So basically, what this says, is AI is not copyrightable by itself. You can use it as a tool but for it to be copyrightable, it must not replace human creativity or work. For example, if you ai generate a character into an existence, the character is not copyrightable until someone uses the ai image as a reference to redraw it.
It also is only copyrightable if someone takes THEIR OWN work and feeds it into ai, and the result is made from ONLY that person's work, and was generated by the owner of said original work. So if someone else takes your work and uses it to generate an image, it isn't copyrightable. If YOU generate something using YOUR OWN work, the image is therefore copyrightable because was generated by someone who made the source material.
THEREFORE, We, the artists in the U.S., HAVE FUCKING WOOOOON!!!!!!

And many traditional artists may feel: “Well, we won — now we’re protected.”
Now let’s ask the main question:
Who benefits?
The driving force behind these regulations are not artists.
The ones pushing for such laws are those who already own massive IP libraries — Disney, Paramount, Sony, Pixar, Adobe.
And then?
Who’s next?
Those who — just like AI — absorbed cultural codes, styles, compositions.
Fandom artists.
Independent creators who are simply “too similar.”
The lawyer won’t care how the work was created — by hand, by stylus, or by AI generation.
What matters is the similarity score. And a legal precedent.
AI artists will simply move to local generations and decentralized platforms.
Manual artists and fandoms will face filters and lawsuits.
And the ultimate winners will be those who patent styles and push IP protection up to 120 years.
Before you continue arguing — ask yourself a few simple questions:
• Are you sure your style is original?
• How many styles would you like to be allowed to draw in?
• How much would you be willing to pay each month to license the style you enjoy using?

Just another day of being grimmed out by Generative AI.
Two distinct spokes for me:

The second spoke bifurcates again:
I am an editor, copywriter and content creator by profession, and the glee with which so many–even close friends–skip towards AI is such a massive downer. Imagine you're a cotton spinner in the 1700s and you're down the pub with your mates and they're all hee heeing about how ace the new cotton spinning technologies are that are literally putting you and your colleagues out of work. Like it? Okay, grim but whatever. But maybe be a bit less casual when I'm thinking about how to pay my tithes and shit.
This next one I find a bit harder to say concisely, so I'll try illustrating it with an exchange I saw on cursed LinkedIn today. But it's basically when people sort of occlude the genuine complaints and fears of people in the corporate/professional sphere by making stupid or bad faith interpretations of those complaints or by throwing up the ways AI is also coming for art-as-passion. Yes, as an amateur artist (and fan of the arts), I also bemoan the impact of Gen AI on my fields of music and creative writing, as well as other formats. However, this is in parallel to the impact on my actual means of living. Myself and my professional writer friends are being rapidly squeezed out of work and it's very destabilising and scary. So, what doesn't help is for this specific conversation to get yanked off by folk who conflate this complaint with somehow pooh-poohing another vertical that's being negatively impacted. Please let professional writers be loudly scared by their pay checks being taken away. Anyway, that exchange was in the replies to this post (which I thought was a very good post):
Person A: To write is a form of self-care. Remind them of that truism. It's never about the money.
Person B: (at Person A) When you pay your bills exclusively by writing, it is about the money.
Person A: (at Person B) No Queen. That's a job. Writing is a passion-which you'll be paid for based on your skill at it. Most of us can write by the time we're 6 years old. Don't confuse the two.

idk. My like. Actual day job involves a lot of needing to know how copyright laws relate to the use of stock images and reference images in art. Like, That is an entire part of the studio I work fors legal teams monthly emails about like documenting sources and such.
And I just saw a post that had a stock model who linked his ToC. I feel so bad for this dude bc like. I prefer to respect folks wishes when it comes to how their images are being used, but he was going Full legal jargon with warnings about contacting lawyers and what not.
and basically none of his ToC was actually legally enforcable. Some of it was Actually Extremely Illegal as it would be classed as like discrimination under relavant laws. Some of it was absolute nonsense, you like need signed contracts for some of this stuff not a DA page that says them, and like. Idk. It's clear he was coming from a place of self protection and I will not fault him for it or use his images but I Desperately hope he never actually tries to go to court over any of it because he Will lose, and he will be loosing Hard.

I've seen a lot of conversation about AI and copyright going around more and more in the last few weeks, and none of them have mentioned that it's already been legally established that only humans can hold a copyright.
The case is Naruto v Slater, back in 2016. TLDR a monkey got a hold of a photographer's camera and took a selfie. PETA tried to argue that the monkey should have the copyright to the photo, and the California courts said no, the Copyright Act only applies to humans.
Last I checked, AI is by definition not human.
AI and copyright is still messy outside of that, but that aspect of it? Pretty cut and dry.
And come on, it's NARUTO v Slater. (There are other cases that back this stance up, but that's the most famous one and, again, this is the internet and the name is Naruto)
