Yeah. I tried to back off from it yesterday and hide in 2 to escape the cringe, but there's just no mistaking the 3 fix now I am aware of it. I actually am amused at watching myself react to this typing, because on one hand, there's all this pride at being the most "get shit done" tritype (absolutely true) and all this shame at being called a Karen. You know, the "I want to talk to your manager!" type.

Which I would never do, because it's so cringe/rude/entitled.

I started laughing this morning, because I was complaining about how disorganized a podcast I listen to is; they start in on a series and promise they're going to follow through and then get sidetracked and start another series, so I'm left waiting for the continuation of the first series five months later and getting annoyed at how disorganized they are, when they should have just scheduled it and completed it.

It is a weird combination -- ENFP and 613, but it explains a lot. I even had one Enneagram enthusiast who is into MBTI say it stunned him at first, but then it "explained everything about you, and why you don't fit either the 613 Karen stereotype or the flighty ENFP one. You are too emotional and idealistic for an STJ, but also weirdly logical and willing to accept criticism and follow through on things."

So, I'll accept it. Tho, I think 3w2 over 3w4. I am project-oriented, but also people-y and I just see a lot of 2. And I might be 631 instead of 613. I think image-second is where some softness (what some of you have called the "big sister" energy) is coming from.

Diferença entre auxílio-acidente e auxílio-acidentário

O auxílio-acidente, também conhecido como auxílio acidente de trabalho ou auxílio acidentário está previsto no  o artigo 86 da Lei 8.213/91, é um benefício de espécie indenizatório concedido aos trabalhadores segurados pelo INSS que tiveram a sua capacidade para as funções habituais comprometida de forma permanente, em decorrência de acidente ou doença.

Diferença entre auxílio-acidente e auxílio-doença

A diferença entre o auxílio-acidente e o auxílio-doença é que este substitui o salário do empregado, uma vez que é considerada a incapacidade temporária. Já o auxílio-acidente é indenizatório, e complementa o salário mensal recebido pelo empregado.

Quais são os requisitos para concessão do auxílio-acidente?

Os requisitos para o recebimento desse benefício são:

consolidação     da lesão,

possuir     qualidade de segurado,

redução     parcial ou definitiva da capacidade para a função habitual,

nexo     causal entre a doença/acidente e a incapacidade.

Auxílio-Acidente: 6 fatos pouco conhecidos sobre o benefício

1. A Incapacidade para o trabalho deve ser parcial .

A Incapacidade parcial é quando o trabalhador pode trabalhar, mas com certas limitações para a função que exercia. Por exemplo, um vigilante que não pode mais portar arma por alguma doença psiquiátrica, um açougueiro que perdeu 3 dedos da mão e não tem a mesma destreza que antes, ou então um pedreiro que desenvolve epilepsia e não pode subir em altura, além de outros incontáveis exemplos.

2.Incapacidade mínima dá direito ao Auxílio

O segurado que após adquirir uma diminuição parcial e incurável na sua capacidade de trabalho devido ao acidente de qualquer natureza, ou uma doença, tem direito a receber auxílio-acidentário mesmo que a incapacidade seja mínima, ou seja, mesmo que o INSS negue o direito, o próprio STJ já decidiu que se há uma limitação funcional mínima, ainda assim o trabalhador tem direito a receber o Auxilio Acidente.

3.É permitido continuar trabalhando enquanto se recebe o benefício.

Este Auxílio é uma complementação do salário e corresponde à metade do valor que o segurado receberia caso pedisse uma aposentadoria por invalidez. Ele tem característica de indenização, logo, permite a continuidade das atividades.

4. O Auxílio Acidente pode aumentar o valor da aposentadoria futura.

O valor do benefício, sendo uma complementação de salário e somado ao pagamento mensal do trabalhador, pode dar aumento no valor da aposentadoria quando ela for requerida. Isso ocorre porque os valores em cima dos quais são calculadas as contribuições aumentam.

5. É devido receber Auxílio Acidente logo depois de cessar o auxílio-doença.

Se o trabalhador gozou de auxílio doença quando sofreu o acidente ou a doença que deixou essa sequela permanente, a lei diz que ele terá direito ao Auxilio Acidente desde o dia seguinte a cessação do auxílio doença. Se não houve pedido específico para isso, não importa, pois é o único benefício que define a Data de Início do Benefício em data que não seja a Data de Entrada do Requerimento, mas sim, a partir do dia seguinte à cessação do Auxílio Doença.

Caso o trabalhador não tenha requerido e se passaram mais de 10 anos, ainda assim terá direito a concessão desde o dia seguinte a cessação do auxílio doença, com acerto dos últimos 5 anos de atrasados.

6. O benefício pode ser acumulado com outros benefícios e será de 50% do valor do Salário de Benefício do Auxílio-Doença.

Isso acontece, pois este auxílio-acidente (B-94 ou B-36) tem caráter indenizatório, ou seja, ele não é um benefício comum do INSS, mas uma “compensação” devido a incapacitação parcial e permanente para o trabalho que o segurado exercia. Todavia, o benefício cessa no momento da concessão de aposentadoria, mas os salários recebidos são somados com as contribuições realizadas para se calcular a aposentadoria.

Auxílio acidente em 2021

Eu vou te explicar mais à frente sobre o cálculo do Auxílio-Acidente, mas já vou adiantar que essa Medida Provisória alterou, para pior, o valor do benefício auxílio-acidente.

Antes dessa lei, o valor do Auxílio-Acidente era 50% do valor do seu Salário de Benefício (SB). O cálculo do SB levava em conta a média dos seus 80% maiores salários de contribuição desde julho de 1994.

Após essa lei, o valor passa a ser 50% do valor que você teria direito se fosse aposentado por invalidez na hora do acidente.

Para você entender melhor: antes dessa lei, se você tivesse R$ 2.500,00 como Salário de Benefício e ocorresse algum acidente que reduzisse sua capacidade para o trabalho, você teria direito a R$ 1.250,00 de benefício.

Agora com a nova lei, você tem que calcular o valor que você teria direito caso fosse aposentado por invalidez na hora do acidente.

O cálculo para saber o valor da Aposentadoria por Invalidez é feito dessa forma:

Para acidentes ocorridos até o dia 12/11/2019

é feita a média aritmética dos seus 80% maiores salários de contribuição desde julho de 1994; você recebe 100% do valor dessa média como valor de aposentadoria; o valor do Auxílio Acidente será 50% desse valor.

Para acidentes ocorridos a partir do dia 13/11/2019 (entrada em vigor da Reforma da Previdência)

é feita a média aritmética de todos os seus salários de contribuição desde julho de 1994 ou desde quando você começou a contribuir; desse valor, você receberá 60% desta média + 2% ao ano que exceder 20 anos de tempo de contribuição para os homens ou que exceder 15 anos de tempo de contribuição para as mulheres; em casos de acidente do trabalho, o valor da Aposentadoria por Invalidez será 100% do valor de todas as médias do seus salários de contribuição. o valor do Auxílio Acidente será 50% do valor que resultar esse cálculo.

O cálculo piorou muito, porque antigamente você recebia o valor proporcional ao seus maiores salários de contribuição, e agora com essa nova forma, você recebe proporcional a todos (não só os maiores) os seus salários de contribuição, o que pode reduzir, e muito, o seu benefício.

Por exemplo, imagine a situação de Maria que teve 17 anos de tempo de contribuição. Ocorreu um acidente (não relacionado com o trabalho) com ela em dezembro de 2019 que deu direito a solicitar o Auxílio Acidente.

A média de todos os seus salários de contribuição está no valor de R$ 2.000,00.

Fazendo o cálculo, ela teria direito a 60% + 4% (2% x 2 anos acima de 15 anos de tempo de contribuição) = 64% de R$ 2.000,00 = R$ 1.280,00 de Aposentadoria por Invalidez.

Como a lei fala que Maria tem direito a 50% do valor que ela teria direito se aposentando por invalidez, 50% de R$ 1.280,00 = R$ 640,00 de Auxílio Acidente.

Atenção: esse benefício pode ser inferior ao salário-mínimo, porque ele tem natureza de indenização.

Agora imagine se o acidente tivesse ocorrido antes do dia 13/11/2019, e que ela tivesse uma média dos 80% maiores salários no valor de R$ 2.200,00 (o valor aqui aumentou porque foram descartados os 20% maiores salários).

Ela teria direito a 50% de R$ 2.200,00 = R$ 1.100,00 de Auxílio Acidente.

Viu como a diferença para a Maria antes e depois da Medida Provisória chegou nos absurdos R$ 460,00 por mês?

Em 20 anos, a Maria perderá mais de R$ 110.400,00, isso é muito dinheiro.

Mais uma possibilidade de cancelamento do benefício

A lei nova também criou mais uma hipótese do benefício ser cancelado.

O segurado perderá direito ao Auxílio-Acidente se sua sequela for revertida. Ou seja, caso sua capacidade de trabalho não esteja mais reduzida, por melhora na sequela, você não terá mais direito ao benefício.

Assim, você pode ser chamado para uma perícia média de tempos em tempos, para avaliar sua capacidade para o trabalho, o famoso pente-fino.

Essa inclusão foi bem justa, porque não faz sentido o governo pagar para alguém que está com plenas condições de trabalho.

Isso já acontece com a Aposentadoria por Invalidez, por exemplo. Se a pessoa não é mais inválida, ela perde direito a aposentadoria.

Somente as sequelas previstas em lista elaborada pelo governo podem dar direito ao benefício

A partir da Medida Provisória do fim de 2019 que comentei agora há pouco, você só terá direito ao Auxílio Acidente se sua sequela estiver prevista numa lista elaborada (e atualizada a cada 3 anos) pela Secretaria Especial de Previdência e Trabalho do Ministério da Economia, de acordo com critérios técnicos e científicos.

Provavelmente essa lista de doenças e acidentes poderão ser equiparadas a outras. Por exemplo, se na lista estiver a tendinite como uma sequela e a tenossinovite (uma doença bastante parecida com a tendinite) não. 

Isso não quer dizer que a tenossinovite não é uma moléstia que não dá direito ao Auxílio Acidente.

Por equiparação das doenças, poderíamos dizer que a tenossinovite dá direito ao benefício.

Acidente ocorrido entre a casa e o trabalho, e vice versa, não é mais considerado acidente de trabalho por equiparação

Existem 3 tipos de acidente de trabalho atualmente:

acidentes     que acontecem dentro do ambiente de trabalho (ou fora dele, enquanto você     estiver trabalhando);

doenças     profissionais e do trabalho, como a Lesão de Esforço Repetitivo;

acidentes     de trabalho atípicos.

Quanto a esse último, uma das hipóteses previstas em lei é que o percurso entre a casa e o trabalho do segurado (e vice versa), qualquer que seja o meio de transporte (inclusive carro próprio da pessoa) é equiparado a acidente de trabalho.

Mas essa lei mudou isso e agora o percurso entre o trabalho e a casa, e vice versa, não é mais considerado acidente de trabalho.

Isso reflete no cálculo do benefício, uma vez que o valor do Auxílio Acidente agora é feito com base no cálculo da Aposentadoria por Invalidez. 

Como eu te disse antes, se a pessoa sofre um acidente de trabalho, ela terá direito a 100% do valor do benefício da Aposentadoria, aplicando, nesse valor, 50% para chegarmos ao valor exato do Auxílio.

Existem 3 tipos de marcas hoje: acidentes que ocorrem dentro do ambiente de trabalho (ou a partir dele, enquanto você trabalha); Doenças e trabalho profissionais, como esforço repetitivo; Acidentes de trabalho atípicos.

Isso reflete no cálculo do benefício, uma vez que o valor da ajuda acidental é agora baseado no cálculo da aposentadoria da deficiência.

Como eu lhe disse antes, se a pessoa sofre de um acidente de trabalho, será permitido 100% do valor do benefício da aposentadoria, aplicando, a este valor, 50% para atingir o valor exato da ajuda.

Adquirido | Bons grupos de notícias para a lei adquiridos, acidentes/doenças que ocorreram até 11/11/2019 (um dia antes desta medida provisória para entrar) observará as regras de acordo com a lei antiga.

Se este for o seu caso, você terá direito a todas as regras antigas, como:

A forma de cálculo será a mais vantajosa (50% do seu salário de lucro); O acidente do curso entre a casa e o trabalho do seguro, e vice-versa, serão considerados um acidente no trabalho; Você não precisa se preocupar se o tipo de sua sequela estiver na lista do secretário de pré-visualização especial e do trabalho; Seu lucro não pode ser cancelado se sua capacidade de trabalho não for mais reduzida.

Isso ocorreu porque o fato gerador (o acidente) ocorreu quando a antiga lei existia que eles tinham essas regras mais úteis.

Agora, se o acidente que tenha feito você abaixar sua capacidade de trabalhar, aconteceu de 12/11/2019 (quando a medida provisória terá efeito), você será abatido por essas novas regras.

Boas notícias, pois esta nova lei é uma medida temporária, dura apenas 60 dias (extensível por 60 dias adicionais), mas pode ser convertido em direito comum.

Para este fim, o poder legislativo deve apreciar esta medida provisória e ver se é transformada ou não legalmente.

No processo eleitoral, eles apostarão em alguns pontos da medida provisória, incluindo as regras mais malignas para o seguro, então nem tudo é perdido.

Aquele que tem doença profissional, recebe uma doença acidental e, em seguida, é uma consequência que reduz sua capacidade de trabalhar, também tem o direito de se beneficiar da ajuda acidental. Isso ocorre porque uma doença profissional é considerada um acidente de trabalho legalmente.

Ao pedir que a ajuda acidental pare de exigir a vantagem, é muito simples, apenas planejar a experiência médica da aplicação ou site, e requer planejamento para uma doença comum.

Se o benefício for rejeitado para o seguro, pode entrar em ação no tribunal federal para forçar a questão a dar a vantagem.

Hmm, probably Rex! As much as I love writing for characters like Obi-Wan and Luke, they’re pretty close to me in personality and don’t require me to stretch my imagination like Rex does (EN/STJ-A? Something like that?). Especially for The Lovers, the Dreamers, and Me, I felt like as the MC was getting to know him in a more genuine way, so was I (insofar as I was interpreting his character).

I often struggle to balance style and substance :/ In some fics like “these are the nights,” “Quarter to One,” and “Aviarium” to name a few I think I lean too much on style and rhythmic flow. (But it’s worth mentioning that I made similar artistic choices in “hos g’amphipiepon” and “Phantom Limb” that I stand by).

I will always prefer to write alone (if not alone, in an area I won’t have a lot of conversation noise), but I almost always have music in the background. I also like to alternate between playlists depending on the fic’s Vibe. Sometimes I can write with a movie/tv in the background, but only if I’m watching something related to what I’m writing.

It's not reading people in general, it's more having an intuitive insight into their emotions (what they could be/likely are feeling) that gives me emotional intelligence and depth of emotion. It's specifically oriented toward people and their feelings -- being considerate of their emotions, understanding of any emotion that arises (and tolerant of it), and mindful of that when making decisions. I am also good at sensing people's potential and encouraging them to live up to it in a way that is quite different from an ESTJ. Inferior Fi users are very protective of their own feelings but not very good with other people's feelings -- in considering them or prioritizing them. The STJs in my life just say whatever they think without thinking about how the feelers around them are going to emotionally interpret it. It may be true to what THEY feel (eg: that's stupid, ridiculous, irrational, I hate this movie so much, why are we watching it?), but it's not at all attentive to how their feelers are going to be offended by it.

I watched or more accurately *tried* to watch the first episode of Lie To Me and didn't last 20 minutes. Good Lord, whatever type the main character is he's ridiculous, I can't believe people actually believe that would work in real life. It's like Sherlock making absolutely impossible but always super accurate discoveries from like a speck of dust. It's like whoever wrote these  characters once met someone really good at figuring things/people out and then tried to imagine how they did it instead of just asking. The female cop was very realistic though, her guesses made sense.

The main character is an 8 ESTJ and yes, he's exaggerated for theatrical affect, but he's based on a real-life STJ (not an 8) who earns a living teaching people to read micro-expressions.

Even as an INFP I found your Typing STJs rather true and helpful. I just wanted to say that even if Te's lower on the spectrum like it is with me as an INFP, I too will seek out relevant information or answers to questions. Whereas my ISTP Dad will break everything down, only to get to the point maybe half an hour to an hour later, and my INTP sister who will begin questioning my methods and questions, and if that drives me crazy, I can't imagine how much it might drive an STJ crazy.

I can see that happening, with lower Fi and I’ve heard similar complaints from my ENFP brother getting frustrated with my ISTP father. To be fair, this also happens to some extent the other way around to high Fe users when dealing with moral issues, where Fi users want to have lots of context on issues of morality and Fe users are just like “okay but this is what we need to do”. I feel like it might be heightened in that logic is more inflexible? But also I am a Te user and so it’s easier to say “this really annoys me” than “huh, I probably am very annoying to this other person.”

But yes it drives me absolutely up a wall. You know the Carl Sagan quote about how, to make an apple pie, you must first construct the universe? I mean, technically yes, everything is connected and the conditions that led to the evolutionary development of apples and wheat and cows and sugarcane and such all track back to universal constants and the fundamental laws of physics, but like...you don’t need to create the conditions for the evolution of the apple to make an apple pie. The apple is already there. And more notably, if I want to eat an apple pie tonight, I can make the apple pie now and learn about the physical constants of the universe that made apples possible later. I can in fact do that while eating the apple pie.

But I think it comes down to all functions have their frustrating quirks. Te can oversimplify and either end up having to brute-force a solution, or miss something important. Ti on the other hand can neglect to acknowledge that sometimes, you have constraints that make it unwise to try and understand every tiny aspect of a vast and complex system, or fails to understand that an elegant solution is great, but an inelegant solution to a crisis today is better than an elegant one a month from now.

A/N: This is more like him realising his feelings then trying to catch your attention and how you got together tbh, but hope you like it!

It took him forever to even realised he had feelings for you.

Mikhail was the one that helped him realise his feelings.

He would always be a little shy around you.

More quiet than usual around you as well.

But fully interested in your topics of discussion.

He didn’t realise how he always had a small smile on his face and slightly pink cheeks.

Yuily would also keep an eye on you and wouldn’t really understand when he would get angry when you talk at a man that’s close to your age, especially Mikhail.

But he ignored what he was feeling, maybe it was the mission that was making him act weird? Or he was tired? He didn’t really know nor did he dwell upon it.

He had better things to think about.

Like you.

Mikhail was the one to notice his little brother’s interest in you and he purposely tried to make him jealous after he confronted Yuily and denied any claim he would be thrown regarding you.

So the older brother had to demonstrate his claims with proof.

“Hey (Y/N),” Mikhail’s arm would swing around your shoulders and pull you in his side, “how are you doing?”

Mikhail couldn’t help but smirk as Yuily frowned more and more.

You didn’t really understand what he was doing because he disappeared as quickly as he appeared.

“See little brother?” Mikhail could not conceal his smirk as he watched his brother grumble under his breath, knowing he must be right.

“Sooo, what are you going to do about it, huh?”

Mikhail’s grin falling immediately when Yuily says “nothing”.

“Seriously? You like her, ask her out or I’ll embarrass you,”

Yuily knows his older brother will do just that but he doesn’t want to ruin your friendship.

If he could even call it that, ever since his brother helped him sort out his emotions, he sort of started distancing himself because he didn’t know how to deal with it.

After much frustration, Mikhail decided to help his brother -- only to find his feet though, he needed to learn.

And be teased, like every brother would around his crush.

Mikhail would embarrass him in front of you to try and get you to notice him.

Does it work?

Lol, nope!

So Yuily just tries to get close again.

You were nice enough to start from a clean slate.

And immediately hit it off.

It was so fun between the two of you, he loved you even more but now he was even less inclined to ask you out because he loved what you two had together.

But thankfully, you felt the same way about Yuily and approached his brother for advice for obvious reasons.

Mikhail would know exactly what Yuily likes and maybe if he likes you back.

Thankfully for you, Mikhail was already pretty frustrated with Yuily for still not having done anything.

“He likes you as well, just kiss the pour soul.”

And blushing instantly when he says that as he shoos you away.

You took a while to make your move.

And Mikhail actually thought you were going to act like Yuily and never do anything about it either.

But one night, you got upset as something someone said and you ran into the garden when the moon was out.

And you stayed there a while because it was so beautiful to look at.

Yuily didn’t hesitate to follow you out.

He sat right next to you, close and everything.

Mikhail’s ship finally sailed.

Yuily was really good at comforting you and when you felt better, you turned to him and distinguished his pink stained cheeks.

Fortunately, he didn’t dare move and you slightly grasped both his cheeks and lowered his face closer to yours.

He let you take the lead, slowly closing his eyes as you captured his lips in yours.

His arms slowly etched up to your hips and around your waist, pulling you closer into his chest.

You were sure you heard Mikhail make a small cheer in the house.

Your fingers ran through his hair as you both pulled yourself closer to deepen the kiss.

And when you pulled away, you were both blushing messes.

“That was uh,” moving away from him a little.

It was his turn to make his move and he pulled you pack into his side, kissing your temple.

That how it aaaall started.

To be fair to you it started when I made angst for stj roof - Roof Cat

I don’t know what I did to start this besides exist and have the capability to imagine an AU and put it on the internet. I did not know this would happen by me making an AU I was sure would die out a week after it started. If I did I’d probably would’ve been more hesitant to post it
