolonged. I hope I get the chance to experience that in real time one day.

Run BTS 15 came out on the 21st March 2017. It was the last episode of three that were filmed at a water park in Ilsan.

In the first two episodes the older brother's team (Jin, JHope and RM) were pitted against the younger brother's team (Jimin, V and Jungkook) in a series of water related games.

By the time they filmed the final episode it looks like they were all physically exhausted and anxious to tuck into the food in front of them. However, they still had three rounds of games to play and identify the spy in their midst. Heads up they didn't find the spy and ended up having to sing for their supper.

Time and healing go hand in hand. Presumably anyways, according to everyone. While the years have allowed the blood to gradually crystalize, Charles Leclerc doesn't think the wound will ever stop dripping on his pristine wooden floor.

Success, achievements, wins. All these things fly with glory. Trigger adrenaline. The blood pumps, moves. Colors seem brighter, voices seem simultaneously louder and quieter, blending in with the murmur of the wind, of the cheers. The heart doesn't stop, doesn't take a break. It keeps on going and going and going. If any tiredness is supposed to be felt, it seems non-existent at that moment. The trophy is cool, blending with the heat of his hands. The light reflects on the champagne bottle. The crowd roars, so does he.

Man has never felt more godly than when he's soaked in red with the cape of history and legacy flowing down his back. Never felt more untouchable than when he's deemed irreplaceable. A hero from a legend coming straight to life.

The highs reach the moon.

So the lows reach the Earth's core. Bright, yet hot enough to incinerate, evaporate.

People die and the world doesn't bat an eye. Life keeps moving and time keeps flowing. But its core weeps molten metal, scalding. Dripping furiously, wondering, screaming. It seems so loud, yet no one notices. Why don’t they see it? Why don’t they understand?

Every June, his phone rings. Echoes in the walls of his expensive apartment. No matter how much he pays, it soaks itself in the crevices between the tiles. Makes sure it follows him. Hangs heavy in his pockets, in his rooms.

The heart has four chambers, each one of Charles’ overflowing.

Every July, Charles hangs his heart, lets it air out in the Monaco air, near the sea. It never fully dries. It drips and drips and drips.

In 2014, F3 welcomed him with open arms, the sun shined bright and his career seemed to be soaring. The future clear.

On October 4th 2014, the present halted. It stopped. His heart dropped, yet it deafened his ears. Hands shaking and eyes unmoving, he heard the gasp of his maman next to him. From the corner of his eye he could see his papa get up and call someone in a fervor. He felt hands on his face and the panicked, yet soft voice of his mother. Everything blurred.

Turned dark.

Blank.

He doesn’t remember much afterwards.

On July 17th 2015, Charles Leclerc’s phone rang at 4:03 AM. Jules Bianchi called him on a Wednesday’s waking hour for the last time. The sea was bursting in his room through every opening, every window.

Jules was finally resting.

Charles couldn't wake up from this nightmare.

His heart swelled. The rush of liquid in its chambers sudden. Wrong. The first thing to fill up were the ventricles, allowing them to hang heavy at the bottom. Slowly over the years, with every drip, every leak, the atriums expanded with the never ending grief.

2017 was his year of change. F2 had kicked off with a grand slam and he kept racking up the points. One after the other, after a long and difficult time, Charles’ future seemed set. His road to F1 perfected already.

He wanted more. He couldn't wait to have it. He'd jump, leep, crouch and slide to achieve what he wanted, what he deserved.

He'd honor Jules, he'd make Papa proud.

He’d bleed red. Get submerged in. Breathe till the bubbles escaped his lungs to reach for the sky.

The high of Monaco still lingered on his skin. In the month in between he'd been counting down the days. Training, sleeping, hoping.

20 days left.

10 days left.

9 days, then 8.

7, then 6.

5, then 4.

Halt.

Stop.

Just stop.

Not again. It's too much.

No.

Not again. Not now. Why now?

No.

The 21st of June’s sun peaked its rays on the cloudy sky, Hervé Leclerc’s eyes slipped shut and Charles Leclerc met his breaking point.

The quiet before the storm, then a boom was heard.

A sudden calm and then a supernova.

His phone rang on the 25th of June.

‘He’d lost his father earlier in the week. We’re talking literally 48 hours later, he was in the car. He then went out, fell to last place, fought his way through and won the race. This was a kid who’d just lost his father and he was a kid at the time, a teenager. To have that kind of mental strength, I’ve never seen anything like it.’

Charles Leclerc won the 2017 F2 Baku Grand Prix.

Charles and Hervé dreamed a lot together. He remembers the race nights, the Grand Prix, the atmosphere, the wins. The drivers and their celebrations, their fireproofs and livery. The success, the wins, the championships, the legacy, the weight.

They remembered the red.

They looked up to the red.

They dreamed of it.

Laid down their lives for a chance to look at it in the eye.

So he lied.

His father on his deathbed, sick and weak, still held that spark in his last words. That smile, that used to be his comfort, now lingered with a looming feeling of dread. Of knowing what's happening.

So he lied.

And take him back in that moment right now, he would still lie.

With his own reassuring smile, Charles Leclerc looked at his dying father and told him Scuderia Ferrari signed him into F1. The horse pranced and jumped and bled Charles Leclerc, as much as his own family had bled for it.

So he lied.

And his father died happy.

His heart filled to the brim. Charles could almost sympathize with the weight of the horse on his back.

Soon enough it'd be his.

Soon enough he would be the horse.

Fury seeped from every pore, screeched in his head, escaped his lungs.

Everything he wanted was taken too early.

Not this.

He wouldn't allow this.

‘It’s very unusual for Ferrari to choose a young driver. But after a decade with no championship success, perhaps trying something a little bit different is going to reap its rewards.’

A year into F1, it became reality.

The wind howled, his heart soared. It dumped its contents on the ground. Blood red leaking down, slowly spilling over each step, each stair. He should be jumping in joy, flying through the sky. Climbing.

So why?

Why was it heavy?

He looked up hoping to see the Sun, catching glimpses of it in between the clouds.

He plunged.

Eyes wide open. Hand holding onto a hoof. Hearing the echoes of its neigh.

His phone rang.

The sound made him pick up his head. Hazy, confused, he looked at the called ID.

Papa <3

Charles Leclerc was drowning in molten gold.

He didn’t swim.

He declined.

‘What Charles is doing is a continuation of Jules’ legacy. Charles has a mission. A mission to do what Jules should have done.’

It was never meant to be his seat.

At least not like this.

He doesn’t know, if on that fateful day in Suzuka, rain hadn't been falling, a crash hadn’t happened, a life wasn’t lost, would he still be here? In this seat?

Who was bleeding more red? Him, his father or Jules?

Can dead men bleed?

Are his achievements his own?

At the end of the day, the past has happened. Its consequences reaped.

Charles can’t revive the dead, but he can honor them.

In his second year in F1, Charles Leclerc became a Ferrari driver.

In his first year in Ferrari, Charles’ teammate was a 4 time world champion.

In his second year in F1 and first in Ferrari, Charles Leclerc won in Spa.

Anthoine Hubert lost his life a few hours before. A crash and a boom. A win and a trophy.

Death is imminent. It favors none and follows all.

And yet, Charles Leclerc at the age of 22, feels its shadow linger near. Never close enough to him, no.

It lingers right there, on the podium, in the trophy, in his anthem, in his legacy.

It gazes, but never touches.

Some days he wished it did.

After all, no one can truly best the perfection of the dead.

‘You can see the celebrations starting. He’s got one more corner, the famous Parabolica to go. Mercedes threw everything at him today. Charles Leclerc has coped brilliantly!

He won in Spa! He wins in Monza!

Charles Leclerc is the winner of the 2019 Italian Grand Prix!’

Monza is another type of beast. It’s godly. It paves the way for anyone, but it spreads the ocean for scarlet.

The confetti falls gently. Lewis Hamilton bathes him in champagne.

He points at the sky. He points at his suit. He looks above.

He sees the Sun.

He shakes his head, laughs in disbelief. Wipes his eyes.

Charles Leclerc wins.

‘On this Sunday afternoon, the Tifosis celebrate, what an epic race—’

Charles got so preoccupied with red he forgot about blue. Dark, mysterious, never ending blue.

Always there. Never far.

This cloud of rain that followed him around, dripping on the track.

Drip, drip, drip.

A puddle was created.

He pushed blue.

Disqualified the both of them.

He doesn’t regret anything. If he’s not winning, no one is.

Austria 2019 was a blur of purple. A blur of hate.

His blood was pumping. Pupils dilating. Eyebrows furrowed.

The PR training didn't matter in that moment.

Charles Leclerc doesn’t just lose.

He opened Instagram’s purple icon, went to his followings.

Typed in ‘Max Verstappen’.

Pressed the button, made it turn blue again.

2020 comes and goes. The quarantine unfamiliar. Unknown. More people gain shadows, and there’s an inkling at the back of his mind that his might finally touch him.

But there’s no time.

He can’t wait and waste his time with things like fear.

Every win, every overtake is not his alone.

So Charles holds his breath and anticipates.

The sky sees. The clouds look back. His phone charges.

He’ll admit, while he doesn’t think he will ever have a teammate which he wouldn't deem his rival, Sebastian Vettel would always be a special case. Would always hold a special place in his pool of a heart.

So it hurt.

It wasn’t Seb’s fault at all. For the first time in his life, Charles Leclerc felt something else towards the prancing horse.

Admiration and hopes were temporarily hidden behind confusion and hurt.

This time the shadow didn’t touch or tap or even come closer.

So why was he alone again?

Why was he leaving?

Please don’t leave!

Don’t leave.

A ring cut through the silence.

He declined.

Charles knows hurt and sadness, anxiety and fear. But that’s too many things to account for, he can't be writing them all in his notebook. Seb wouldn't.

So he writes a piece of paper with ink, doesn't let it dry, crumbles it and puts it in a little red box. A label lays on it.

Rage.

2021 happened, that’s for sure.

Shit car, shit luck, shit strategy, shit Charles.

Oh, and a new teammate.

A win stolen.

But it’s ok. It’s fine.

Patience is something he has learned the hard way, honed it to be his comrade.

Silenced, his phone’s screen flashed at 5:58 AM.

He ignored.

2022 is here and so is Charles.

Bahrain. A dream on the precipice of flowing over the rim of the glass.

He won.

He won!

The season had started off on a good note.

In a good car.

It was now on his shoulders to bear the expectations. Not just of others and his own, but also the expectations of the dead and their wishes.

Hope is a scary, scary thing.

It runs along with failure and when you least expect it, it catches its arm while it plummets in the abyss.

Drags it along, one drag at a time.

Saudi Arabia was a close call, but the clouds overtook him.

That’s ok.

He’s just starting.

He’s got what it takes. He knows he does.

So, for the hundredth time, why?

Goddamnit, why?

Every time. Every time he lets himself want.

This happens.

Charles Leclerc wins in Australia.

Charles Leclerc loses in Imola.

Loses in Miami.

Loses in Spain.

Loses in Monaco.

Loses and loses and loses.

But he’s always been special to Austria.

And Austria seems like it wants to be special to him.

He’s always got a knack for the raging bull. Specifically the blue one.

He crosses the finish line and Charles Leclerc smiles. Eyes squinting in the face of the screams. Cheeks pulling upwards. He runs to that podium.

Charles Leclerc grins at the cloud, at the sky.

The cloud pours and Charles Leclerc laughs.

Turns around, shakes his head and looks at it in the eye. His one constant. Grief can't touch the fastest after all.

There is hope.

It was blatantly obvious after a few more races, that Ferrari had no clear vision on how to improve its car.

So he lost.

He had the championship cup in his hands, and it slipped through its fingers. Rolling away on a slope.

So he lost.

He got second, but second was never what he aimed for.

This time, when his phone rang, Charles Leclerc anticipated it.

A thunk was heard. A crack was felt.

Whether it was his phone screen or his heart, Charles didn’t know.

He broke.

He doesn’t know if it will ever get better or heal. Everyone tells him scars heal with time, yet his is infected.

He can’t do this. Can’t hold this weight.

Why does he still call?

Why?

Grief still knows my number, and I don’t have the heart to block it.

2023 rolled around and there was nothing he could do about it.

There was nothing Ferrari could do about the absolute hindrance of a car that they had created.

A tractor would’ve at least given him more consistency.

It was out of his hands, but maybe he never had it in the first place.

His heart had been hanging out to dry for a while, yet the humidity kept it aching.

So for the first time in his career, summer break rolled around and Charles Leclerc breathed.

The shadow has retreated.

So with that in mind, you could see how it was a pleasant surprise.

Pole positions, podiums. No wins yet, but the Sun was shining, the Earth rotating and its core waking up from its slumber with slow, but assured movements.

Fred Vasseur is in.

Finally for the first time in years, Charles felt the warm embrace of a calm figure in his life, who understood his struggles.

Finally for the first time in years, Charles Leclerc was first. Not in the championship standings, in his own.

The dead may be honored, but they are gone. They can be remembered.

The living are here. They can’t be put to wait in line, life doesn’t wait for people to catch up.

His blood is rushing, his lungs expanding, eyelids blinking, thoughts running.

He’s alive. He’s here. He’s important.

Charles Leclerc races in Las Vegas for himself. He fights for himself. He forgives for himself.

Max races after him to apologize but Charles has already moved on. He doesn’t hold grudges anymore.

He wraps his arm around the cloud and reassures. He smiles, eyes sparkling in the Vegas lights. Blue meets green.

He remembers and looks at the sky. His heart returned in his chest, no longer in the hands of mother nature’s fickle decisions.

Charles Leclerc makes his own decisions.

After Abu Dhabi, his phone rings again.

In the first time in 6 years, he answers.

It’s quiet for a while.

The number you are trying to contact is inactive. Please try again.

At least he tried.

A ping was heard. A message arrived.

Papa <3

He remembers the adrenaline, the confusion. He froze for a moment, but recovered quickly.

He replies.

Papa? Are you there?

Unseen, unanswered.

And yet, he’s content.

He sleeps and dreams, and legacies don’t plague him.

He sleeps and he wakes up the next day, calls his maman.

“Hey maman. How’ve you been?”

Charles Leclerc is familiar with Grief’s number, as much as he’s familiar with his own.

2023 ends. But he’s just getting started.

The winter break came and went in the blink of an eye.

Contract extensions, announcement dates, livery showcasings and more.

Air enters his lungs and he lets himself feel.

5 wins this year, that’s the goal for now.

A small step backwards for a giant leap forwards.

Charles Leclerc is ready, has always been.

Rage in one hand and pride in the other, he steps forwards.

Blue on his side, as was meant to be. Blue meets green, understanding in between.

The crown on his head high and bright, and well deserved. His accomplishments and wins.

The cape down his back is theirs. He’ll let them have this.

After all, the championship will be his.

‘Charles Leclerc. Prince of Ferrari. King of Monza. Legacy of Monaco. What a star of the future! Celebrating wildly in the present!’

Please note that no matter how much I am writing here, it is all artistic speculation of what Charles himself has decided to show the world. Do not forget that these drivers are real people.

All of the italicized sentences that start and end with ' ' are actual words said for Charles, either by Netflix, Will Buxton, Crofty or other documentaries.

The phone ringing from a person that has already passed away, has happened to me and my mom. So it directly inspired me.

Time for some clarification of my analysis:

The wound is grief showing its head at the very start of this.

The cape is Ferrari obviously.

The Earth's core and its molten metal is always Charles himself.

Every correlation with a phone/phone call is Herve's, except the specific Jules one.

Every time the heart is mentioned it mostly means Jules grief.

The ventricles are the two lower chambers of the heart, which in this case filled up first, which is why it weighed him down.

The atriums are the two upper chambers, which are slowly overflowing.

Herve died exactly 4 days before his F2 Baku race, that is why the time stops at 4.

Red is Ferrari.

He holds onto the hoof and hear a neigh. This is Ferrari's prancing horse.

The Sun is hope, the unachievable.

The clouds and the color blue are always Max Verstappen, including the blue raging bull.

The sky are both Jules and Herve.

The shadow is always death in every mention.

Purple is the conflict and the brief pushing from Max on Austria. It shows an intriguing way of which even when they are fighting they are always in sync.

The notebook is the habit he picked up from Sebastian.

His one constant in life that will never leave is Max Verstappen. He calls him the fastest despite not knowing how the results of the 2023 season.

The message for anyone temporarily confused says: I'm proud. Its more of a sign that Charles has finally started racing for himself, has let go of some of the self-afflicted responsibility to hold the dead's wishes.

Every blue colored things is Max Verstappen.

Every red colored thing is the intense feeling that Ferrari gives him, every win makes him soar, but every loss digs him deep.

The title of this work is inspired by someone on social media showing their own experience of old phone numbers calling.

No one can best the perfection of the dead is a quote from Aya, in Bungou Stray Dogs season 5, which I thought was exactly what this fic needed.

31/05/2014 — @queerascat coined maverique as "a non-binary gender characterized by an unconventional and unothodox internal sense of self and the interrelationship between that sense of self and society"

15/06/2014 — queerascat reworded the definition as: "a non-binary gender characterized by autonomy and inner conviction regarding a sense of gender which is unorthodox, unconventional and entirely independent of conventional concepts of gender". they created the maverique flag on the same day.

18/06/2014 — tearun suggested maver as an equivalent to man/woman and rique as an equivalent for boy/girl, the latter was never heard of again due to it sounding like "reek"

my favorite background moments in falsettos (2017)

this is purely because i am insane. it's a very long list. i might make a similar post for the bootleg of the original broadway cast because they are also very dear to me. anyway, list is below the line!

3:50 ("four jews in a room") during the last chorus, whizzer + mendel starting spinning in a circle as opposed to dancing normally

3:54 ("four jews in a room") trina accepts a piece of the block from marvin and grabs at the back of his head, seemingly picking something out of his hair and tossing it to the ground

17:16 ("marvin @ the physiatrist") following whizzer's "part two", marvin looks over at him and smiles (i can't tell if this is christian to andrew or if it's supposed to be in character)

21:55 ( "my father's a homo") as jason says "my mother's no wife" and "my father's no man, no man at all", both trina and marvin react to their relative assessment. trina stops for a moment and shoots jason a stern look, while marvin turns back at each repeat of 'no man' to stare desperately at him.

25:34 ("everyone tells jason to see a physiatrist") whizzer grins at jason encouragingly following his line "absolutely, jason"

43:16 ("a tight-knit family reprise") following mendel's line "it's embarrassing" marvin looks to whizzer and says "you're watching embarassing" (i'm like 90% sure on this one haha)

43:18 ("a tight-knit family reprise") as marvin's pushing jason away as he's on the cube, he says to him "i can't look at this jackass"

43:55 ("a tight-knit family reprise") after mendel and marvin arm wrestle, whizzer and jason exchange a look

49:50 ("trina's song reprise") trina reemerges having changed costumes, her outfit now including a beaded bracelet we see mendel wearing earlier on in the show

54:57 ("the chess game") as whizzer is yelling at marvin (and the audience) about marvin's absurd expectations, marvin says "come on" and "is that all you got?"

56:00 ("making a home") jason retreats to the background to set his chess board down as well as push in a looser block - not sure if this is just anthony fixing the set or if it's supposed to be in character. he then proceeds to watch trina + mendel setting up the couch before looking up/out to the audience as they do (with the lines "what it needs is people/men and women talking"). he does the same thing at 57:30 during the second chorus

56:23 ("making a home") whizzer is pulling out his clothes from inside one of the blocks, similar to how trina retrieves the couch throw pillows later on

57:08 ("making a home") the photographs they set on the mantlepiece appear to be historical family portraits; the one in the back is most likely trina as a child with her parents, and the one in front are mendel's parents (judging by the era of clothing)

1:03:40 (marvin hits trina") rather than use an instrument (like a clapper), whizzer uses his hands to make the slapping sound

1:05:22 ("i never wanted to love you") marvin and whizzer's eye contact lingers after whizzer's part. i'm curious what you all think christian's trying to express here - to me it looks like he's about to start crying before he turns away.

1:20:00 ("miracle of judaism") when the family erupts to tell jason the second ball is coming, marvin says something along the lines of "there's a...there's a what, what's happening - he's not looking". also, each character reacts in their own unique way. i love cordelia in particular because when jason looks over, she waves first before pointing to the ball

1:21:18 ("the baseball game") this is similar to the previous, i love focusing on what each character says.

cordelia: you're kinda choking up, buddy (motioning to the way jason holds his bat)

charlotte: next inning, jason, next inning

mendel: get your head in the game, think about the footwork a little bit

marvin: it's alright buddy, you'll get 'em next time

trina: you have eight more innings, my love!

1:22:40 ("the baseball game") cordelia + charlotte realize who whizzer is and are shocked, and then quickly try to appear nonchalant about it (1:22:50 you can see charlotte rest a hand on both cordelia and marvin's knees before all three adjust in their seats and separate)

1:23:16 (during "the baseball game") the lesbians nod encouragingly at marvin after whizzer asks "is he still queer?" (i absolutely LOVE this detail it's so cute lolol)

1:30:24 ("a day in falsettoland") cordelia reacts to charlotte's line "...lightbulbs up the ass" by dropping her smile + staring off into the distance in horror

1:30:33 ("a day in falsettoland") following charlotte's line "people overdosed and i saved them", cordelia nods at her + says "yeah, you did"

1:31:06 ("a day in falsettoland") charlotte laughs in shock when cordelia says "...and i save chicken fat"

1:35:25 ("everyone hates his parents") following trina's line "you have paintings of dicks/don't talk to me about taste", she + marvin have the following interaction:

marvin, smug: those are french

trina, exasperated: really?

1:43:15 ("something bad is happening") charlotte holds a copy of JAMA aka the "Journal of the American Medical Association". i'm unsure the larger magazine is

1:50:55 ("days like this") prior to the song beginning, whizzer says either "marvin" or "mornin'" to marvin

1:52:45 ("days like this") marvin turns and says something to whizzer (i can't figure it out and its KILLING ME) as mendel sings "go ahead, be good and pissed/how can i help, says the wiry pyschiatrist"

1:54:00 ("canceling the bar mitzvah") as jason gets up and walks downstage, trina nods in his direction - can't tell if this is her communicating with mendel or marvin, or perhaps both

2:01:30 ("unlikely lovers") following whizzer's line "i love friends that hover", charlotte reaches over and playfully pinches his shoulder

2:09:30 ("jason's bar mitzvah") while trina is singing "probably it's doubly useful/at a time like this", mendel says something akin to "you don't have one/you don't have some?", most likely to jason in regards to the champagne

2:09:38 ("jason's bar mitzvah") after saying cheers, marvin first looks to whizzer and then to jason - presumably because this is jason's first time drinking alcohol. my guess is that he says "good?", asking for jason's opinion on the champagne

2:09:50 ("jason's bar mitzvah") while whizzer sings "please excuse me if i interfere", mendel and marvin have a brief conversation about the cubicle curtain. it's fairly inaudible so i'm not sure of the exact wording

2:12:00 ("jason's bar mitzvah") as marvin is fixing jason's tie, he whispers to him "relax, relax". while the cast sings "like marvin", marvin continues speaking to jason by saying "is that so hard?"
