ESA Action Alert: Comment on proposed rescission of the Endangered Species Act’s definition of “harm”

Earlier this month, the United States Fish and Wildlife Service and the National Marine Fisheries Service proposed a new rule that could limit the scope of Endangered Species Act protections.  The agencies are accepting public comments on the proposed rule change until May 19, 2025.

Background:

Currently, the Endangered Species Act prohibits certain actions that “harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect” threatened and endangered organisms. Until now, “harm” was understood to include actions that significantly impact an organism’s habitat. However, the new proposed rule change would rescind the regulatory definition of “harm,” limiting the Act’s prohibitions to actions that directly injure or kill listed species.

What you can do:

All ecologists have the opportunity to share their expertise and comment on the proposed rule by May 19, 2025. Comment instructions from the Federal Register notice:

Go to the Federal eRulemaking Portal: https://www.regulations.gov.

In the Search box, enter FWS-HQ-ES-2025-0034, which is the docket number for this rulemaking. Then, click on the Search button.

On the resulting page, in the panel on the left side of the screen, under the Document Type heading, check the Proposed Rule box to locate this document.

You may submit a comment by clicking on “Comment.”

Blackcat!reader has some type of car trouble and the mechanic is definitely trying to swindle you cause your pretty and look like you don’t know what’s going on. But you’re not stupid (cause Simon’s taught you the basics to fixing your car) and know to call Simon if anything goes array.

Simon’s there after about twenty minutes of the mechanic rambling about how it was cost 2000 pounds because blah, blah, blah— his hand immediately going to The small of your back.

Of all people, he knows your car the best.

Definitely feel like he’d immediately start going back and forth with that scamming mechanic but before he can really get it in, he glanced down at you (who’s unflinching) but tells you to wait in the car anyway.

You can tell even with the loud music, Simons got the idiot scared to even breath, and you’re sure he’s loud. He comes back to the car with a slam of the door. One hand starting the car and the other lands on your thigh. When you ask why you couldn’t hear him yelling at the guy, he gives you a glance—

“Cause you’re my kid, little girls can’t hear shit like that kitty.”

And it does nothing but make your heart beat faster and your thighs clench together.

Honestly, the creator of Arcane insisting that he never intended to imply a romance between Viktor and Jayce and that their bond is brotherly or whatever makes that one scene from season 1 the most hilariously oblivious sequence in all of TV history. Like. "We decided that Mel and Jayce hooking up for the first time and Viktor collapsing at the lab would be parallel events and we'd show it by alternating between clips of each scene. Jayce would also leave Mel's bed immediately afterwards because they called him from the hospital. What do you mean that links Jayce's budding romance with another person to Viktor's worsening condition while establishing that Jayce still prioritises Viktor over Mel. What do you mean that implies romantic subtext between Viktor and Jayce. No, we didn't mean anything like that. We did it just because." Dude what. Lmao?

This is from last summer (I found it while trying to clean up browser tabs--oops.) Anyway, it's one of many examples of critically endangered species showing an upturn in population with support. The Devils Hole pupfish is particularly imperiled because it is only found in one flooded cavern in Nevada's Amargosa Desert; the species is likely descended from fish that were washed in there by flooding thousands of years ago, and have managed to eke out a living in the hot, oxygen-deficient water ever since.

This is one of the first species ever listed under the U.S. Endangered Species Act. Devils Hole is threatened by groundwater depletion from well drilling, and after the pupfish's ESA listing there were numerous legal battles between conservationists and farmers over water usage. Water levels reached their lowest point in the early 1970s, but have been slowly rising since then.

Scientists are excited because the current wild population (at least as of last fall) is at 263 fish. That's up from just 35 in 2013, the lowest recorded population ever. There are a few hundred more in captivity, being used to breed more young for reintroduction. The hope is that this fall's wild count will break 300, a good sign for the world's most endangered fish.

(regular disclaimer that I will exaggerate big feelings for effect but at the end of the day this is fandom and in the grand scheme of things Just Ain't That Serious good? good)

okok look while I am obviously SOOO into where Arcane went with the Machine/Arcane Herald, I can get why gamers who liked og LoL Viktor would be Big Annoyed at him being totally retconned and overhauled in game. That is undeniably a totally different guy there and yeah it would be shitty to have the guy you like completely swapped out. I can especially get it if they liked the mechanical cyborg engineering aspects of his character!

BU T I keep seeing iterations of "he didn't choose anything for himself he just had things happen to him" or "he just went mystic. he used to be someone who used his genius to remake himself and now he just meditated himself into a wizard" and I am so so down to meet in the pit on those takes!! I get people not liking the less mechanical aspects of him but hhhhhhohmygod do not be taking my guys agency and genius down like that

Yes the initial full fusing with the hexcore is something that happened to him, that someone who loved him maybe too much did to him (almost like Arcane has themes of people being launched down dark paths by things that happen to them beyond their control hMmMmmmmmm!!!) And btw I still hold that while his brain got changed by trauma (bc trauma DOES THAT) and the hexcore helped amplify and empower him leaning into his worst traits, after Jayce forced that initial fusion everything Viktor did was a choice.

But also!! Jayce used Viktor's notes. Viktor was the one who went down and got shimmer, who lied and experimented in secret. He stumbled into noticing the hexcore responding to biological material but then he pursued that avenue (because LIFE is a lot of stumbling into things and then deciding what to do from there), figured out what interdisciplinary collaborations he needed to make, figured out on his FIRST TRY what runes he would need to put where.

And while they don't lean into the mechanical engineering genius as much as the OG Viktor like...guys that's a software engineer with a big scoop of magic theorist on top of it (who then started a pivot into biomechanical arcane theory like THAT). He made a magic AI! Don't go telling me he didn't use his genius to become the Arcane Herald when he made a magic AI and then I got to watch the hexclaw grabbing and programming runes into spells like the coolest shit ever!!

That man figured out how to make Jayce's ideas into reality. He then used the scant knowledge of the arcane that still exists to figure out and recreate, using technology, what mages do by instinct. He made a MAGIC AI HOLY SHIT. Jayce is STILL referencing Viktor's rune theories to figure out the anomaly!!

He did not use the same type of genius to become the same type of Herald, but my guy invented being a technomancer so hard that he turned himself into a magical supercomputer and was so good at THAT that he made himself a robowizard god and I will not be hearing anything belittling how nuts that is!!
