ICJ Ruling
Okay, let's get into this.
First of all, I get the frustration at the court not ordering a ceasefire. I was disappointed and frustrated at first too, since a ceasefire was the biggest and most important preliminary measure South Africa was requesting - and of course we just all want this horror to finally end for the people in Gaza. So I get the frustration and disappointment, I really do.
However, I do think this ruling is still a major win for South Africa, Palestine, and international law as a whole and here's why:
The court acknowledged that it has jurisdiction over this case and completely dismissed Israel's request to throw out the case as a whole. It will now determine at the merits stage (that will probably take years) whether Israel is actually commiting genocide.
The court acknowledged that Palestinians are a "distinct national or ethnic group and therefore deserving of protection under the genocide convention". Pull this out next time someone tells you "there's no such thing as Palestinians, they're all just Arabs".
The court acknowledged very unambiguously that "at least some" of Israel's actions being genocidal in nature is "plausible". South Africa has a case, officially. Israel is accused of genocide, in a way the ICJ deems "plausible", officially. This is huge. (And seriously, how freaking satisfying was it to hear all of those genocidal statements by Israeli politicians read out loud and used as justification for this rulling?)
The court might not have ordered a "ceasefire" in those words, but they did order Israel to "immediately end all genocidal acts" (which includes killing and injuring Palestinians) and submit proof that they actually did. How are they going to comply with this ruling without at least severly reducing or changing what they're doing in Gaza?
In fact, this wording might actually be more appropriate for a genocide (vs a war), as author and journalist Ali Abunimah notes on Twitter:
Tumblr media Tumblr media
He's completely right. Israel lost today, by overwhelming majority (I mean, 15 to 2? I heard people predict the rulings would be very close, like 9 judges vs 8, but instead we got 15 to 2 (and even 16 to 1 on the humanitarian aid). Holy shit.) The court disimissed almost everything Israel's side of lawyers said, while acknowledging that South Africa's accusations are "plausible".
And this is important especially because of Mr Abunimah's second tweet there^. Because the question is, where do we go from here?
This ruling means that Israel is officially /possibly/ commiting genocide and that should have huge international consequences. The rest of the world now HAS to take these accusations seriously and stop arming and supporting Israel - and if they won't do it on their own, we, the people, have to make them. This is THE moment to rise up all around the world, especially in the countries most supportive of Israel (the US, the UK, Germany): Protest, call your representatives and demand a ceasefire and an end of arms deliveries to Israel.
We now have a legal case to back our demands: If Israel is, according to the ICJ, "plausibly" commiting genocide, then all of our governments are, according to the ICJ, "plausibly" guiltly of aiding in genocide. And we need to hold that over their heads and demand better. We need to do that right now and in huge numbers. Most politicians only care about themselves and saving their skin. We have to make them realize that they could be accused of aiding in genocide.
(As a German, I'm thinking of Germany here in particular: After South Africa's hearing, our government dismissed their case as having "no basis" - how are they going to keep saying that now that the ICJ officially thinks otherwise? Over the last months, people here have been arrested at protests for calling what's happening in Gaza a genocide. How are the police supposed to legally keep doing that now that the ICJ has officially deemed this accusation "plausible"? I used to be scared to use the word "genocide" at protests or write it on my protest signs - not anymore, have fun trying to arrest me for that when the ICJ literally has my back on this one 🖕🏻.)
So yeah - don't be defeatist about this, don't let Israel's narrative that they "won" (they didn't) take over. This might not be everything we wanted, but it's still a good result. Don't let what the court didn't say ("ceasefire"), distract you from the very important things that they did say. Let this be your motivation to get loud and active, especially if you live in any country that supports Israel. Put pressure on your governments to not be complicit in genocide, you now officially have the highest international court on your side.

So the South African Foreign Affairs Minister Dr. Naledi Pandor and her family are being threatened for her (& South Africa's) support of Palestine. Surprise surprise western media hasn't said a thing about it.
"I think one of the things we must not allow is a failure of courage."
She has my respect, truly. God protect this woman and her family 🙏🏾

The International Court of Justice has acknowledged a plausible risk of genocide in Gaza by refusing to dismiss the case.
The Court has found that there is plausibility of irreparable harm done to the fabric of Palestinian society.
The conditions for genocide are met.
It's literally a drop in the ocean, it's far too late but it will be a stain on the bloodied history of Israel in perpetuity.

Canada has a legal obligation to prevent and punish the genocide of the Palestinians in Gaza but has acted against that obligation by withdrawing financial aid from UNRWA, and casting doubt on its legitimacy. The allegations and subsequent withdrawal of support from UNRWA has imperilled its ability to provide humanitarian assistance in Gaza. The State of Israel has been ordered to “take immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance to address the adverse conditions of life faced by Palestinians in the Gaza Strip” by the ICJ. Accusing 12 people out of 13,000 UNRWA workers in Gaza, with no publicly-shared evidence or details of the allegations does not constitute “immediate and effective measures to enable the provision of […] humanitarian assistance” and every single country who has pulled funding from UNRWA is now aiding and abetting Israel in its failure to comply with the legally binding measures put forth by the ICJ.

ICJ Rules Israel Must Prevent Genocide in Gaza
Tumblr media
The court did not rule at this stage on the core of the case brought by South Africa – whether genocide has occurred in Gaza – but an overwhelming majority of its 17 judges presiding over the case voted on Friday for the emergency measures to be implemented.
Delivering its interim ruling, the court said Israel must take all measures within its power to prevent its troops from committing genocide, prevent incitement to commit genocide, allow more humanitarian aid into Gaza, and bring more measures to protect Palestinians, which it called a protected group under the 1948 Genocide Convention. The ruling also called for Israel to report to the court in one month on its steps to implement the measures. However, it did not order a cessation of hostilities in Gaza, where Israel’s military action has killed more than 26,000 Palestinians since the war began on October 7. Delivering the judgement, Court President Joan E Donoghue said there is sufficient evidence of dispute for the genocide case to proceed, and that the ICJ has the jurisdiction to rule on the matter.
This is what we needed to happen! Israel and the USA may try to spin this as a win since the court didnt order a ceasfire, but it's Good.
As others have said, this whole trial has become more about the integrity of the world. These orders for example are not enforceable by the court. World leaders are supposed to lead and respect those decisions.
If this case and this ruling are meaningless then that means everything is. They'd let us all die when told directly that what they're doing is approaching genocide and needs to stop? For Amazon's "freedom of navigation" through the Suez? Leaders who think they're above the law and above the people of the world but serve...profit?
This case is everything and all eyes need to stay on Palestine.
Points I wanna address since this is my post:
When told to prevent genocide only a gaslighting, manipulative piece of shit would say, "well you didn't say that meant I had to stop killing them completely now did you so if I do then who's fault is that?"
Further, a person in charge of an entire country shouldn't need a call for violence to be spelled out when they've already been told to stop commiting genocide. Again: gaslighting piece of shit.
The court didn't call for a ceasefire because they called for genocide prevention which is what they were brought to court to rule on. Genocide and it's prevention. Of which they ordered Israel to prevent immediately and that Israel does meet a couple requirements for commiting genocide as defined in the Geneva conventions.
There's no excuse but Wanting to kill people after this. They've been formally informed that they're approaching genocidal levels of destruction. Not stopping means genocide is the goal and always was and nobody is gonna humor the ppl denying it anymore. What rational person wouldn't stop at this point?? What rational people would continue justifying it? They wouldn't.

In case anyone was curious, here is article 2 from the Convention on the Prevention and Punishment of the Crime of Genocide:
Article II
In the present Convention, genocide means any of the following acts committed with
intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as
such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its
physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
And here is the link to the whole UN article
Just in case anyone needs absolute clarity that this is indeed a genocide and Israel needs to be held accountable

it actually really fucks me off to see people praising the ICJ’s decision when the Palestinians actually on the ground communicating with us are screaming to the rooftops that this isn’t enough. all the lib-brained cretins on this website crowing about ‘progress’ don’t seem to understand that incremental change means less than fucking nothing when you’re on the ground, watching your home and family and your people being bombed, systematically destroyed by israeli troops. it means nothing when you’re afraid for your life.
Palestinians don’t have the luxury of waiting, and we all know full well that Israel WILL NOT abide by this ruling. Unless greater intervention is made, the bombardment will continue; but the ICJ is a bourgeois, imperialist court, made to serve bourgeois, imperialist interests. While they have shown themselves to be more benevolent than I had expected by condemning israel and conceding that they are committing genocide, the fact that they couldn’t even ask for a ceasefire speaks volumes.
Whether it’s due to deliberate inaction or whether they simply lack the capacity to do so, the ‘international community’ is still failing Palestine. It is up to us to continue the pressure, continue the boycotts, continue the action; and to threaten greater disruptions if further progress is not made.

UPDATE:
Tumblr media
AJ is flooded right now and I can't access reports to provide more info, also: evening reporting is cancelled due to my being away to assist with a local presentation on the occupation of Palestine.
It's actually going to be a very interesting evening that I'll see about getting clips of to post here, we have a Human Rights Monitor and a woman born in the West Bank giving talks, and possibly a video call to the West Bank if tech stuff goes smoothly. This area is slow to progress, I'm hoping it will help educate and encourage others to start being active on the issue, many of the local politicians voted No to Ireland supporting South Africa's case and it galls me.
I do apologise however for the cancellation of today's reporting, you can check here at intervals to see if traffic has slowed down:

🇵🇸 Important statistics regarding "israel's" upcoming report back to the ICJ on the measures ordered on January 26th 2024.
from Diana Buttu, 25/Feb/2024: (transcribed from twitter thread screenshots)
"Israel is required to submit its response to the ICJ outlining the measures it has taken since January 26 to prevent genocide. Here is what they actually did.
Israel killed an average of 100 Palestinians per day bringing the death from 26,422 to 29,514
Israel blocked delivery of humanitarian aid including by allowing Israelis to erect a bouncy castle in front of Kerem Shalom (spot for entry of goods)
Israel allowed only on average 62 trucks of aid in per day even after committing to allowing 200 per day (though 500 or more are needed)
Israel continues to refuse to resume electricity and water supplies.
Israel has not prosecuted a single soldier for their genocidal acts. Israel has not acted to stop genocidal speech.
"We are witnessing genocide and no one is stopping Israel."
